A public hearing was conducted on June 25, 2025, at 10:00 a.m., with the following present: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Lindsay Oliver Development Review Representative, Mike McRoberts The following business was transacted: �---� I hereby certify that pursuant to a Notice dated May 15, 2025, and duly published May 17, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Noble Energy, Inc., c/o Syrcuit Energy Solutions, Inc., for Use by Special Review Permit, USR25-0006, for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Lindsay Oliver, Department of Planning Services, presented a brief summary of the proposal, described the sign posting and location of the site, and stated there will be 15 employees during construction, and operation will be during daylight hours only, Monday through Saturday. She shared there will be two temporary construction trailers located on site, as well as up to two (2) storage containers for spare parts and materials after construction. Ms. Oliver relayed an operations and maintenance team will visit the site quarterly for routine maintenance, project monitoring, and vegetation control. She shared a dryland seed mixture will be planted on all disturbed areas that will not require irrigation once established, there are three (3) nearby residences, and the applicant is proposing an eight (8) foot game fence around the perimeter of the site, in addition to a six (6) foot tall privacy fence, along a portion of the west and south side of the SEF site, where the residences are located. Page 2 water or sewage disposal service is required, and bottled water and portable toilets will be provided during construction. Ms. Oliver stated 18 surrounding property owners (SPOs) were noticed, and no communication was received. She explained the site is located within the Town of Kersey's Coordinated Planning Agreement area, but is outside the Town's Influence Area, and a Notice of Inquiry (NOI) was submitted which indicated no interest in pursuing annexation. Ms. Oliver entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. Ell Mike McRoberts, Department of Planning Services, Development Review, shared access is onto County Road (CR) 53, which is a local gravel road. He stated the latest average daily traffic counts 205 vehicles per day, with 33`)/0 trucks, and the 85th percentile speed is 56 mph. He relayed construction traffic could be up to 40 semi -trucks delivering equipment, and a Road Maintenance Agreement, for construction only, is required. He stated the site requires double cattle guards and 100 feet of road base or road base on all driving surfaces to serve as permanent tracking control. He explained a Drainage Narrative has been submitted and a Grading Permit is required if more than one (1) acre is disturbed. Melissa Truitt, represented the applicant, and in response to Chair Buck, indicated she had not had contact with any of the Commissioners regarding this case. Ms. Truitt relayed a history of Syrcuit Energy Solutions, and stated there are three (3) residences within 500 feet of the site, one (1) waiver was received, and a Community Meeting was held in Galeton, with three (3) landowners in attendance. Commissioner Ross thanked the applicant for hosting a public meeting. In response to Commissioner Maxey, Ms. Truitt confirmed the applicant intends to install opaque fencing on the sides where the neighbors are located, which will blend with the Colorado Parks and Wildlife (CPW) fencing requirements. No public testimony was offered concerning this matter. El The Board reviewed the Conditions of Approval and Development Standards. Commissioner Maxey suggested DS #19 (sources of light) be stricken and the Board agreed. Page 3 Commissioner Ross moved to approve the request of Noble Energy, Inc., c/o Syrcuit Energy Solutions, Inc., for Use by Special Review Permit, USR25-0006, for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Maxey, and it carried unanimously. There being no further discussion, the hearing was completed at 10:14 a.m. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 9th day of July, A.D., 2025: Perry L.
