Staff finds that this Change of Zone is consistent with Section 23-2-30.A.
S ection 23-2-30.A.1. — That the proposal is consistent with Chapter 22 of the Weld
County.
S ection 23-2-30.A.2. — The uses which would be allowed on the subject property by
granting the change of zone will be compatible with the surrounding land uses.
S ection 23-2-30.A.3. — Adequate water and sewer service can be made available to
the site to serve the uses permitted within the proposed zone district.
S ection 23-2-30.A.4. — Street/Roads providing shall meet the minimum criteria or the
applicant shall enter into an Improvements Agreement.
S ection 23-2-30.A.5. — In those instances where the following characteristics are
applicable to the rezoning request, the applicant has demonstrated compliance with
the applicable standards:
Section 23-2-30.A.5.a. — No Overlay Districts
Section 23-2-30.A.5.b. — Does not interfere with mineral extraction
Section 23-2-30.A.5.c. — Soil limitations can be overcome on a 94% of the
acreage

Hope you are well. Unfortunately, the legal notice that was sent out included the February hearing dates not the
March hearing dates therefore this case was not properly noticed. We will have to send out another legal notice
and schedule this Change of Zone for April 1St (no joke) and a BOCC hearing date 3-5 weeks later. Are there any
wednesdays in late April/early May that you will be unavailable?
