Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: Change of Zone from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District. This project is south of Highway 34 and is east of and adjacent to County Road 13. Parcel number: 095718200054. Access is from County Road 13. ACCESS Development Review has reviewed the application materials related to access and determined that the subject parcel has one (1) existing, unpermitted, residential access onto County Road 13 located approximately 2,355 feet south of Highway 34. No new access is being proposed with this Change of Zone. ROADS AND RIGHTS -OF -WAY County Road 13 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. County Road 13 meets the physical road requirements specified in Section 23-2-40.B.4., of the Weld County Code. No further roadway information is needed. CONDITIONS OF APPROVAL The plat shall be amended to delineate the following: County Road 13 is a paved road and is designated on the Weld County Functional Classification Map as an arterial road which requires 140 feet of right-of-way. The applicant shall delineate and label the existing right-of-way (along with its creating document), the future right-of-way, and the physical location of the road. All setbacks shall be measured from the future right-of-way line. This road is maintained by Weld County. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) A. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) B. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. (Development Review) C. There shall be no parking or staging of vehicles on public roads or within public rights -of -way. On -site parking shall be utilized. (Development Review) D. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned ponding of stormwater runoff. Windsor Severance Fire Rescue (WSFR) has no issues with this area being rezoned to Business. However, once this becomes commercial, it will need to be designed and built in accordance with the 2024 International Fire Code and amendments that are adopted by WSFR. This will include, but not be limited to, the installation of fire hydrants, apparatus roads, Haz- Mat permits being required, and the installation of fire suppression systems in the buildings. All these items and any others will be assessed when building permits are applied for with the fire department. This property is outside the Town of Windsor growth management area and community influence area. Currently, the Town of Windsor staff does not have any comments. Due to the area converting to commercial use and the increased traffic impacts on the intersection of US Hwy 34 and Colorado Blvd, the Town of Windsor appreciates the opportunity to review submittals in the area.
