The County Commissioners approved submission of the VOCA Grant application for funding of positions in the Victim Witness Assistant Unit.Victim
Witness Assistance Unit contract in the amount of$280,000.00 for 2026 Grant cycle.VOCA amended documents requested and we are asking for the
grant contract be placed for signature approval and acceptance without a work session.
What options exist for the Board?
Request approval of 2025 Contract so that the VOCA funding can be awarded.
Consequences:
Grants not funded will result in Victim Rights Act mandated compliance.
Impacts:
Will impact the funding for Victim Witness Unit in the District Attorney's office.

The Weld County Victim Assistance Unit provides services to all victims and witnesses involved in the prosecution
of criminal cases . We serve individuals of all races and ethnicities , languages and cultures , gender and sexual
identity , economic status and disability .
The diversity of Weld County continues to grow along with the population . Weld County has a varied population of
refugee and immigrant non - English speakers ( 19 . 29 % ) whose primary language is not English . The 2024 US
census estimates Weld ' s population is 62 . 8 % White ; 31 . 3 % Hispanic or Latino ; 1 . 9 % Black or African American ;
1 . 7 % American Indian ; and 2 . 2 % Asian . An area of emphasis for the Victim Assistance Unit has been providing
VRA Rights to victims with language barriers along with education and support on how to participate in the
criminal justice process to the fullest . Many individuals in the Hispanic or Latino population in Weld are
monolingual Spanish speaking . To help serve this population , we have ten Spanish bi - lingual Victim Assistance
Staff . In addition , we have access to a language line service , knowledge of local translators for language and
ASL , contact letters in primary East African languages to reach a greater number of our refugee population , and
VRA letters in English and Spanish . We serve victims speaking a minimum of fifteen different languages to
include : Karen , Burmese , Chuukese , Haitian Creole , Malay , Mandarin , Somali , Kinyarwanda , Swahili , French ,
Napoli , Tigrinya , Rohingya , Farsi and Spanish . Victims whose primary language is Rohingya find themselves
especially vulnerable as many only have knowledge of the verbal language and translators are very limited .
Victim Witness staff sometimes communicate with victims to find a second closely understood language or
schedule times when they can pre - arrange translation for appropriate communication . In 2025 , JBS Swift , the
largest employer in Weld County and largest employer who sponsors immigrant workers announced a $ 50 million
expansion in Greeley . This expansion has the potential to further the diversity and immigrant population in Weld
County through needed employees .
The Victim Assistance Unit Staff and volunteers are the only service provider for victims whose eases are going
through prosecution . The Victim Assistance Unit Staff work with all victims of crime . The requested VOCA project
focuses on continued funding of Victim Assistance Unit Staff to support the unique needs of victims which include
victims of juvenile offenders , domestic violence victims , victim families whose loved ones have been killed or
seriously injured in Careless Driving Resulting in Death or Injury , traffic crashes and financial crimes , as well as
victims of other misdemeanor and felony crimes .

Victims of Felony and Misdemeanor Offenders
Entering the prosecution phase of the criminal justice system is often a scary and unknown realm for most victims .
The District and County Court Victim Witness Assistants proactively contact victims to provide the needed
emotional and physical support to assist victims during prosecution . The Assistants provide initial guidance on
charges , education about the court process and legal terminology , physical or on - line support during court
proceedings , safe waiting areas , assist Deputy District Attorneys in case consultation , arranging transportation ,
assistance with victim impact statements to give victims a voice at sentencing , and give needed community and
economic resources to primary and secondary victims during the different phases of trauma . As three of the four
VOCA funded Assistant positions also speak Spanish , which is the second most spoken language in Weld
County , this often includes the ability to speak to a Victim Witness Assistant in the victim ' s native language .
Feedback is often received that the relationship built by the Victim Witness Assistant was the link that enabled the
victim to attend and testify in court against their offender .
Victims of Juvenile Offenders
Victims of juvenile offenders are navigating a system which operates differently than a traditional adult criminal
justice process as juvenile offenders have support of an attorney , GAL , Department of Human Services casework
and their parents . These cases drag on through the Juvenile Criminal Justice System as the court gives offenders
many opportunities to comply with court orders . What seems to them as insignificant penalties for juveniles adds
frustration and anger by victims and their families . The Juvenile Victim Assistant not only has specialized
knowledge of the juvenile justice system but extreme patience .
Victims of Domestic Violence
Because victims of domestic violence often recant , Victim Assistants and volunteers make immediate victim
contact which is essential to establishing safety , referrals , and rapport . Domestic violence victims need
comprehensive wrap around services due to the complex nature of the crime . The Victim Assistance Unit
recognizes the need to provide immediate intervention in these complex and dangerous cases . Making immediate
contact with victims , connecting them with services , offering nonjudgmental support , and explaining next steps in
the court process are crucial in assuring the safety of victims who may already be recanting the events of the
incident .
Victims of domestic violence are subject to being involved in a lengthy criminal justice system as their perpetrator ' s
case is set over again and again before a plea negotiation is entered into or the case goes to trial . Prior to 2008 ,
there was no process in place to know if a new felony domestic violence case was scheduled for the initial court
hearing . Since 2008 , due to VOCA funding , a system has been implemented by the WV Assistants to identify a
victim ' s attendance at court and provide safe support when the victim becomes involved in an overwhelming and
busy courtroom scene .
Presently three County Victim Assistants are handling misdemeanor domestic violence crimes in a high - volume
setting , with multiple cases every day coming on for first appearance bond hearings . The addition of the third
County Victim Assistant has enabled us to make quicker contact with victims whose perpetrators were arrested
and saw a judge during weekend bond hearings as well as responding to the multitude of calls from victims as
their perpetrator ' s case is continued for future court hearings .
Victims of Careless Driving Resulting in Death and Careless Driving Resulting in Injury .
These cases are filed in County Court as traffic and are the most intense cases County Victim Assistants handle .

Victim families who ' s loved one has been killed or hurt seriously due to a defendant ' s careless driving can
experience the same emotions as families who ' s loved one has been murdered or of become a victim of vehicular
assault .
In Careless Driving Resulting in Death cases , the greatest difficulty victim ' s families are faced with is the
defendant ' s potential punishment of only being jail and / or Probation compared to a defendant who is convicted of
murder faces prison time . County Victim Assistants must support families who are absolutely devastated and
inconsolable in feeling their loved one ' s death does not matter in the criminal justice system .
Similarly , County Victim Assistants provide services to victims and their families who have been seriously hurt in
lraffic crashes . Although Careless Driving Resulting in Injury cases are not VRA crimes , our office tries to identify
victims who have been seriously injured with a permanent physical or mental loss as the police reports may not
adequately portray the seriousness of a person ' s injuries .
Restitution Assistants
The direct and indirect financial burden on victims of crime can be significant , further impacting the trauma of
victims and their ability to stabilize their life after the crime . The Restitution Assistants have a vital role during their
proactive contact with victims of all crimes as they gather restitution information . During their contact , they also
ascertain which victims need additional resources and provide those resources ( i . e . Crime Victim Compensation ) .
The two Spanish speaking bi - lingual Restitution Assistants process 3 , 000 victim restitution requests a year . This
entails gathering and clarifying restitution information submitted by victims . They also reach out to victims who
have not yet submitted documentation . On November 8 , 2021 , Supreme Court case 20SC340 People vs Weeks
changed our business practices on gathering restitution documentation from victims to a 30 day deadline ( was
60 - 90 days ) after the defendant is sentenced . The change requires contact with victims in a more proactive and
Immediate timeline after a case is filed . Without two Restitution Assistants we could not handle the accelerated
deadlines and victims would not see their offenders pay restitution for victim ' s out - of- pocket losses caused by the
crime , increasing their financial burden .

Below is background information regarding the 2026 VOCA Grant for the DA's Office:
• The Board approved the 2026 VOCA Grant Application on March 12,2025(known as 2025-0679 on record)
• The DA's Office received notification of Award on August 14,2025,with the instructions to fill out Exhibits D
and E and sign the Certificate of Lobbying Form,as an interim workflow step,to proceed with the
agreement for their awarded amount.(known as 2025-2389 on record)
• Attached are said Exhibits and Form with the argument for listing on the Consent Agenda to obtain the
Chair's signature on the Form,which are then incorporated as part of the forthcoming IGA,which will then
be reviewed by finance and legal,and formally accepted by the Board at a later date.(Please reference last

I am pleased to inform you that in its final review of grant applications during the Funding Meeting,the
Crime Victim Services Advisory Board(CVSAB)recommended your project for funding up to the
amount of$280,000 in VOCA funds. This recommendation will become final only upon completion of
the grant agreement and receipt of required approvals and signatures at the Colorado Department of
Public Safety.
Over 230 applications were submitted for the CY26 funding opportunity,with requests totaling almost
double the available funding.When making funding decisions,the CVSAB considered the applicant's
eligibility,organizational capacity,prioritized expenses,and the project's alignment with the review
criteria and the Board's funding philosophy.Please see this video with a message from OVP's Unit
Manager Kelly Kissell.
IMPORTANT REQUIRED NEXT STEPS(Please save this email for future reference):
In order to move forward with creating your grant agreement,please review the following information
on required actions:
• We have attached your original application for reference to aid you in the creation of your new
Exhibit D:Statement of Work and Exhibit E:Budget,based on your award amount.
• Complete Exhibit E:Budget(attached)
o While the Board was not able to fully fund your request,you can use the recommended
funds(up to$280,000)to support the aspects of your program that your agency
prioritizes.
o You can only include expenses that were requested in your original application budget.
• Complete Exhibit D:Statement of Work(attached)
o Please copy the activities from your original application into the attached Exhibit D as
appropriate.Please edit the information based on what you will be including in your new
revised Budget Exhibit E.For example,do not include activities that will not be
supported by the grant funds awarded.
o Complete the services charts based on the awarded funds,as well.Prorate this
information based on what you were awarded,not what you applied for.
• Lastly,please review the Project Officials listed in ZoomGrants under the"Project Overview"
Tab and let us know if any updates need to be made to your Project Officials-this is extremely
important as they will receive all future emails regarding your award,including an email from
Docusign when it is time to sign your grant agreement.
In addition to the Exhibits,there are other documents that are required for contracting.Please upload
all required attachments in ZoomGrants under the"Documents"Tab.
