SUBJECT: COZ25-0001 Camacho
The proposal has been reviewed on behalf of the Weld County Department of Public Works and Department
of Planning Services. Staff comments made during this phase of the application process may not be all-
inclusive, as other issues may arise during the remaining application process.
COMMENTS:
Parcels: 096110300009 (1846 Cherry Ave.).
The project proposes to: Change of Zone from to the R-1 (Low Density Residential) Zone District to A
(Agricultural) Zone District.
ACCESS:
Weld County Development Review has reviewed the application materials related to access.
The parcel has two permitted access points onto Cherry Avenue (AP21-00796 - AG, AP21-00795 —
Residential).
ROADS AND RIGHT-OF-WAY:
Cherry Avenue is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2024-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on
the plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot
be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90,
the required setback is measured from the future right-of-way line. Be aware that physical roadways may not
be centered in the right-of-way. This road is maintained by Weld County.
Sec.23-2-230.A.4 and .240.B.4 include standards for unpaved roads providing access to parcels proposed to
undergo zoning changes. Cherry Avenue is a paved road. Thus, the assessment of these standards is not
triggered.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4):
The parcel is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific
water quality requirements or other drainage improvements. In addition to compliance with applicable Weld
County regulations, the property owner is required to be compliant with any additional MS4 requirements.
Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970-304-
6496.
CONDITIONS OF APPROVAL:
The plat shall be amended to delineate the following:
1. Cherry Avenue is a paved road and is designated on the Weld County Functional
Classification Map (Code Ordinance 2024-01) as a local road, which requires 60 feet of
right-of-way at full buildout. The applicant shall delineate and label on the plat the future
and existing right-of-way (along with the documents creating the existing right-of-way) and
the physical location of the road. If the existing right-of-way cannot be verified it shall be
dedicated. The applicant shall also delineate the physical location of the roadway. Pursuant
to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is
measured from the future right-of-way line. This road is maintained by Weld County.

2. Show and label the existing, permitted access points onto Cherry Avenue. Include the

DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site,
pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. Access on the site shall be maintained to mitigate any impacts to the public roads including
damages and/or offsite tracking. (Development Review)
3. The historical flow patterns and runoff amounts will be maintained on the site. (Development
Review)
4. This parcel is located in the MS4 area and is subject to the regulations of the state -issued MS4
Permit. (Development Review)
5. If applicable, once any permanent control measure has passed final inspection by Public Works,
the site shall be routinely inspected at a frequency determined by Public Works, usually on an
annual basis unless otherwise noted, for the life of the control measure. Inspections occur to
ensure the permanent control measure remains fully operational and is being adequately
maintained according to the site's Operation and Maintenance Plan. Upon sale of the property,
the responsibility of maintaining permanent control measures shall be transferred to the new

Re: COZ25-0001 Applicant: Jose Alegria Camacho
Environmental Health Services has reviewed this proposal requesting a Change of Zone
from R-1 (Low Density Residential) Zone District to (Agricultural) Zone District.
The parcel is served by the City of Greeley for water and on -site wastewater treatment
system (SP -20000388) sized for 3 bedrooms. A water bill from the City of Greeley was
included with the application.
We recommend the following appear as notes on the resubdivision plat:
1. Water service may be obtained from the City of Greeley.
2. The parcel is currently not served by a municipal sanitary sewer system. Sewage
disposal may be by on -site wastewater treatment systems (OWTS) designed in
accordance with the regulations of the Colorado Department of Public Health and
Environment, Water Quality Control Division, and the Weld County Code in effect at
the time of construction, repair, replacement, or modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which shall
not contribute to compaction of the soil or to structural loading detrimental to the
structural integrity or capability of the component to function as designed.
