Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Maxwell Nader Department of Planning Services — Development Review, Melissa King The following business was transacted: (Clerk's Note: Recordation began at the point of Deputy County Attorney's legal description.) hereby certify that pursuant to a Notice dated February 14, 2025, and duly published February 19, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of 6045 County Road 6 Trust, for Use by Special Review Permit, USR23-0046, for a Residential Therapeutic Center, outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. El Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, described the sign posting, stated 15 surrounding property owners (SPOs) were noticed, and two (2) SPOs returned comments with concerns regarding impacts of the potential of two (2) facilities related to traffic, infrastructure, zoning, general safety, property values, and traffic. He shared, per the Development Review staff, the parcel has an existing unpermitted access onto County Road (CR) 6, which does not meet the minimum access spacing criteria, thus, this access will be closed and reclaimed, and a new access point onto CR 6 will be utilized. He shared the County will be replacing the existing intersection of CR 6 and 13 with a roundabout, which will require additional cc : PL (UE/MNNIK) 04/3o/2S 2025-0765 PL2947 Hearing Certification (USR23-0046) - 6045 County Road 6 Trust Page 2 right-of-way, and during this development, the County will relocate and permit the new access for the project site. He relayed the Traffic Narrative has been accepted, and the site meets the stormwater exception detention, per the Drainage Narrative. Per the Department of Public Health and Environment staff, the existing residence has a tap from the Central Weld County Water District and a septic system that is permitted for six (6) bedrooms. He explained a septic system was permitted in 2019, to replace an existing failing system, and an Engineer review is required to ensure the system is adequate for additional usage, which is covered in Condition of Approval (COA) #1.D. He further stated the future residential treatment facility will require an engineered septic system for commercial use and COA #5.A requires the system be installed prior to issuance of a Certificate of Occupancy. He stated COA #1.A requires the applicant to address comments from the Central Weld County Water District, and the Department may require additional licenses or registrations addressed in DS #13. He explained Environmental Health (EH) has two (2) COAs and DS #8 thru #14 cover EH items. Mr. Nader described the surrounding uses and pointed out the aerial view of the site. He explained the site is located within the three (3) mile referral area of the Town of Erie, Cities of Fort Lupton, Northglenn, and Dacono, all of whom responded with no concerns. Mr. Nader entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. In response to Commissioner Maxey, Melissa King, Development Review, confirmed improvement of the intersection consists of a roundabout being installed, which will require relocation of the access point. In response to Commissioner Ross, Mr. Nader confirmed all septic impact of the area shall be reviewed. Responding to Commissioner Maxey, Ms. King confirmed adequate tracking control is required, per Code, because CR 6 is an arterial road, and dirt and debris on the road hinders the braking process. In further response to Commissioner Ross, Ms. King pointed out the new access point location to the site. Jordan Gutierrez, applicant, in response to Chair Buck, indicated he had not had contact with any of the Commissioners regarding this case. He relayed the new driveway has already been moved to the new access point, which was designed by the County as the roundabout construction has already begun. He stated internal site construction would not begin until the roundabout is completed and operational, and a new septic has already been installed and the previous septic could be reassessed as it has now dried up. In response to Commissioner James, Mr. Gutierrez explained the traffic impact anticipated once the center is operational for senior assisted living. All the Commissioners commended the applicant for his empathy and dedication to this project. No public testimony was offered concerning this matter. The Board reviewed the Conditions of Approval and Development Standards, and no changes or corrections were made. 2025-0765 PL2947 Hearing Certification (USR23-0046) — 6045 County Road 6 Trust Page 3 El In response to Chair Buck, Mr. Gutierrez indicated they have reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. ti Commissioner Ross moved to approve the request of 6045 County Road 6 Trust for Use by Special Review Permit, USR23-0046, for a Residential Therapeutic Center, outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Maxey and it carried unanimously. There being no further discussion, the hearing was completed at 11:10 a.m. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 9th day of April, A.D., 2025: Perry L.
