Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Molly Wright Development Review Representative, Mike McRoberts The following business was transacted: I hereby certify that pursuant to a Notice dated June 16, 2025, and duly published June 18, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Genaro Nunez and Rosa Maria Vega de Nunez, for Change of Zone, COZ25-0004, from the R-3 (Medium Residential) and A (Agricultural) Zone Districts to the R-3 (Medium Residential) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Molly Wright, Department of Planning Services, presented a brief summary of the proposal and stated there is one (1) parcel, totaling approximately five (5) acres, of which approximately 0.62 acres is currently zoned A (Agricultural), and noted the approval of the Change of Zone (COZ) will result in the whole parcel being zoned R-3 (Medium Residential), and will resolve the split zoning, which occurred in March, 1965. She indicated the applicant wants to build a duplex, which will result in a total of three (3) living units, and mentioned the existing residence is served by the North Weld County Water District (NWCWD), and the duplex will be served by a properly permitted well and a half - tap by the NWCWD. She relayed the site is within the 100 -year Special Flood Hazard Area, which will require the applicant to obtain a Flood Hazard Development Permit, prior to the construction of any future buildings. She stated notice was sent to 17 surrounding property owners (SPOs), resulting in one (1) call and one (1) email, both with general questions. Ms. Wright indicated the site is located within the Coordinated Planning cc : PL(DE/MNbA/Nw/ICR2025-2149 091ois/25 PL2964 Hearing Certification (COZ25-0004) — Genaro Nunez and Rosa Maria Vega de Nunez Page 2 Agreement (CPA) area of the City of Evans and the Town of Kersey, neither of which wish to pursue annexation, and within the three (3) mile referral area of the City of Greeley. She displayed images of the surrounding zoning, Use by Special Review (USR) permits, the draft plat, the site, and surrounding views. She entered the favorable recommendation of the Planning Commission into the record, as written, and in response to Commissioner Maxey, indicated there is no history of a Lot Line Adjustment or Resubdivision, rather, the parcel was just established with split zoning. Mike McRoberts, Department of Planning Services, Development Review, stated access to the site is on Fern Avenue. Mark Taylor, with Alles, Taylor and Duke, represented the applicant, and in response to Chair Buck, indicated he had not had contact with any of the Commissioners regarding this case. He stated he had nothing additional to add, but relayed that staff did a good job presenting the case. No public testimony was offered concerning this matter. Commissioner Ross moved to approve the request of Genaro Nunez and Rosa Maria Vega de Nunez for Change of Zone, COZ25-0004, from the R-3 (Medium Residential) and A (Agricultural) Zone Districts to the R-3 (Medium Residential) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Maxey and it carried unanimously. There being no further discussion, the hearing was completed at 10:10 a.m. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 20th day of August, A.D., 2025: Perry L.
