Gentlemen:
As you have probably heard by now, a decision was rendered
in District Court on July 15th, favoring Weld County in the
action brought by the State Department of Social Services to
have a restraining order placed on Weld County to force the
issue of exceeding the Maximum Statutory Mill Levy for Welfare.
The decision by the presiding judge in favor of Weld County
is a major break-through for all the counties of the State of
Colorado. Basically proving that Boards of County Commissioners
do have the authority and the right not to exceed their Maximum
Statutory Mill Levy.
The State Department of Social Services will undoubtedly
appeal to the State Supreme Court for a final decision, but
after the decision in Weld County, we are hopeful that the
Supreme Court will look favorably at the counties.
As the State Chairman of the Relief and Welfare Committee
for the County Commissioners Association, I shall continue to
work to draft legislation to further improve the standing
throughout all the counties.
We are once again requesting your help in this matter and
as had asked in a previous letter dated June 30, 1971, we
need to have an answer from all counties stating your opinion
in favor or disapproving of our position.
This request is most urgent and we need an immediate
answer.
