Approve Amendment #2 to Memorandum of Understanding for Colorado Child Care
Assistance Program (CCCAP) and Authorize Chair to Sign
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Board has been presented with Amendment #2 to the Memorandum of
Understanding for the Colorado Child Care Assistance Program (CCCAP) between the
County of Weld, State of Colorado, by and through the Board of County Commissioners
of Weld County, on behalf of the Weld County Department of Human Services, and the
Colorado Department of Early Childhood, commencing January 1, 2025, and ending
June 30, 2026, with further terms and conditions being as stated in said amendment, and
Whereas, after review, the Board deems it advisable to approve said amendment, a copy
of which is attached hereto and incorporated herein by reference.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that Amendment #2 to the Memorandum of Understanding for the Colorado
Child Care Assistance Program (CCCAP) between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Department of Human Services, and the Colorado Department of Early
Childhood, be, and hereby is, approved.
Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign
said amendment.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Resolution, on motion duly made and seconded, by the following vote on
the 23rd day of April, A.D., 2025, nunc pro tunc January 1, 2025:

Brief description of the problem/Issue: On December 12, 2022, the Department entered into a
Memorandum of Understanding (MOU) with the Colorado Department of Early Childhood (CDEC) for
the Colorado Child Care Assistance Program (CCCAP), known to the Board as Tyler ID# 2022-3413.
The CCCAP helps families that are homeless, working, searching for work, or in school find low-income
childcare assistance.
On January 110, 2024, the Department entered into Amendment #1, known to the Board as Tyler ID#
2024-0105, that reaffirmed the MOU and extended the term for an additional year.
The Department is now requesting to enter into Amendment #2 with the CDEC, which will extend the
term date to January 1, 2023 through June 30, 2026, and allow the MOU to automatically renew on an
annual basis.
What options exist for the Board?
Approval of Amendment #2 with the CDEC.
Deny approval of Amendment #2 with the CDEC.
Consequences: Weld County Department of Human Services will not have a current
Agreement to implement the CCCAP.
Impacts: Weld County residents will not have the option of participating in the CCCAP.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
Funded through Federal Funding and appropriated in the American Rescue Plan Act (ARPA) of
2021 (Public Law 117-2) signed into law March 11, 2021.

Weld County Department of Human Services
This Amendment No. 2 ("Amendment") is effective as of January 1, 2025, or upon the date of
execution, whichever is later, and amends the Memorandum of Understanding (MOU) executed
by and between the State of Colorado Department of Early Childhood and the Board of County
Commissioners or other elected governing body of Weld County Department of Human Services
(the "County") on December 21, 2022.
The purpose of this Amendment is as follows:
1.) Extend the term of the contract by 1 year, and
2.) Eliminate the requirement for an annual reaffirmation.
Item 2. TERM in the Memorandum of Understanding shall be replaced with the following:
2. TERM
The term of this MOU will be from January 1, 2023, through June 30, 2026. During the term, the
MOU shall automatically renew on an annual basis unless either party gives written notice at least
90 days prior to July 1 of each year, with the MOU expiring on July 1 of that year if either party
invokes this option.
By signing, both parties agree to the changes described in the body of this Amendment.
