Re: Public Declaration Letter: Weld County, Colorado, and the Weld County Public Works Weed
Division
Dear Sirs:
Weld County is a political subdivision of Colorado, pursuant to Section 1, Article XIV, Colorado
Constitution and C.R.S. § 30-5-171. The Weld County Public Works Weed Division, an agency of Weld
County derives its statutory authority to control or eradicate certain noxious weed species as part of
the County Code chapter 15 as well as the Colorado Noxious Weed Act Title 35, Article 5.5.
Thus, Weld County, through the Public Works Weed Division, is qualified to be a public aircraft
operator pursuant to 49 U.S.C. § 40102(a) (41) (C). The Public Works Weed Division, as a public aircraft
operator, will only conduct operations that meet the definition of a "government function" in
compliance with 49 U.S.C. § 40125(a)(2), namely, agricultural spray operations to treat noxious
weeds on Weld County maintained properties. Finally, the public aircraft operations by the Public
Works Weed Division will not be for commercial purposes, in compliance with 49 U.S.C. § 40125(b).
