HomeMy WebLinkAbout20251748.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Monday, June 23, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 23, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem — Excused Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Controller, Rusty Williams Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppier seconded the motion and it carried unanimously. 1. Minutes from June , 2025 El Certification of Hearings: Commissioner Maxey moved to approve the below listed Hearing Certificate. Commissioner Peppier seconded the motion, which carried unanimously. 1. Hearing to Allow Public Input Concerning the 2025 Annual Action Plan and its Proposed Use of CDBG Funds for Infrastructure Improvements, Public Facilities, Public Services, Housing Preservation, and General Grant Administration 911 2025-1748 BC0016 Page 2 Monday, June 23, 2025 www.weId.gov ▪ Amendments to Agenda: Commissioner Ross moved to amend the Agenda to remove the following item under 'New Business - General', and renumber the remaining items accordingly. Seconded by Commissioner Maxey, the motion carried unanimously. 1. 2025-1751: Consider Increase of Change Fund for Weld County Sheriff's Office Civil Unit Ei Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Peppler seconded the motion and it carried unanimously. • Warrants: 1. General Warrants: Commissioner Ross moved to approve the General Warrants, as printed. Commissioner Maxey seconded the motion and upon a roll call vote, the motion carried three (3) to zero (0), with Commissioner Pepper abstained. ▪ Bids: 1. Present Bid #B2500077, Demolition of House and Accessory Structures — Department of Public Works: Toby Taylor, Purchasing Department, stated four (4) bids were received and staff will make a recommendation on July 7, 2025. (Clerk's Note: Subsequent to the approval date stated on record, staff determined the bidders did not meet specifications. For details, please see the County Commissioner Minutes from June 30, 2025, known as 2025-1843.) New Business — General: 1. lE9 Consider Temporary Closure of County Road 19 Between State Highway 66 and county Road 34: Amy Mutchie, Department of Public Works, stated the closure will begin July 7, 2025, and go through August 14, 2025, for a full mill and overlay road construction project. She stated the detour route is paved and indicated local access will be maintained throughout the closure. Commissioner Ross moved to approve said temporary closure. The motion was seconded by Commissioner Peppler and it carried unanimously. 2. a Consider Temporary Closure of County Road 48.5 Between County Road 17 and State Highway 257: Ms. Mutchie stated the closure will begin July 7, 2025, and go through August 22, 2025, to re -deck Bridge 48.5/19A and install guardrails. She stated the detour route is paved and indicated local access will be maintained, as needed. Commissioner Ross moved to approve said temporary closure. The motion was seconded by Commissioner Maxey and it carried unanimously. 2025-1748 BC0016 Page 3 Monday, June 23, 2025 www.weId.gov 3. F-1 Consider Temporary Closure of County Road 41 Between State Highway 52 and County Road 22: Ms. Mutchie presented the closure on behalf of AB Underground, which is requested to begin July 7, 2025, and go through September 5, 2025, for the north leg of the intersection improvements project. She stated the detour route is paved, indicated message boards will be placed throughout the duration of the closure along with the use of additional signage to keep traffic on the identified detour route, and noted local traffic will be accommodated, as needed. Commissioner Maxey moved to approve said temporary closure. The motion was seconded by Commissioner Ross and it carried unanimously. 4. Ei Consider Permission to Enter Property Form and Authorize Chair to Sign — Poudre Valley Rural Electric Association (PVREA) and Hunt, Guillot, and Associates, LLC: Bruce Barker, County Attorney, explained the agreement allows for the County to give consent to Poudre Valley REA and Hunt, Guillot, and Associates, LLC, to enter County property for land surveying purposes. He further explained the property is a triangular tract of land located east of County Road (CR) 15 and immediately north of CR 60, which was conveyed to the County in 1910. Mr. Barker stated, in the past 115 years, there has never been any county business conducted on said land, but it does seem to be of interest to other entities to conduct surveying. He noted, from the County's perspective, there is a pond located on the property that is used privately, and the concern is, if it being used for recreational purposes there is no governmental immunity for properties that are recreational in nature. Commissioner Maxey moved to approve said agreement and authorize Chair to sign. Commissioner Ross seconded the motion and further concurred with Mr. Barker and his assessment of the property. There being no further discussion, the motion carried unanimously. New Business — Planning: 1. IE Consider Consent to Enforcement of 2024 International Fire Code, with Amendments, Within Certain Areas of Unincorporated Weld County Lying Within Platteville-Gilcrest Fire Protection District: Mr. Barker explained, when a fire district operates in unincorporated Weld County and wishes to update their fire codes, they must gain consent by the County Commissioners. He indicated staff reviewed the changes and ensured there is nothing that conflicts with the County's building code requirements, and stated staff recommends granting the consent to enforce the 2024 International Fire Code. In response to Commissioner Maxey, Mr. Barker explained should the fire district uphold or enforce any code that is in conflict with the County's Building Codes, the Board has the ability to de -consent to enforcement of any amendments to the fire code within the unincorporated areas of the county. Commissioner Ross shared his concerns regarding the potential effects of future discussions regarding municipal and County coordinated planning agreements. Seconded by Commissioner Ross, the motion carried unanimously. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
