Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli El Minutes: Commissioner Ross moved to approve the minutes from February 3, 2025, as printed. Commissioner James seconded the motion and it carried unanimously. • Minutes: Commissioner Maxey moved to approve the minutes from February 5, 2025, as printed. Commissioner Peppler seconded the motion and it carried unanimously. IE Certification of Hearings: Commissioner Ross moved to approve the below listed Hearing Certificate. Commissioner James seconded the motion, which carried unanimously. 1. USR24-0023 — Parkview Apartments, LLC, do SunShare, LLC, dba Periwinkle Solar, LLC, Longspur Solar, LLC, and 1876 Solar, LLC • Amendments to Agenda: There were no amendments to the Agenda. IR Approval of Consent Agenda: Commissioner James moved to approve the Consent Agenda, as printed. Recognition of Services, Workforce Development Board — Rich Werner: Chair Buck read the certificate for the record and the Board thanked Rich Werner for his voluntary contributions on the Workforce Development Board for the past ten (10) years for the citizens of Weld County. Warrants: 1. General Warrants — February 12,14, and 18, 2025: Commissioner James moved to approve the General Warrants, as printed. Commissioner Ross seconded the motion and it carried unanimously. Bids: 1. Approve Bid #62500011, Long -Term Document Storage — Facilities Department: Toby Taylor, Purchasing Department, reviewed the criteria staff used to consider each of the bids received, and stated staff recommends selecting the lowest bidder who met specifications, RAZR Logistics, LLC, for a total amount not to exceed $87,300.00. Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner James and it carried unanimously. 2. El Approve Bid #62500004, Household Hazardous Waste Pickup and Disposal Services — Department of Public Health and Environment: Mr. Taylor stated staff recommends selecting the lowest bidder who met specifications, Veolia ES Technical Solutions, LLC. Commissioner Maxey moved to approve said bid. The motion was seconded by Commissioner Peppier and it carried unanimously. 3. El Present Bid #B2500009, Dacono Grader Shed — Facilities Department: Mr. Taylor stated eleven (11) bids were received, with two (2) being deemed non -responsive, and staff will make a recommendation on March 5, 2025. 4. El Present Bid #B2500010, Wireless Irrigation Controls — Facilities Department: Mr. Taylor stated four (4) bids were received and staff will make a recommendation on March 5, 2025. 5. Consider Contract ID #9086 2025 Edward Byrne Memorial Justice Assistance Grant (JAG) Program Application for Jail Campus Public Space Emergency Response Plan and Equipment, and Authorize Sheriff's Office to Submit Electronically: Sonja Kohlgraf, Sheriff's Office, recommended approval of the application for grant funds, in the amount of $13,010.00, to purchase equipment for the public spaces at the Jail Campus as part of the emergency response plan. Commissioner Maxey moved to approve said application and authorize the Sheriff's Office to submit electronically, which was seconded by Commissioner James, and it carried unanimously. 2. IE Consider Adoption of Weld County Comprehensive Emergency Management Plan: Roy Rudisill, Director of the Office of Emergency Management, gave a brief overview of the updates made to the Emergency Management Plan for Weld County, which focused on changes to align county finances with federal grant guidance requirements. He explained the Colorado Revised Statute requires each County to a have a current and up-to-date plan and/or a current Health Medical Annex. Commissioner James commended staff for their efforts in making sure Weld County is prepared in the event of an emergency, and further moved to approve the adoption of said plan. The motion was seconded by Commissioner Maxey and it carried unanimously. 3. a Consider Contract ID #9088 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Melissa Cooper: Tami Grant, Deputy Director of the Department of Human Services, stated the contract is for a new certified kinship foster care home located in Colorado Springs, Colorado. Commissioner Ross moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 4. eConsider Contract ID #9089 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Fredy Arnulfo Diaz Coreas and Kenia Guevara -Guerra: Ms. Grant stated the contract is for a certified kinship foster care home located in Denver, Colorado. Commissioner Ross moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 5. a Consider Contract ID #9090 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Lloyd and Christal Roberts: Ms. Grant stated the contract is for a new provisional kinship foster care home located in Firestone, Colorado. Commissioner Maxey moved to approve said contract and authorize the Chair to sign. Consider Contract ID #9091 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Blaise and Kristen Hockel: Ms. Grant stated the contract is for a new provisional kinship foster care home located in Loveland, Colorado. Commissioner James moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 7. El Consider Contract ID #9092 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — George and Lora Lawrence: Ms. Grant stated the contract is for a new provisional kinship foster care home located in Frederick, Colorado. Commissioner Peppler moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 8. El Consider Contract ID #9093 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Michael Ortiz and Carmen Gallegos: Ms. Grant stated the contract is for a new provisional kinship foster care home located in Denver, Colorado. In response to Chair Buck, Ms. Grant explained the difference between provisional and fully certified contracts related to foster care certification timeline requirements provided by the state. Commissioner James moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 9. a Consider Contract ID #9101 Individual Provider Contract for Purchase of Foster Care Services in a Foster Care Home and Authorize Chair to Sign — Jerome and Lola Martin: Ms. Grant stated the contract is for a certified kinship foster care home located in Frederick, Colorado. Commissioner Peppler moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 10. 1D Consider Contract ID #9120 Federal Highway Safety Improvement Program (HSIP) Local Agency Application for Intersection Conflict Warning Systems (ICWS) at Various Locations and Authorize Department of Public Works to Submit Electronically: Elizabeth Relford, Department of Finance, requested to submit said application, on behalf of the Department of Public Works, to the Colorado Department of Transportation (CDOT) Region 4 for funds in the amount of $3.9 Million, for the 2027-2028 state fiscal year call for projects. She identified three (3) locations for the record, which were on the Capital Improvement Plan (CIP) and currently meet the threshold of requirements by CDOT to utilize said funds, in the amount of $375,000.00, for the installation of traffic lights for intersection safety improvement initiatives. Ms. Relford explained two (2) out of the three (3) locations, are shared with the state, meaning the County's ten percent (10%) match can also be shared, reducing the match to five percent (5%) or $12,500.00, if the state does, in -fact, share the match. In 2025-0479 BC0016 Page 5 Wednesday, February 19, 2025 www.weld.gov response to Commissioner Peppler, Ms. Relford explained if the state chooses not to share the matching cost with the County, then the County would be responsible for $37,500.00. Commissioner James moved to approve said application and authorize the Chair to sign. The motion, which was seconded by Commissioner Maxey, carried unanimously. 11. eConsider Acceptance of Deed of Dedication for Purchase of Public Road Right -of -Way for County Road 66 Corridor Project and Authorize Chair to Sign — Lytle Farms, LLC: Bruce Barker, County Attorney, on behalf of Clay Kimmi, Department of Public Works, indicated this and the following item are to be considered together, and stated staff recommends acceptance of the deed for each property. Commissioner Ross moved to approve acceptance of said deed and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 12. a Consider Acceptance of Deed of Dedication for Purchase of Public Road Right -of -Way for County Road 66 Corridor Project and Authorize Chair to Sign — Kaycee Lytle: Commissioner Ross moved to approve acceptance of said deed and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 13. IE Consider Extension to Temporary Road Closure of County Road 44 Between County Roads 51 and 53: Amy Mutchie, Department of Public Works, explained the closure was approved for approximately five (5) months that began October 14, 2024, and was scheduled to reopen February 28, 2025; however, due to unforeseen additional required road improvements, staff requests the closure to be extended an addition six (6) weeks through April 8, 2025, to complete the construction and final paving. Commissioner Maxey moved to approve said extension of the temporary closure. The motion was seconded by Commissioner Ross and it carried unanimously. 14. Ei Consider Temporary Closure of County Road 80 Between County Roads 29 and 31: Ms. Mutchie stated the requested the closure was presented and approved by the Board on February 5, 2025; however, due to inclimate weather, the closure never took place. She indicated the department now requests the closure to begin February 24, 2025, and go through February 28, 2025, to replace an irrigation culvert, and she noted the detour route is paved. Commissioner Ross moved to approve said temporary closure. IE Consider Temporary Closure of 17 Between County Road 28 and State Highway 66: Ms. Munchie requested the closure to begin February 26, 2025, and go through June 13, 2025, for the replacement of Bridge 17/28A. She stated magnesium chloride will be used for dust control, as needed, on the gravel portion of the detour route and message boards will be placed in advance of said closure. Commissioner Maxey moved to approve said temporary closure. The motion was seconded by Commissioner Ross and it carried unanimously. 16. El Consider Biennial Renewal Application for Tavern (County) Liquor License and Authorize Chair to Sign — RM, Inc., dba Room 119: Matthew Conroy, Assistant County Attorney, reviewed the location and history of the establishment, indicated staff does have one (1) minor concern with an interior remodel, but the applicant is working with staff to resolve the issue and it should not affect the renewal, therefore, staff recommends approval. Commissioner Ross moved to approve said renewal application. The motion was seconded by Commissioner Maxey and it carried unanimously. 17. IRConsider Client Engagement Agreement Regarding Federal Advocacy and Authorize Chair to Sign — Purple Label Government Solutions, LLC: Commissioner Ross stated the agreement allows for the County to engage with a lobbyist firm for representation in Washington, D. C., concerning federal legislation. Commissioner James moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 18. a Consider Appointment to Workforce Development Board: Commissioner Maxey moved to approve said appointment. The motion was seconded by Commissioner James and it carried unanimously. New Business — Ordinances: 1. Second Reading of Code Ordinance #2025-01, in the Matter of Repealing and Reenacting, with Amendments, Chapter 27 Planned Unit Development of the Weld County Code (Amendments to Existing PUDs): Commissioner James moved to read Code Ordinance #2025-01 by title only. The motion was seconded by Commissioner Ross, and it carried unanimously. Mr. Barker read the title for the record. Maxwell Nader, Department of Planning Services, reviewed the proposed changes, noted there are no additional changes since First Reading, and indicated staff recommends approval. No public testimony was offered concerning this matter. Commissioner Maxey moved to approve Code Ordinance #2025-01 on Second Reading. The motion was seconded by Commissioner James and it carried unanimously. 2025-0479 BC0016 Page 7 Wednesday, February 19, 2025 www.weld.gov New Business — Planning: 1. Consider Certification to Weld County Treasurer of Zoning Violation Penalties as Special Assessment — Consuelo Hernandez (Cont'd from 11/18/2024): Adria Schiel, Assistant County Attorney, provided an overview of the on -going violations on the property owned by Consuelo Hernandez, which include cargo containers and a non-commercial junkyard, since 2021. She explained the matter was last heard by the Board on November 18, 2024, where staff confirmed Ms. Hernandez had removed the cargo containers, but other items still remain, thus the property is still in violation due to the existence of the non-commercial junkyard. Ms. Schiel informed the Board, upon staff's inspection of the property on February 11, 2025, there is now evidence of occupants residing in recreational vehicles (RVs) on the property, which is a violation of the Weld County Code. However, she clarified, due to occupancy of RVs not being part of the original violations with the court assessed penalties, the County will be re -filling a case in the Weld County Court to address the added concern, and the Board cannot consider the RV occupancy factor at this time. Cynthia Villanueva, Department of Planning of Services — Code Compliance, shared photographic evidence reflecting the current state of the property. She explained, despite the property owner's attempt to address the issues, the property remains in violation. In response to Commissioner Maxey, Ms. Schiel explained the Board needs to determine if the property owner is in violation of the Weld County Code, and if so, the penalties, in the amount of $16,600.00, are certified as a special assessment with the Treasurer's Office. She further explained, due to the fact the cargo containers have been removed, the Board can choose to certify a lesser amount if desired. Ms. Schiel indicated staff's recommendation is to certify rather than considering another continuation due to the case already being in violation since 2021, and there simply has not been enough progress given the addition time already received. Consuelo Hernandez, property owner, confirmed the cargo containers were removed, but explained due to inclimate weather it has limited her and her mother's ability to remove the remaining debris from their property. She further explained, despite requesting assistance from the Sheriff's Office to remove the squatters living the RVs, it has become apparent that their removal from the property will have to involve eviction and court proceedings. In response to Commissioner James, Ms. Hernandez's mother indicated she does not intend to proceed with attempting to clear the property until the seasons change providing warmer weather. Following discussion, Commissioner Ross moved to approve the certification, in -part, to assess 10% of the proposed penalties, in the amount of $1,660.00, as a special assessment to the Treasurer's Office with consideration of the attempts made from the property owner. Edwin Grant, City of Greeley resident, offered his comments to the Board.
