Approve Biennial Renewal Application for Optional Premises (County) Liquor
License from Fritzler Farms, Inc., dba Fritzler Farm Park, and Authorize Chair to
Sign — Expires September 9, 2027
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Ruie Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, pursuant to Articles 3 and 4, Title 44, C.R.S., Colorado Liquor Rules,
1 CCR 203-2:47-303, and Chapter 12 of the Weld County Code, licensees in good
standing may request to renew their license for a two-year period on a biennial basis,
subject to further terms and conditions, and
Whereas, Fritzler Farms, Inc., dba Fritzler Farm Park, presented to the Board of County
Commissioners of Weld County, Colorado, an application for the biennial renewal of an
Optional Premises (County) Liquor License, for the sale of malt, vinous, and spirituous
liquors for consumption by the drink on the premises only, subject to the rules and
regulations found in Article 3, Title 44, C.R.S., at an establishment outside the corporate
limits of any town or city in the County of Weld at the location described as follows:

Whereas, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid the
sum of $175.00 to the County of Weld for renewal of the existing license for the first year
of the biennial period, and
Whereas, said applicant has paid the sum of $750.00 to the Colorado Department of
Revenue for renewal of the existing license for the first year of the biennial period, and
Whereas, the Licensee shall require "responsible vendor" training of each employee, as
agreeable to the Colorado Department of Revenue, Liquor Enforcement Division, and the
Licensee shall provide documentary evidence that each employee has been "responsible
vendor" trained upon request by the Weld County Sheriff's Office or the Colorado Liquor
Enforcement Division.
Now, therefore, be it resolved that the Board af County Commissioners of Weld County,
Colorado, having examined said application and the other qualifications of the applicant,
does hereby grant License Number 2025-07 to said applicant to sell malt, vinous, and
spirituous liquors for consumption by the drink on the premises only at said location; and
the Board does hereby authorize and direct the issuance of said license by the Chair of
the Board of County Commissioners, attested to by the Clerk to the Board of Weld County,
Colorado, which license shall be in effect until September 9, 2027, providing that said
licensee operates in strict conformity to all of the laws of the State of Colorado and the
rules and regulations relating thereto, per Article 3, Title 44, C.R.S., heretofore passed by

the Board of County Commissioners of Weld County, Colorado, and any violations thereof
shall be cause for revocation of the license.
Be it further resolved by the Board that pursuant to Articles 3 and 4, Title 44, C.R.S.,
Colorado Liquor Rules, 1 CCR 203-2:47-303, and Chapter 12 of the Weld County Code,
Fritzler Farms, Inc., dba Fritzler Farm Park, be, and hereby is, found in good standing,
and be, and hereby is, approved to renew their license for a two-year period on a biennial
basis, subject to further terms and conditions. Such approval is contingent on payment of
the annual renewal application fee contained in Appendix 5-H of the Weld County Code
by April 15, 2026, for the second year of the biennial period.
Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign
said application and license.

am signing this Tax Check Authorization, Waiver and Request to Release Information (hereinafter
"Waiver") on behalf of
the "A IicanULicensee"
Fritzler Farms, lnc., dba Fritzler Farm Park
to permit the Colorado Department of Revenue and any other state or local taxing authority to release
information and documentation that may otherwise be confidential, as provided below. If I am signing
this Waiver for someone other than myself, including on behalf of a business entity, I certify that I have
the authority to execute this Waiver on behalf of the Applicant/Licensee.
The Executive Director of the Colorado Department of Revenue is the State Licensing Authority, and
oversees the Colorado Liquor Enforcement Division as his or her agents, clerks, and employees. The
information and documentation obtained pursuant to this Waiver may be used in connection with the
Applicant/Licensee's liquor license application and ongo�g licensure by the state and local licensing
authorities. The Colorado Liquor Code, section 44-3-101. et seq. ("Liquor Code"), and the Colorado
Liquor Rules, 1 CCR 203-2 ("Liquor Rules"), require compliance with certain tax obligations, and set
fo�th the investigative, disciplinary and licensure actions the state and local licensing authorities may
take for violations of the Liquor Code and Liquor Rules, including failure to meet tax reporting and
payment obligations.
The Waiver is rnade pursuant to section 39-21-113(4), C.R.S., and any other law, regulation, resolution
or ordinance cmcerning the confidentiality of tax information, or any document, report or return filed
in connection with state or local taxes. This Waiver shall be valid until the expiration or revocation
of a license, or until both the state and local licensing authorities take final action to approve or deny
any application(s) for the renewal of the license, whichev�er is later. ApplicanULicensee agrees to
execute a new wraiver for each subsequent licensing period in connection with the renewal of any
license, if requested.
By signing below, Applicant/Licensee requests that the Colorado Department of Revenue and any
other state or local taxing authority or agency in the possession of tax documents or information,
release information and documentation to the Colorado Liquor Enforcement Division, and is duly
authorized employees, to act as the Applicant's/Licensee's duly authorized representative under
section 39-21-113(4), C.R.S., solely to allow the state and local licensing authorities, and their duly
authorized employees, to investigate compliance with the Liquor Code and Liquor Rules. Applicant/
Licensee authorizes the state and local licensing authorities, their duly authorized employees, and
their legal representatives, to use the information and documentation obtained using this Waiver in any
administrative or judicial action regarding the application or license.

Summary: AMUSR-1268 was approved in 2014; this amendment is to permit the addition of

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The proposed change(s) will be compatible with exrsfing and allowed uses in the surrounding area
and be in harmony with the neighborhood.
The Use by Special Review (USR) AMUSR-1268 map was recorded in October 7, 2005 for a
Site Specific Development Plan and Amended Use by Special Review Permit #1268 is for a

Rea-eational Facility, with uses similar to those seen at a Guest Farm and Fairgrounds in the A
(Agricultural) Zone District. The applicant has made some modifications to their previously
approved USR and therefore is amending their application to stay in compliance with Weld
County. Some of the changes to the corn maze include a beer garden, escape room, mini golf,
zip ine, pumpkin stroll, haunted bam and some year round activates such as an escape room,
event room and a brewery. The boundaries of the Use by Special Review will also expand to
incl�de the entire Lot D of corrected RE-3966.
Several of the neighbors objected to the beer garden and the ability of the facility to serve liquor.
The Board of County Commissioners on August 26, 2015 approved a Tavern License for the
faciity. The proposed development standards and conditions of approval will help ensure the use
remains compatible with the surrounding area.
2. The proposed change(s) is consistenf with the County Comprehensive Plan pursuant to Chapter
22 of the Weld County Code.
ECON.Policy 3.1. County activities and regulation should protect the rights of private property
owners and the public health, safety and welfare, recognizing that these basic rights and
pro6ections allow the free market to prosper and groW the local economy.
The applicant is requesting to expand their existing Use by Special Review to include additional
attractions at the corn maze and some year round activates such as an escape room, event room
and a brewery. Some of the surrounding properties are concemed with liquor being served. A
Tavem License was approved by the Board of Couniy Commissioner on August 26, 2015 to serve
liquor at the facility.
3. The proposed change(s) will not result in a substantia/ adverse impact on the other property in the
vicinity of fhe subject property.
AMUSR-1268 was approved by the Weld County Board of County Commissioners and the map
was recorded on October 7, 2005 for a Site Specif� Development P{an and Amended Use by
Special Review Permit for a Recreational Facility, with uses similar to those seen at a Guest Farm
and Fairgrounds in the A(Agricultural) Zone District.
The County notified all the property owners within 50D-feet of the request to amend AMUSR-1268
to include additional attractions at the com maze and some year round activates such as an escape
room, event room and a brewery. Some surrounding property owners did comment on this
application but their comments mainly pertained to the facility serving liquor which has already been
approved by the Board of County Commissioners.
4. The recommendatrons of the referral agencies have been considered.
The attached Development Standards and Conditions of Approval address the requirements of the
referral agencies.
5. Not deemed to be a major change.
After the Pre-Application meeting on April 30, 2015 Weld County Planning staff determined the
proposed modifications were not a major change to the current permit.
6. Must be consistent with the original development standards.
The previous USR was approved for a Recreational Facility, with uses similar to those seen at a
Guest Farm and Fairgrounds in the A(Agricultural) Z,one District. The proposed modifications are
to aAow additional attractions at the corn maze and some year round activates such as an escape
room, event room and a brewery. The attached development standards incorporate the

development standards approved under AMUSR-1268 but have been updated and expanded to
ref�ct cu�rent regulations.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, dther relevant information regarding the request, and responses from referral entities.
1. The map shall be amended to delineate the following:

D. County Road 44 is a paved road and is designated on the Weld County Road
Classification Plan as an arterial road which requires 140 feet of right-of-way at full
buildout. The applicant shall delineate on the site plan the future and existing right-
of-way. All setbacks shall be measured from the edge of future right-of-way. This

2. Prior to Recording the Map:

4. Upon completion of 1-2 above the applicant shall submit one (1) paper copy or one (1) electronic
copy of the map for preliminary approval to the Weld County Department of Planning Services.
Upon approval of the paper copies the applicant st�all submit a Mylar map along with all other
documentation required as Conditions of Approval. The Mylar map shall be recorded in the office
of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The map shall
be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code.
The Mylar map and additional requirements shall be submitted within sixty (60) days from the dabe
of the Board of County Commissioners resolution. The applicant shall be responsible for paying
the recording fee.
5. In accordance with Weld County Code Ordinance 2006-7 approved June 1, 2006, should the map
not be recorded within the required sixty (60) days from the date the Board of County
Commissioners resolution a$50.00 recording continuance charge shall added for each additional

6. The Department of Planning Services respectively requests the surveyor provide a digital copy of
this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format
type is .e00. The prefened format for Images is .tif (Group 4). (Group 6 is not acceptable). This
digital file may be sent to maps co.weld.co.us.
7. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review mapis ready to be recorded in the office of the Weld County
Clerk and Recorder.

1. A Minor Amendment to a Site Specific Development Plan and Use by Special Review Permit No
AMUSR-1268 for a Recreational Facility, with uses similar to those seen at a Guest Farm and
Fairgrounds to include an escape room modular, brewery, ticket office, concession building,
modular trailer haunt, beer garden, tetherball, tire climb, dog agility show, and other similar
activities in the A(Agricultural) Zone District.
2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code.
3. The applicant shall maintain compliance with the Department of Labor and Employment, Oil and
Public Safety &CCR 1101-12, carnivals and amusement parks regulations at all times.
4. As indicated rn the application materials the maximum number of customer allowed on the site at
one time shall be 2,000.
5. The site may operate from the last week in August until the weekend after Halloween seven days
a week from 9:00 am to midnight with the exception of the produce stand which may operabe from
the first of July through the end of September from 9:00 am to 6:00 pm.
6. The brewery, escape room and event room shall be allowed to function year round from 9:00 am
to midnight.
7. The applicant shall have an insurance policy written by an insurance company authorized to do
business in the State of Colorado or by a surplus lines insurer in an amount of not less than
$100,000 per occurrence with a$300,000 annual aggregate for class A amusement rides (as
designated by the Department of Labor and Employment) and all other recreational amenities
insuring the owner or operator against liability for injury to persons arising out of the use of the
amusement rides.
8. Should the applicant place any Class B amusement rides on the site (as designated by the
Department of Labor and Employment) they shall obtain an insurance policy written by an
insurance company authorized to do business in the State of Colorado or by a surplus lines
insure, in an amount of not less than a$1 Million per Occurrence insuring the owner or operator
against liability for injury to persons arising out of the use of the amusement rides.
9. No Smoking signs shall be placed in sufficient locations to ensure �re will not be allowed near
corn stalks or flammable areas.
10. No oommercial all-terrain vehicle (AN) courses shall be allowed on the site.
11. The two semi trailer being used as storage units shall be an allowed use from the date of
approval by the Board of County Commissioners. The trailer shall be maintained in drivable
conditions and shall maintain current licensing.
12. The applicant shall install a trash collector at the cuive�t located at the intersection of Weld
County Road 33 and U.S. Highway 85. The type of device shall be agreed upon by the applicant
and western mutual ditch company and the applicant shall be responsible for any costs
associated with the project.
13. The screening and landscaping on the site shall be maintained per the map.

14. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicanUlandowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
15. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsiDe tracking.
16. There shall be no parking or staging of vehicles on pubtic roads. On-site parking shall be utilized.
17. The historical flow patterns and runoff amounts will be maintained on the site.
18. Weld County is not responsible for the maintenance of onsite drainage related features.
19. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30 20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
20. No permanent disposal of wastes shall be permitted at this site. This is not meant �o include
thase wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
21. The applicant sha�l remove, handle, and stockpile manure from the animal areas in a manner that
will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to
a aondition that facilitates excessive odors, flies, insect pests, or pollutants.
22. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that
ve�rnin infestation, odors, disease hazards, and nuisances are minimized.
23. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The
applicant shall operate in accordance with Chapter 14, A�ticle 1 of the Weld County Code.
24. FugRive dust should attempt to be confined on the property. Uses on the property should comply
with the Colorado Air Quality Commission's air quality regulations.
25. There shall be no open burning conducted on the s�e, with exception to buming de�ned as
`agricultural open burning" as defined by Regulation No. 9 of the Colorado Air Quality Control
Canmission Regulations.
26. This facility shall adhere to the maximum permissibie noise levels allowed in the Non-Specified
Zone as delineated in Section 14-9-30 of the Weld County Code.
27. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons
of the facility, at all times. For temporary or seasonal uses that are utilized 6 months or less per
year portable toilets and bottled water are acceptable. Records of maintenance and proper
disposal for portable toilets shall be retained on a quarterly basis and available for review by the
Weld County Department of Public Health and Environment. Portable toilets shall be serviced by
a cleaner licensed in Weld County and shall contain hand sanitizers.
28. Any septic system located on the property must comply with all provisions of the Weld County
Code, pertaining to On-site Wastewater Treatment Systems.
29. A permanent, adequate water supply shall be provided for drinking and sanitary purposes for
uses that are not considered temporary. The facility shall utilize the existing public water supply,
(Central Weld County Water District).

goveming the regulation of food service establishments.
31. The operation shall comply with all applicable rules and regulations of the State and Federal
agencies and the Weld County Code.
32. Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties
where such would cause a nuisance or interfere with the use on the adjacent properties in accordance
with the plan. Neither the direct, nor reflected, light from any light source may create a traffic hazard
to operators of motor vehicles on public or private strsets. No colored lights may be used which may
be aonfused with, or construed as, traffic control devices.
33. Building permits may be required, per Section 29-3�10 of the Weld County Code. Currently, the
folbwing have been adopted by Weld County: 2012 International Codes, 2006 International
Eriergy Code, and 2011 National Electrical Code. A Building Permit Application must be
completed and two (2) complete sets of engineered plans bearing the wet stamp of a Colorado
registered architect or engineer must be submitted for review. A Geotechnical Engineering Report
performed by a Colorado registered engineer shall be required or an Open Hole Inspection.
34. The property owner or operator shall be responsibie for complying with the Design and Operation
Standards of Chapter 23 of the Weld County Code.
35. Necessary personnel from the Weld County Departments of Planning Services, Public Works, and
Piblic Health and Environment shall be granted acoess onto the property at any reasonable time in
order to ensure the activities carried out on the property comply with the Conditions of Approval and
Development Standards stated herein and all applicable Weld County regutations.
36. The Use by Specia� Review area shall be limited to the plans shown hereon and governed by the
foregoing standards and all applicable Weld County regulations. Substantial changes from the plans
or Development Standards, as shown or stated, shall require the approval of an amendment of the
Pamit by the Weld County Board of County Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
37. The property owner or operator shall be �esponsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may be
reason for revocation of the Permit by the Board of County Commissioners.
38. RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld Caunty has some of the most
atwndant mineral resources, including, but not lirnited to, sand and gravel, oil, natural gas, and
coal. Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the
state's commercial mineral deposits are essential to the state's economy; (b) the populous counties
of the state face a critical shortage of such deposits; and (c) such deposits should be extracted
according to a rational plan, calculated to avoid waste of such deposits and cause the least
practicable disruption of the ecology and quality of life of the citizens of the populous counties of
the state.
Mineral resource locations are widespread throughout the County and person moving into these
areas must recognize the various impacts associaied with this development. Often times, mineral
resource sites are fixed to their geographical and geophysical locations. Moreover, these
resources are protected property rights and mineral owners should be afforded the opportunity to
e�ract the mineral resource.
39. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural
caunties in the United States, typically ranking in the top ten counties in the country in total market
value of agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must recognize and
aacept there are drawbacks, including conflicts with long-standing agricultural practices and a lower

level of services than in town. Along with the drawbacks come the incentives which attract ufian
dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and
congestion, and the rural atmosphere and way of life. Without neighbo�ing farms, those features
which attract urban dwellers to rural Weld County w�ould quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; stow-moving
farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from
animal confinement, silage and manure; smoke from ditch buming; flies and mosquitoes; hunting
and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides
and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural
producers to utilize an accumulation of agricultura► machinery and supplies to assist in their
agricultural operations. A concentration of miscellaneous agricultural materials often produces a
visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides
that an agricultural operation shall not be found to be a public or private nuisance if the agricuftural
operation alleged to be a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Water has been, and continues to be, the lifeline fQ the agricultural community. It is unrealistic to
assume that ditches and reservoirs may simply be moved "out of the way" of residential
development. When moving to the County, property owners and residents must realize they cannot
take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right
to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice
the size of the State of Delaware) with more than t�ree thousand seven hundred (3,700) miles of
stabe and County roads outside of municipalities. The sheer magnitude of the area to be served
stretches available resources. Law enforcement is based o� responses to complaints more than
on patrols of the County, and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by
volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,
no matter how often they are bladed, will not provide the same kind of surface expected from a
paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be
cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not
be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than
urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and
tivestock, and open burning present real threats. Controlling children's activities is important, not
only for their safety, but also for the protection of the farmer's livelihood.
