HomeMy WebLinkAbout20242074.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, AUGUST 5, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, August 5, 2024, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman — EXCUSED Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Controller, Chris D'Ovidio ▪ MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of July 22, 2024, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. ▪ AMENDMENTS TO AGENDA: There were no amendments to the Agenda. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Buck seconded the motion and it carried unanimously. CI PROCLAMATIONS: 1) WELD COUNTY CHILD SUPPORT AWARENESS MONTH - AUGUST 2024: Chair Ross read the proclamation for the record. Tami Grant, Deputy Director of the Department of Human Services, expressed gratitude to the Board for the opportunity to recognize their team and raise awareness for child support services. She further explained the definition of child support and the financial stability it creates, rather than relying on public assistance. Ms. Grant shared statistical data to support the amazing work staff has done with processing the court orders, phone calls, and caseloads, and indicated Weld County was recognized with the Outstanding Large County in Child Support Services Award for the 2023-2024 fiscal year and reached all four (4) Colorado Statutory (C-Stat) Measures. She reported from January 2024, through June 2024, their staff has processed more than $12 Million in child support payments, which is distributed to families throughout Weld County, and further introduced staff who were in attendance for the record. In turn, each Commissioner expressed their gratitude for the daily challenges staff faces with positivity, remarking that it is often the silent efforts that allow children to become healthy and happy citizens. Izc) Minutes, Monday, August 5, 2024 Page 1 2024-2074 BC0016 • WARRANTS: 1) GENERAL WARRANTS - JULY 31, AND AUGUST 2, 2024: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. BIDS: 1) APPROVE BID #B2400109, ADMINISTRATION BUILDING (1150 'O' ST, GREELEY) HEATING, VENTILATION, AND AIR CONDITIONING (HVAC) CONTROL UPGRADES - FACILITIES DEPARTMENT: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Johnson Controls, Inc., for a total amount of $100,715.00. Commissioner Buck moved to approve said bid. The motion was seconded by Commissioner James, and it carried unanimously. • NEW BUSINESS: 1) CONSIDER STANDARD FORM OF AGREEMENT AND RATES FOR PROFESSIONAL SERVICES FOR OLDER AMERICANS ACT (OAA) IN -HOME SERVICES VOUCHER PROGRAM BETWEEN THE DEPARTMENT OF HUMAN SERVICES AND VARIOUS PROVIDERS, AND AUTHORIZE CHAIR TO SIGN ANY AGREEMENT CONSISTENT WITH SAID FORM: Ms. Grant recommended approval of a standard form with various in -home service providers as part of the Older Americans Act (OAA), at a rate of $29.00 per hour, with a term of July 1, 2024, through June 30, 2025. Commissioner James moved to approve said form and authorize the Chair to sign any agreement consistent with said form. The motion was seconded by Commissioner Buck, and it carried unanimously. • 2) CONSIDER CONTRACT ID #8514 AGREEMENT TO PURCHASE OUT -OF -HOME PLACEMENT SERVICES AND AUTHORIZE CHAIR TO SIGN - GRIFFITH CENTERS, INC.: Ms. Grant stated the agreement is for out -of -home placement services for children in the child welfare system, when needed, with the state -approved rate, funded through the Child Welfare Block Grant with terms from July 1, 2024, through June 30, 2025. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. • 3) CONSIDER CONTRACT ID #8536 AGREEMENT TO PURCHASE OUT -OF -HOME PLACEMENT SERVICES AND AUTHORIZE CHAIR TO SIGN - ADOPTION OPTIONS: Ms. Grant stated the agreement is for out -of -home placement services for children in the child welfare system, when needed, with the state -approve rate, funded through the Child Welfare Block Grant with terms from July 1, 2024, through June 30, 2025. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. • 4) CONSIDER CONTRACT ID #8522 EXPENDITURE AUTHORIZATION AND WORK PLAN FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) JOBS FOR VETERANS STATE GRANT (JVSG) PROGRAM AND AUTHORIZE CHAIR, DEPARTMENT OF HUMAN SERVICES, AND WORKFORCE DEVELOPMENT BOARD TO SIGN: Ms. Grant stated the expenditure authorization currently compliments the Veteran Service Officers to provide services to veterans in Weld County. She indicated the state intends on sunsetting the program, which is reflective of the low funding amount of $10,000.00, with a term from October 1, 2023, through December 31, 2024. Commissioner Buck moved to approve said expenditure authorization and workplan, and authorize the Chair, Department of Human Services, and the Workforce Development Board to sign. The motion was seconded by Commissioner James, and it carried unanimously. Minutes, Monday, August 5, 2024 Page 2 2024-2074 BC0016 ▪ 5) CONSIDER CONTRACT ID #8533 FOR COLORADO WORKS SUBSIDIZED TRAINING AND EMPLOYMENT PROGRAM (CW STEP) AND AUTHORIZE CHAIR TO SIGN: Ms. Grant stated the contract provides Colorado Temporary Assistance for Needy Families (TANF) participants the opportunity to engage in work -based learning activities while earning susidized minimum wage. She stated the funding amount totals $150,000.00, from July 1, 2024, thought June 30, 2025. Commissioner Buck moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried unanimously. • 6) CONSIDER CONTRACT ID #8534 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - JOHN AND SANDY HILDEBRAND: Ms. Grant stated the contract is for a fully certified foster care home located in Loveland, Colorado, from August 1, 2024, through April15, 2025. Commissioner Buck moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried unanimously. IR 7) CONSIDER CONTRACT ID #8554 2024-2025 CORE SERVICES PROGRAM PLAN AND AUTHORIZE CHAIR AND DEPARTMENT OF HUMAN SERVICES TO SIGN: Ms. Grant stated the Core Services Program Plan is required annually by the state for increased core funding, in an approximate amount of $6 Million, which will be distributed through the Child Welfare Division through core and non - core services from July 1, 2024, through June 30, 2025. Commissioner James moved to approve said plan and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. • 8) CONSIDER SETTLEMENT AGREEMENT AND RELEASE FROM SHERIFF'S OFFICE SHOOTING RANGE/TRAINING SITE PROJECT, CHANGE ORDER FOR SHOOTING RANGE, AND AUTHORIZE CHAIR TO SIGN - ROCHE CONSTRUCTORS, INC.: Bruce Barker, County Attorney, stated the first item of consideration is the settlement agreement with Roche Constructors, Inc., to allow MT2, LLC, to mitigate various aspects to the construction of the shooting range for the amount of $45,000.00. Mr. Barker stated the second item for consideration is the change order to the original agreement, which reduces the amount by $54,000.00, as part of the overall $1 Million retainer that needs to be paid out. Commissioner James moved to approve said agreement and change order, and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. • 9) CONSIDER WAIVER OF THE RIGHT OF FIRST REFUSAL GRANTED TO WELD COUNTY BY AND THROUGH C.R.S. §29-4-1202(2)(A): Mr. Barker stated legislation created the Right of First Refusal for local governments to purchase multi -family or mixed use residences, no less than five (5) units, which includes mobile home parks. He explained the intent is for mountain communities that need to purchase residential properties for their employees. Mr. Barker indicated the Resolution waives the Board's right of first refusal to purchase, with a matched offer of stated residential properties for existing affordable housing, until and unless the waiver is rescinded by subsequent action of the Board. He clarified this action means that sellers of such properties are not required to notify Weld County as required by C.R.S. §29-4-1202(3). Commissioner James moved to approve said Resolution. The motion was seconded by Commissioner Buck, and it carried unanimously. • PLANNING: 1) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION PENALTIES AS SPECIAL ASSESSMENT - BRUCE OLSON AND SUZANNE BRUNSTROM (CONT'D FROM 11/8/2023): Karin McDougal, Deputy County Attorney, alongside Cynthia Villanueva, Department of Planning Services, stated Bruce Olson and Suzanne Brunstrom, have a court -ordered penalty of $25.00 per day, beginning on May 8, 2023, through October 3, 2023, which is a period of 149 days and Minutes, Monday, August 5, 2024 Page 3 2024-2074 BC0016 violations include a building converted into a dwelling unit without a building permit and does not meet offset bulk requirements, which results in a total special assessment of $3,725.00 to be certified. She indicated the property owner had retained counsel and is currently working towards correcting the issues on his property and a motion was filed on October 4, 2023; however, Ms. McDougal stated staff recommends the Board certify the stated amount due to lack of progress made to bring the property into compliance. Stacey Shea, representative of Bruce Olson, noted she does not represent Suzanne Brunstrom, acknowledged the current status of the property, and further updated various attempts from Mr. Olson to bring the property into compliance. She indicated her client is working with the Department of Planning Services to pursure a variance option, but would rather pursure a Lot Line Adjustment (LLA). She requested and additional 30 days to have the survey plat for the LLA and supporting documentation ready for submittal once documents are obtained from the owner on the northern property. Commissioner James moved to continue said certification of zoning violation to September 4, 2024, at 9:00 a.m. The motion was seconded by Commissioner Buck, and it carried unanimously. • 2) FINAL READING OF CODE ORDINANCE #2024-10, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING OF THE WELD COUNTY CODE (FLOODPLAIN): Commissioner James moved to read Code Ordinance #2024-10 by title only. The motion was seconded by Commissioner Buck and it carried unanimously. Mr. Barker read the title for the record. Diana Aungst, Department of Planning Services, reviewed the proposed changes, stated there have been no additional changes since Second Reading, and indicated staff recommends approval. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2024-10 on Final Reading. The motion was seconded by Commissioner Buck and it carried unanimously. • PUBLIC COMMENT: No public comment was offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2024-10 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
