Resolution Approve Revocation of Zoning Permit, ZPAG20-0022, for certain uses in the A (Agricultural) Zone District outside of subdivisions and historic townsites, specifically a private recreational facility (sports club) — Erica Walden Trust Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, on November 3, 2020, the Department of Planning Services approved Zoning Permit, ZPAG20-0022, for certain uses in the A (Agricultural) Zone District outside of subdivisions and historic townsites, specifically a private recreational facility (sports club), and, being more particularly described as follows: Subdivision Exemption, SE -122; being part of the SW1/4 of Section 29, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado Whereas, the Board has received a request from the current property owner, the Erica Walden Trust, 1030 County Road 15, Brighton, Colorado 80603, to revoke ZPAG20-0022, and Whereas, the Board heard all of the testimony and statements of those present, studied the request of the permit holder and the recommendations of the Department of Planning Services staff, and all of the exhibits and evidence presented in this matter, and having been fully informed, deems it advisable to accept said request. Walden Page 1 of 9 Case Summary The applicants are requesting a Zoning Permit for certain uses in the A (Agricultural) Zone District outside of subdivisions and historic townsites, specifically a private recreational facility (sports club), permitted under Section 23-3-35 V of the Weld County Code The facility will be utilized by SOLFLO Collective, a Colorado non-profit corporation for a jiu jitsu club A proposed 3,000 square foot metal structure will be constructed in which the club will be conducted, including a restroom facility A portion of the proposed structure will also contain personal storage, a home gym and garage space The site also contains a residence (formerly the Weld County School District No 43 Mountain View Schoolhouse) in which the jiu jitsu club owners live and other accessory outbuilding, not related to the Zoning Permit activities The club will be open year-round with a classes occurring on a maximum of four (4) days per seven (7) day week, with an approximate class length of two (2) hours per day Classes shall be conducted anytime within the daytime interval of 8 am to 8 pm Up to five (5) volunteers may assist during classes Approximately fifteen (15) to thirty (30) participants are expected for a class No more than thirty-five (35) persons will be on -site at a given time, this maximum number is expected to occur infrequently for belt ceremonies and occasional club member gatherings Ten (10) standard and one (1) handicap dimensioned gravel parking stalls are proposed Limited building - Walden Page 2 of 9 the residence and sports club, designed for fifty (50) students per week, including the need for a larger septic tank C Section 23-4-1200 A6 -- The proposed use is compatible with the character of the neighborhood The jiu jitsu facility will conduct classes for members of the non-profit club and will not include any activity that may disturb or be viewable from surrounding properties Because the primary use of the property will continue to be a private residence and the proposed classes are limited in size and frequency, this proposal is expected to be compatible with the surrounding community The Cities of Dacono and Northglenn, City and County of Broomfield and Adams County had no concerns with this proposal, as documented in the relevant referral responses The surrounding land uses are predominately rural residential and agricultural Planning staff sent notice to seven (7) surrounding property owners within five -hundred (500) feet Two (2) letters were received back, one (1) in opposition and one (1) in support of the proposal The letter in opposition included concerns with traffic, signage, hours of operations, client count, liability and lack of public hearing No comments were included with the letter of support One (1) phone call was received with general questions and comments about the proposal but with a neutral stance The nature of the project and proposed Development Standards will adequately protect the health, safety and, welfare of the community Specifically, the controls on number, of.members and hours of operation are anticipated to mitigate potential nuisances of the club , 3 The, proposed request is in compliance with the Operation Standards requirements of Section 23- 4-1210 of the Weld County Code This recommendation is ,based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities The Department of Planning Services' staff recommendation for approval is conditional, upon the following 1 Prior to recording the map - Walden Page 6 of 9 21 Weld County is not responsible for the maintenance of onsite drainage related features 22 All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100 5, C R S ) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination 23 No permanent disposal of wastes shall be permitted at this site This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100 5, C R S 24 Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions The facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code 25 Fugitive dust should attempt to be confined on the property Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations 26 Adequate drinking, hand washing, and toilet facilities shall be provided for employees and patrons, at all times A permanent, adequate water supply shall be provided for drinking and sanitary purposes 27 Any On -site Wastewater Treatment system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems 28 Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties in accordance with the plan Neither the direct, nor reflected, light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets No colored lights may be used which may be confused with, or construed as, traffic control devices 29 The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code 30 Building permits may be required, for any new construction or set up manufactured structure, per Section 29-3-10 of the Weld County Code A building permit application must be completed and submitted Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application Currently the following has been adopted by Weld County 2018 International Building Codes, 2018 International Residential Code, 2006 International Energy Code, 2017 National Electrical Code, and Chapter 29 of the Weld County Code A plan review shall be approved, and a permit must be issued prior to the start of construction 31 The property owner or operator shall be responsible for complying with the Design and Operation Standards of Chapter 23 of the Weld County Code 32 Necessary personnel from the Weld County Departments of Planning Services, Public Works, and Public Health and Environment shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Conditions of Approval and Development Standards stated herein and all applicable Weld County regulations 33 The Zoning Permit area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations Changes from the plans or Development Standards, as shown or stated, require the written approval of an amendment of the Permit by the Weld County Planning Services Department before such changes from the plans or Development Standards are permitted A revised map may be required to be submitted, approved, and recorded ZPAG20-0022 - Walden Page 7 of 9 34 The property owner or operator shall be responsible for complying with all of the foregoing Development Standards Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners 35 The property owner, operator or successor shall be responsible for acknowledging and complying with Section 23-4-1240 of the Weld County Code 36 Section 23-4-1240 E of the Weld County Code states "Construction or use pursuant to issuance of a zoning permit shall be commenced within three (3) years from the date of approval of the permit A one-time extension of one hundred twenty (120) days may be granted by the Department of Planning Services for good cause shown by written request Before this extension has expired, the applicant may seek a further extension -from the Board of County Commissioners by written request to the Director of Planning Services If the Board of County Commissioners denies the extension or if construction has not commenced by the date specified by the Board, the zoning permit approval shall be voided, and the application denied " 37 Section 23-4-1240 F of the Weld County Code states "Any zoning permit may be revoked by the Board of County Commissioners for violation of any of the terms of this Division 17 or conditions of approval of the zoning permit following a Probable Cause Hearing as outlined in Section 2-4-40 of this Code If the zoning permit is revoked, the property owner shall cease operation of the use immediately Continued operation of the use after a zoning permit has been revoked shall be a violation of this Code " 38 Section 23-4-1240 G of the Weld County Code states "The Director of Planning Services may revoke a zoning permit' if the use is discontinued for a period of three (3) consecutive years Should the Department of Planning Services observe or receive credible evidence of such a discontinuance, the Department shall notify the property owner by first-class mail If the property owner objects to the revocation of the zoning permit within thirty (30) days, the Director of Planning Services may schedule a public hearing before the Board of County Commissioners for its review and decision The applicant shall be notified of the public hearing at least ten (10) days prior to the hearing " 39 Section 23-4-1240 H of the Weld County Code states "The Department of Planning Services may permit minor amendments to an approved zoning permit without a complete application for a new zoning permit, notification to surrounding property owners, or referral to agencies The applicant shall provide a written summary of the proposed amendment(s) and any other documentation required by the Department of Planning Services An increase of ten (10) percent or more in impervious surface area or an increase of ten (10) percent or more in traffic shall not be considered a minor amendment If the Director of Planning Services determines the proposed amendment does not qualify as a minor amendment, the proposed amendment shall require a new zoning permit " 40 RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the state's commercial mineral deposits are essential to the state's economy, (b) the populous counties of the state face a critical shortage of such deposits, and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state Mineral resource locations are widespread throughout the County and person moving into these areas must recognize the various impacts associated with this development Often times, mineral resource sites are fixed to their geographical and geophysical locations Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource 41 WELD COUNTY'S RIGHT TO FARM STATEMENT Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold The rural areas of Weld County may be open and spacious, fly ZPAG20-0022 - Walden Page 8 of 9 but they are intensively used for agriculture Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area Well -run agricultural activities will generate of site impacts, including noise from tractors and equipment, slow -moving farm vehicles on rural roads, dust from animal pens, field work, harvest and gravel roads, odor from animal confinement, silage and manure, smoke from ditch burning, flies and mosquitoes, hunting and trapping activities, shooting sports, legal hazing of nuisance wildlife, and the use of pesticides and fertilizers in the fields, including the use of aerial spraying It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County Section 35-3 5-102, C R S , provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production Water has been, and continues to be, the lifeline for the agricultural community It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and county roads outside of municipalities The sheer magnitude of the area to be served stretches available resources Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm Services in rural areas, in many cases, will not be equivalent to municipal services Rural dwellers must, by necessity, be more self-sufficient than urban dwellers People are exposed to different hazards in the County than in an urban or suburban setting Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sandburs, puncture vines, territorial farm dogs and livestock, and open burning present real threats Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood ZPAG20-0022 - Dust abatement along the relevant travel routes is expected to occur approximately two to five times per year Dust abatement is required for roads with more than 200 vehicles per day, per Section proportional share of excavation, patching and pavement repair on designated travel routes The amount and extent of repair and paving measures will be determined by site -specific conditions at the health and safety or renders the road impassible ("Significant Damage ), County shall, after inspection, notify Property Owner of such Significant Damage Property Owner shall identity the repair required and shall consult with County on the extent, type, timing materials and quality of repair (i a temporary versus permanent) within twenty -tour (24) hours after receipt of such notice and shall commence such repair within forty-eight (48) hours atter receipt of such notice If Property Owner identifies Significant Damage prior to receiving notice thereof from County Property Owner may commence repair of such Significant Damage and shall concurrently notify County of the extent, type, timing, materials and quality of repair (i a temporary versus permanent) 5 0 Repair of Road On or before December 31 of the calendar year in which County staff has determined through site analysis and/or pavement testing that a particular travel route road portion will require paving measures in order to protect the public health safety and welfare, and the County has budgeted sufficient funds for the following calendar year to pay its share of the Off -Site Improvement/Repair Costs, County, shall notify Property Owner in writing that the Ott -Site Improvements/Repairs shall be undertaken 5 1 In County's sole discretion, County may undertake the repairs and/or improvements Property its sole discretion, shall determine actual conditions and shall further determine what road repair/improvement/maintenance work is to be performed during that construction season Notification to the Property Owner of the required roadway O O repairs will be given as soon as the data become available 8 0 Notification The County shall notify Property Owner of County's preliminary determination and assessment of Property Owner's proportionate share of costs of maintenance repair or improvements to Property Owner s designated travel routes Prior to County's final determination and assessment, Property Owner's Input prior to making a final determination and assessment PART II GENERAL PROVISIONS A. Permits Property Owner is required to apply for and receive all permits required by the County or any other applicable local, State, or federal permit, including but not limited to 1.0 Access Permits Property Owner shall not use any access onto any County road unless and until an access permit has been issued by the Department of Public Works Public Works may condition the issuance of an updated access permit on the amendment of this Agreement if the updated access permit authorizes the use of an additional access point, or if there is a change in use of the current access point, as permitted by Article XIV of Chapter 8 of the Weld County Code 2 0 Right-of-Way.ROW) Permits Per Article XIII of Chapter 8 of the Weld County Code, any work occurring within County ROW requires a ROW permit issued by the Department of Public Works No work shall occur without said ROW permit 3.0 Transport Permits Per Article XV of Chapter 8 of the Weld County Code, a Weld County Transport Permit is required for Extra -legal vehicles using Weld County roadways to ensure the operation and movement of Extra -legal Vehicles and Loads occurs in a safe and efficient manner B. Enforcement and Remedies 1.0 Violation of Terms of Agreement If in County s opinion Property Owner has violated any of the terms of this Agreement, County shall notify Property Owner of its belief that the Agreement has been violated and shall state with specificity the facts and circumstances which County believes constitute the violation Property Owner shall have Sliest (15) days within which to either cure the violation or demonstrate compliance It, after fifteen (15) days have elapsed County believes in good lath that the violation is continuing, County may consider Property Owner to be in breach of this Agreement 2.0 Remedies for Breach by Property Owner In the event that County determines that Property Owner has violated the terms of this Agreement, and has tailed to correct said violation, County may exercise any or all of the following remedies, or any other remedy available in law or equity 2 1 Withholding Permits County may "lock any or all lots within the Property which precludes the continued issuance of building permits zoning permits, septic permits, or any other permit issued by any department of the County 2 2 Court Action County may seek relief in law or equity by fling an action in the Weld District Court or Federal District Court for the Distinct of Colorado except that no such civil action or order shall be necessary to access collates al for the purpose of completing improvements as described above 2 3 Revocation of ZPAG Permit Property Owner acknowledges that failure to comply with the terms of this Agreement constitutes cause to revoke the ZPAG, and County may exercise this option in its sole discretion by proceeding with revocation under the then current provisions of the Weld County Code 3 0 Termination of Agreement This Agreement shall terminate upon the earliest of the following events 3 1 Failure to Commence County may terminate this Agreement upon or after revocation of the underlying land use approval under Weld County Code Section 23-4-1240 However County may still exercise all necessary activities tinder this Agreement that the County determines necessary to protect the health, safety and welfare of the residents of Weld County 3 2 Cessation of all Permit Related Activities Termination of this Agreement shall occur upon Property Owner's complete cessation of all activities permitted by the ZPAG including any clean up or restoration required A partial cessation of auivrttes shall not constitute a Termination of this Agreement, nor shall County's issuance of a partial release/vacation constitute a Termination Unless informed in writing by the Property Owner of cessation of activities, and verified by the County, cessation shall only he presumed If the County determines that the ZPAG has been inactive for three (3) years 3 3 Execution of Replacement Agreement This Agreement shall terminate following County's execution of a new Improvements Agreement with a new property owner or operator who has purchased the Property or has assumed the operation of the business permitted by the ZPAG, and intends to make use of the rights and privileges available to it through the then existing ZPAG 3 4 Revocation of ZPAG This Agreement shall terminate following County's revocation of Property Owner's ZPAG, except that the Property Owner shall only be released from this Agreement after the successful completion of all improvements required under this Agreement, which may be completed by County after accessing Property Owner's collateral if Property Owner tails to complete such improvements D General Provisions 1.0 Successors and Assigns 1 I Property Owner may not delegate, transfer, or assign this Agreement in whole or in part, without the prior express written consent of County and the written agreement of the party to whom the obligations under this Agreement are assigned Consent to a delegation or an assignment will not be unreasonably withheld by County In such case, Property Owner's release of its obligations shall be accomplished by County's execution of a nets Improvements Agreement with the successor owner of the property 12 County s rights and obligations under this Agreement shall automatically be delegated, transferred, or assigned to any municipality which, by and through annexation proceedings, has assumed jurisdiction and maintenance Governmental Immunity_ No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other
