HomeMy WebLinkAbout20251914.tiffResolution Approve Professional Service Agreement for K-9 Comfort Dog Ministry Program and Authorize Chair to Sign — Lutheran Church Charities / Redeemer Lutheran Church Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Professional Service Agreement for the K-9 Comfort Dog Ministry Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Justice Services, and Lutheran Church Charities / Redeemer Lutheran Church, commencing upon full execution of signatures, and ending June 30, 2026, with further terms and conditions being as stated in said agreement, and Whereas, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Professional Service Agreement for the K-9 Comfort Dog Ministry Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Justice Services, and Lutheran Church Charities / Redeemer Lutheran Church, be, and hereby is, approved. Date: July 7, 2025 Following a Pass Around submitted on June 10th, in which the Board unanimously approved for placement on a future hearing agenda, this item now comes before you for final review and approval. Enclosed is an Agreement outlining provisions for Lutheran Charities to provide an onsite comfort dog named Zacchaeus. Under the care of his trainer, Zacchaeus would offer emotional support, comfort, and companionship to our staff across our various locations. This service would be at no cost to Weld County. Lutheran Charities currently provides this service over at Dispatch, where it has been very well received by that team. I know our staff would love it too. If approved and the partnership proves successful, we hope to expand the program to our various offender clientele, under close staff supervision. This Agreement has been reviewed by the County Attorney's Office. Thank you for your consideration. 2025-1914 BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE: Consider Agreement Between Weld County and Lutheran Church Charities/Redeemer Lutheran Church K-9 Comfort Dog Program DEPARTMENT: Justice Services DATE: June 10, 2025 PERSON REQUESTING: Doug Erler Brief description of the problem/issue: The department seeks the services of Lutheran Charities to provide onsite comfort dogs. These dogs (Devorah and Zacchaeus) are specially trained dogs that provide emotional support, comfort, and companionship to people in various settings. Unlike service dogs, which are trained to perform specific tasks for individuals with disabilities, comfort dogs are used more broadly to ease stress and anxiety. What options exist for the Board? Consequences: All positive. This program helps to reduce anxiety and stress among staff and, if the partnership proves successful, could be extended to benefit our various clientele as well. It promotes overall wellness by lowering blood pressure, bringing a sense of normalcy to busy workdays, and encouraging positive social interaction and emotional healing to those who engage with the dogs. Impacts: Again, all positive and at no costs to the County Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): None, this is a free service. Options: Option 1. Approve for placement on a future hearing agenda and authorize Chair to sign. Option 2. Work Session. Recommendation: Option 1. This service is currently approved by the Board and is being successfully delivered at the Weld County Regional Communications Center (WCRCC). In speaking with Tina Powell, she says her team loves the program! Bringing this service to our department is something I've long envisioned. 1 recently met with Ms. Joni Heiden with this program (very nice lady), and we both agree this program would be a great fit for our department and at our various operational sites. Enclosed is a Service Agreement that I drafted, which has been reviewed and approved by the County Attorney's Office. Thank you for your consideration. Ross AGREEMENT BETWEEN WELD COUNTY AND LUTHERN CHURCH CHARITIES/REDEEMER LUTHERAN CHURCH K-9 COMFORT DOG PROGRAM THIS AGREEMENT is made and entered into this %1k day of July 2025, by and between the Board of Weld County Commissioners, on behalf of the Department of Justice Services, hereinafter referred to as the "County," and Lutheran Church Charities/Redeemer Lutheran Church K-9 Comfort Dog Ministry Program, 3020 Milwaukee Ave., Northbrook, IL 60062, hereinafter referred to as the "Contractor. WHEREAS, the County desires a services contractor to perform the services requested by the County and set forth below; and WHEREAS, the Contractor is willing and has the specific ability to perform the requested services at no cost to the County; and WHEREAS, the Contractor is authorized to do business in the State of Colorado and has the time, skill, expertise, experience necessary, and understanding to provide the following services: The Contractor will bring a K-9 comfort dog(s) to the Department of Justice Services at its operational sites, at scheduled and mutually agreed upon times. The Contractor warrants that the comfort dog(s) is/are current on state vaccination and health requirements, free from any contagious diseases, and are pest and parasite -free (i.e. not infested with fleas or ticks). The care and supervision of the comfort dog(s) is solely the responsibility of its handler(s). All dog handlers of the Contractor agree they are solely responsible for any clean up that is required because of the comfort dog's visits. The Contractor understands that if there is a Department of Justice Services staff member on duty who does not consent to having the comfort dog(s) present, the comfort dog(s) and handler(s) may be assigned to another space, as designated by the department's onsite manager or supervisor. The Contractor acknowledges and understands that it holds a separate Agreement with Weld County to provide similar services at the Weld County Regional Communications Center (WCRCC). This Agreement is understood to be entirely independent and mutually exclusive from that separate Agreement. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the Parties hereto agree as follows: 1. Services. The Contractor agrees to procure the materials, equipment and/or products necessary for these services and agrees to diligently provide them, the personnel, and any materials necessary to fulfill the services. 2. Term. The term of this Agree ent begins upon the date of the mutual execution of this Agreement and shall end on 3011.0-2._. Weld County may extend the term of this Agreement upon mutual written agreement of the Parties. 3. Termination. Either Party may terminate for cause. An aggrieved party must first notify the other Party of the outstanding issue and allow one day to cure or such longer period of time as is mutually agreed upon by the Parties. In the event such issue is not cured within the cure period, the aggrieved party may terminate the Agreement and pursue any remedy recognized by Colorado law. Weld County has the right to terminate this Agreement, with or without cause on thirty (30) days written notice. 4. Extension or Amendment. Any amendments or modifications to this Agreement shall be in writing signed by both Parties. 5. Independent Contractor. The Contractor agrees that it is an independent Contractor, and that the Contractor's officers, agents or employees will not become employees or agents of the County, nor entitled to any employee benefits (including unemployment insurance or workers' compensation benefits) from the County as a result of the execution of this Agreement. The Contractor shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this Agreement. Any provisions in this Agreement that may appear to give the County the right to direct the Contractor as to details of performing these services or to exercise a measure of control over the services means that the Contractor shall follow the direction of the County as to end results of the services only. The Contractor understands that it is solely obligated to pay all federal and state income tax on any moneys earned pursuant to this Agreement. 6. Insurance. The Contractor must secure, before the commencement of these services, the following insurance covering all operations, goods, and services provided pursuant to this Agreement, and shall always keep the required insurance coverage in force during the term of the Agreement, or any extension thereof, and during any warranty period. For all coverages, the Contractor's insurer shall waive subrogation rights against Weld County. Required Types of Insurance. Workers' Compensation and Employer's Liability Insurance as required by state statute, covering all the Contractor's employees acting within the course and scope of their employment. The policy shall contain a waiver of subrogation against Weld County. This requirement shall not apply when a Contractor or subcontractor is exempt under Colorado Workers' Compensation Act., AND when such the Contractor or subcontractor executes the appropriate sole proprietor waiver form. Commercial General Liability Insurance including public liability and property damage, covering all operations required by these services. Such policy shall include minimum limits as follows: 2 Each Occurrence General Aggregate Personal Injury Medical Payment Per Person $ 1,000,000 $ 1,000,000 $ 1,000,000 $ 5,000 Automobile Liability Insurance. The Contractor shall maintain minimum limits to all vehicles operating both on Weld County property and elsewhere for vehicles owned, hired, and non -owned vehicles used in the services of this Agreement, as follows: Bodily Injury Per Person $ 1,000,000 Bodily Injury for Each Accident $ 1,000,000 Professional Liability (Errors and Omissions Liability). The policy shall cover professional misconduct or lack of ordinary skill for those positions defined in the of Services of this Agreement. T h e Contractor shall maintain limits for all claims covering wrongful acts, errors and/or omissions, including design errors, if applicable, for damage sustained by reason of or during operations under this Agreement resulting from said services. In the event that the professional liability insurance required by this Agreement is written on a claims -made basis, the Contractor warrants that any retroactive date under the policy shall precede the effective date of this Agreement; and that either continuous coverage will be maintained or an extended discovery period will be exercised for a period of two (2) years beginning at the time services under this Agreement is completed. Minimum Limits: $1,000,000 Per Loss; $2,000,000 Aggregate. All insurers of the Contractor must be licensed or approved to do business in the State of Colorado. The Contractor's comprehensive general liability and workers' compensation insurance policies and/or certificates of insurance shall be issued to include Weld County, its employees and officers, as additional insured parties and shall include the following provisions: The insurance company issuing the policy or policies shall have no right of recovery or subrogation against Weld County, it being the intent of the Parties that the insurance policies so affected shall protect both Parties and be primary coverage for any and all losses resulting from the actions or negligence of the Contractor, or injuries arising out of the Contractor's activities. The insurance company issuing the policy or policies shall have no recourse against Weld County for payment of any premiums due or for any assessments under any form of any policy. Any and all deductibles contained in any insurance policy shall be assumed by and at the sole risk of the Contractor. 3 Each insurance policy herein required shall be endorsed to state that coverage shall not be suspended, voided, or cancelled without thirty (30) days prior written notice to Weld County by certified mail, return receipt requested. At any time during the term of this Agreement, the County may require the Contractor to provide proof of the insurance coverage or policies required herein. Upon failure of the Contractor to furnish, deliver and/or maintain such insurance as provided herein, this Agreement, at the election of the County, may be immediately declared suspended, discontinued, or terminated. Failure of the Contractor to obtain and/or maintain any required insurance shall not relieve the Contractor from any liability under this Agreement, nor shall the insurance requirements be construed to conflict with the obligations of the Contractor concerning indemnification. 7. Indemnification. The Contractor agrees to indemnify and hold harmless Weld County, its officers, agents, and employees for, from, and against any and all claims, suits, expenses, damages, or other injury to persons, entities, or property caused or sustained by any person(s) as a result of the Contractor's performance or failure to perform services pursuant to the terms of this Agreement. 8. Mutual Understandings: Compliance with Law. The Contractor shall strictly comply with all applicable Federal and State laws, rules and regulations in effect or hereafter established, including without limitation, laws applicable to discrimination and unfair employment practices. Non -Exclusive Agreement. This Agreement is nonexclusive, and the County may engage or use other Contractors or persons to perform services of the same or similar nature. Entire Agreement/Modifications. This Agreement contains the entire understanding of the Parties hereto and neither it, nor the rights and obligations herein may be changed, modified, or waived except by an instrument in writing that is signed by both Parties. Employee Financial Interest/Conflict of Interest — C.R.S. §§24-18-201 et seq. and §24-50-507. The signatories to this Agreement state that to their knowledge, no employee of Weld County has any personal or beneficial interest whatsoever in the services, which is the subject matter of this Agreement. Severability. If any provision of this Agreement is deemed unenforceable or invalid for any reason, the remainder this Agreement shall remain in effect, unless otherwise terminated within the original intent of the Parties. Non -Waiver. No term or condition of this Agreement shall be construed or interpreted as a waiver, express or implied, of the monetary limitations or any of the other immunities, rights, benefits, protections, or other provisions, of the Colorado Governmental Immunity Act §§ 24-10-101 et seq., as applicable now or hereafter amended. 4 No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned Parties and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned Parties that any entity other than the undersigned Parties receiving services or benefits under this Agreement shall be an incidental beneficiary only. 9. Board of Commissioners of Weld County Approval. This Agreement shall not be valid until it has been approved by the Board of Commissioners of Weld County, Colorado, or its designee. 10. Choice of LawNenue. Colorado law, and rules and regulations established pursuant thereto, shall be applied in the interpretation, execution, and enforcement of this Agreement. Any provision included or incorporated herein by reference which conflicts with said laws, rules and/or regulations shall be null and void. In the event of a legal dispute between the parties, the Contractor agrees that the Weld County District Court shall have exclusive jurisdiction/venue to resolve said dispute. 11. No Employment of Unauthorized Aliens. The Contractor certifies, warrants, and agrees that it does not knowingly employ or contract with an unauthorized alien who will perform work under this Agreement (see 8 U.S.C.A. §1324a and (h)(3)) nor enter into a contract with a subcontractor that employs or contracts with an unauthorized alien to perform services under this Agreement. Upon request, the Contractor shall deliver to the County a written notarized affirmation that it has examined the legal work status of an employee and shall comply with all other requirements of federal or state law. The Contractor agrees to comply with any reasonable request from the Colorado Department of Labor and Employment during any investigation. If the Contractor fails to comply with any requirement of this provision, the County may terminate this Agreement for breach, and if so terminated, the Contractor shall be liable for actual and consequential damages. 5 Acknowledgment. Weld County and the Contractor acknowledge that each has read this Agreement, understands it and agrees to be bound by its terms. Both Parties further agree that this Agreement, is the complete and exclusive statement of agreement between the Parties and any other communications between the Parties relating to the subject matter of this Agreement. A LCC K-9 Comfort Dog is trained beginning at 8-10 weeks of age and receive over 2000 hours of training before certification and placement. Each LCC K-9 Comfort Dog has been trained to behave appropriately in a public setting. LCC K-9 Comfort Dogs bring comfort to individuals and families suffering pain or loss, calm hyperactive individuals, facilitate conversation, work with the developmentally disabled, work with veterans, work with the elderly and are used in counseling situations. In Newtown Connecticut the LCC K-9 Comfort Dogs were the only dogs allowed into Sandy Hook Elementary School. The LCC K-9 Comfort Dogs and their handlers were made available to students, teachers, staff, and parents to help with the healing process. Counselors and other professionals also used the LCC K-9 Comfort Dogs on individual's sessions with students. Parents most often remarked that their children would not be back at school if it were not for the dogs being there. "Our CT-DBHRN (Connecticut's Disaster Behavioral Health Response Network) team members served in many different capacities in Newtown during that time and, as a result, we often found ourselves working alongside one of your teams of handlers and K -9's; certainly most routinely in the schools". Our high standards and continuing education and training of both K -9's and handlers continue to set our LCC K-9 Comfort Dog organization apart. LCC K-9 Comfort Dogs and handlers support the good works done by therapy dog groups, however LCC K-9 Ministry teams do not join with other therapy dog groups on visits or deployments. As our ministry continues to grow we are presented with new venues of opportunities to engage our Comfort Dogs. A considerable amount of work continues to be done with schools, victim's advocacy, hospital employees, first responders, active duty military and veterans. In August 2013, LCC started a K-9 Comfort Dog training school working with volunteers to train future Comfort Dogs. The course covers a 2 year period and be accompanied by a LCC K-9 Comfort Dog training and socialization curriculum. Currently LCC operates multiple training classes each week. The addition of our training school continues to insure the consistently high standards in LCC K-9 Comfort Dog behavior and handler knowledge. LCC works with a number of educational, veterinary, and other professionals on an advisory level to insure its training methods and curriculum along with the highest standards of veterinary care is provided for every LCC K-9 Comfort Dog. LCC Kare 9 Military Ministry is an outreach of Lutheran Church Charities designed to specifically connect with active military, veterans, and their families, to stand by them during active service and when they return home. Veterans may only reveal their story to another veteran — someone they feel will understand what they have experienced. A LCC K-9 Comfort Dog is a purebred Golden Retriever who is AKC registered and has passed the AKC Good Citizenship Test and received their LCC certification. LCC K-9 Comfort Dogs and their handlers are certified by Lutheran Church Charities as a K-9 Comfort Dog. LCC K-9 Comfort Dogs and their handlers receive ongoing and advance training. LCC K-9 Comfort dogs are trained to work with as many as six to eight trained handlers. Every LCC K-9 Comfort Dog is trained and certified through LCC K-9 Comfort Dog Ministry. Once the dog is certified it receives an ID badge and a vest as a LCC K-9 Comfort Dog. The following are the tests each dog is given and must pass in order to be certified by our trainers. 2 Handled by Stranger The animal is handled by a stranger. The evaluator will look in ears, hold tail, put fingers in mouth, and handle feet. Exuberant/Clumsy Petting The evaluator will repeat the petting using stronger, more aggressive pressure. Evaluator becomes exuberant, speaking in a high-pitched voice, squealing, grabbing the dog's ears, tail, and feet. 3 Test for Hand -Shy The evaluator will, unexpectedly move his/her hand directly at the dog's head in a quick motion. 4 Restraining Hug The evaluator will, unexpectedly give the dog a full body hug that restricts its movement. 5 Loud Vocalization The evaluator will begin to shout and wave arms about 6 feet from the dog. 6 Sitting with Stranger The evaluator will sit in a chair and the dog will be given the "free" or "visit" command. The evaluator will pet and talk to the dog. Supervised separation — 3 minutes. 7 Reaction to Movement The evaluator will sit in a chair and swing an extremity in the proximity of the dog. 8 Blow in Face The evaluator will unexpectedly, blow into the dog's face. 9 Feet Stomping The evaluator and at least one other person will walk around the animal in a wide circle stomping their feet. 10 Reaction to Running The evaluator will run past the dog. The dog should remain in a sit or down position. Crowded Petting The evaluator and two other people will gather closely around the dog and begin to touch it. All people will talk at once to get the dog's attention. 12 Come When Called Handler stands 6 feet away and calls dog to come. 13 Controlled Load and Unload Out of Vehicle The handler/trainer will load the dog into vehicle with dog entering first on command. The dog may not sniff or eat the food. The individual may vocally correct the dog, but the dog must maintain a sit and ignore the food without repeated commands. 19 Sit with Shopping Cart Distraction The dog will sit on command as a person with a shopping cart approaches within 3 feet of the dog and continue past. The dog should remain in the sit and not show fear of the shopping cart. 20 Sit Politely for Petting The dog is in a sit when a person walks up behind the team, talks to the person, and asks to pet the dog. The dog may not break the sit to solicit attention. The dog may be in the heel position for this test component. 21 Down on Command The dog is to complete a down immediately after receiving the command. The handler may correct and repeat the down command one additional time. 22 Down with Food Distraction The dog will complete a down on command 2 feet or less away from a table where food will be dropped on the floor. The dog may not break the down to go for the food or sniff at it. The handler/trainer may give a verbal "leave if and leash correction to maintain the down. No repeated commands. 23 Down with People Distraction The dog will complete a down on command, and then 2 people will approach the dog. The dog should maintain the down and not solicit attention. 24 Noise Distraction The team will be walking and the evaluator will drop and object to the ground behind the team. The dog may acknowledge the noise, but may not show fear or aggression. A startled reaction is acceptable, the dog may jump or burn but needs to quickly recover and continue to walk with handler/trainer. The dog should NOT become aggressive or begin shaking. 25 Handler Seated with Dog Under Table The dog should go under the table and lie down until released. This test is to evaluate eac,i potential handler's ability to effectively lead an LCC K-9 Comfort Dog into various situations. It also tests the ability of each handler's ability to provide correction, if needed, with an appropriate response. LCC Handler Comprehension Evaluation Test 1: Human conversation This test demonstrates that the hander knows how to instruct the dog to sit and be patient, while the handler has a conwersation with a friendly person. The person may be known or unknown to the dog. A LCC Evaluator will approach the handler and begin a brief conversation. The evaluator may shake hands with the handler, laugh, etc... They will not pay attention to the dog. The dog should remain in the sit position, patiently waiting for their handler to finish. The dog should not fidget, stand, approach the handler or break the position they were given. Should the dog do any of these activities, the handler must demonstrate, through proper correction, that they can confidently enforce a command. Test 2: Handler guides dog while being pet This test demonstrates that the handler is able to guide the LCC K-9 Comfort Dog through being pet by another person. The dog should be sitting in the heel position next to the handler. A LCC Evaluator will approach and ask if they can pet your dog. As a handler, you need to decide what will be the best position for the dog to be in while being pet. If the handler chooses sit or down, the dog should remain in that position while they are interacting with the same person. If the dog breaks the position, the handler must demonstrate the best way to guide the dog to continue the interaction. Test 3: Appearance and grooming This practical test demonstrates that the handler is prepared and capable of doing a quick grooming on a dog before a visit or after a play paycheck. The handler looks over the dog, checking ears, paws/ nails, and cleanliness. The handler uses a brush to lightly brush the loose fur that easily tangles. Checks collar, bandana, and vest. This is a brief check. The handler lets the evaluator know when they feel the dog is prepared to leave for their outing. Test 4: Walking in the "With Me" position This test demonstrates that the handler is in control of the dog. The dog is on the left side of the handler with their "ears to the seam" of their pants. The dog is permitted to look forward or at their handler. The LCC Evaluator will instruct the handler to make a left turn, a right turn, and a complete turn. (The handler goes in the opposite direction they are walking). When the evaluator instructs the handler to stop, he or she will take 2 slower steps and the dog must sit. If at any point the dog breaks the "with me" position, forges ahead, lags behind, or fails to sit; the handler must demonstrate the ability to correct and guide the dog appropriately. Test 5: Walking through a crowd This test demonstrates that the handler is able to guide the dog, while making good handling choices, in a crowded environment. The environment may be on, or in a simulated crowded street or group of people wandering about. The handler should guide and praise as necessary to ensure the dog remains under control and confidant. Should the dog become fearful, break their "with me" position, or fail to meet LCC K-9 Comfort Dog expectations; the handler must guide and / or correct appropriately. Test 6: Sit..Down..Stay This test demonstrates that the handler has the ability to give commands, with the expectation that the commands will be followed. Handler commands sit. Handler commands down. Handler commands stay, drops the lead and walks roughly 15 feet away from the dog. Holds that position for 20-30 seconds, then returns to the dog and picks up the leash. The stay may be done in either the sit or down position. The handler may not lean over to tell the dog down or stay. If the dog breaks from a position or refuses to follow a command, the handler corrects appropriately. The handler tells the dog sit or down. The handler will walk 10 feet from the dog, turn to face the dog, and tell the dog to come. The dog must come and sit directly in front of them. The handler may use praise to encourage the dog while they are moving. If the dog moves before commanded to come, does not come, or fails to sit once they reach the handler; the handler should correct appropriately. The exercise should be repeated if not completed properly. Test 8: Reaction to another dog This test demonstrates that the dog can behave politely around other dogs. Two handlers and their dogs approach each other from a distance of about 20 feet, stop, shake hands and exchange pleasantries, and continue on for about 10 feet. The dogs should show no more than casual interest in each other. Neither dog should go to the other dog or its handler. Should the dog or handler use poor judgement, the exercise should be repeated. Test 9: Reaction to distraction This test demonstrates that the handler is confident at all times when faced with common distracting situations. The evaluator will select and present two or more distractions. Examples of distractions include dropping a chair, rolling a crate dolly past the dog, having a jogger run in front of the dog, or dropping a crutch or cane. The dog may express natural interest and curiosity and/or may appear slightly startled but should not panic, try to run away, show aggressiveness, or bark. The handler may talk to the dog and encourage or praise it throughout the exercise. Should the dog show a fearful or display behavior that is not appropriate for a LCC K-9 Comfort Dog, the handler must guide their dog to a successful outcome. Test 10: Wait and passing through a door This test demonstrates that a handler can guide a dog properly through a closed door. The handler must be able to demonstrate that they can command the dog to wait. The handler must be able to open the door, hold it safely while moving themselves and the dog through. The handler may only release the door for closure once the dog has passed through and cleared the path of the door.
