HomeMy WebLinkAbout20240866.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, APRIL 15, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 15, 2024, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli ri MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of April 1, 2024, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. • AMENDMENTS TO AGENDA: Commissioner Saine moved to amend the Agenda to remove the 15 -minute time limit and vote provisions under `Public Comment'. There being no second, the motion failed. There were no additional amendments to the Agenda. • CONSENT AGENDA: There being no public testimony concerning Partial Vacation, VAC24-0003, of Two -Lot Recorded Exemption, RE -1912, for Removal of Lot B — Jerome Throckmorton, Jr., Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion and it carried unanimously. • WARRANTS: 1) GENERAL WARRANTS - APRIL 12, 2024: Commissioner Buck moved to approve the General Warrants, as printed. Seconded by Commissioner James, and upon a roll call vote of four (4) to one (1), the motion carried with Commissioner Saine opposed. Minutes, Monday, April 15, 2024 Page 1 2024-0866 BC0016 • BIDS: 1) APPROVE BID #B2300066, IT PRINT MANAGEMENT SOLUTION — DEPARTMENT OF INFORMATION TECHNOLOGY: Toby Taylor, Purchasing Department, stated three (3) proposals were received and explained this software will help centralize print management capabilities, assist with printer status monitoring, issue/maintenance tracking and reporting, device setup and configurations, printer and print object security, multi -location support, and detailed print analytics. He indicated staff recommends selecting the lowest cost solution that meets specifications, Zivaro, Inc., for the total amount of $34,896.15. Commissioner Saine moved to approve said bid. The motion was seconded by Commissioner Buck, and it carried unanimously. ▪ 2) APPROVE BID #B2400062, VMWARE MAINTENANCE PS — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Taylor stated five (5) bids were received and reviewed staffs recommendation to select Insight Public Sector, Inc., the lowest cost solution that meets specification, for the total amount of $40,642.56. Commissioner Saine moved to approve said bid. The motion was seconded by Commissioner Buck, and it carried unanimously. ▪ 3) APPROVE BID #B2400064, CONCRETE - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor introduced Raptor Materials, LLC, as the sole bidder and confirmed the price for Exterior and Pumpable Class D concrete is $181.25 per yard, and the price for Flowfill is $150.00 per yard. He noted both recommendations are for north and south Weld County, and shared a bid response was not received for Class E concrete. Mr. Taylor stated $236,625.00 is budgeted for this purchase and staff recommends approval. In response to Commissioner Saine, Mr. Taylor reiterated Raptor Materials, LLC, was the sole bidder. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner Saine, and it carried unanimously. le 4) PRESENT BID #B2400055, CONTINUAL MOTOR VEHICLE RECORD MONITORING SOFTWARE - DEPARTMENT OF HUMAN RESOURCES: Mr. Taylor stated one (1) bid was received and staff will make a recommendation on May 13, 2024. ▪ NEW BUSINESS: 1) CONSIDER CONTRACT ID #7959 LICENSE AGREEMENT FOR USE OF WELD COUNTY PROPERTY FOR VETERINARY VACCINE CLINIC AND AUTHORIZE CHAIR TO SIGN - REZDAWG RESCUE: Chris Coulter, Director of the Facilities Department, stated Rezdawg Rescue is a non-profit animal rescue that requested the use of the parking lot east of the Weld County Food Bank (located at 1104 H Street, Greeley) for a one -day vaccine clinic for people who cannot afford veterinary care for their animals. He further stated this clinic will take place on June 22, 2024, between the hours of 8:00 a.m. and 12:00 p.m. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. • 2) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR PAYMENT OF FEDERAL MINERAL LEASE FUNDS FOR ROAD IMPROVEMENTS PROJECT FUNDING AND AUTHORIZE CHAIR TO SIGN - FEDERAL MINERAL LEASE ACT DISTRICT: Commissioner Freeman stated he has been the President of the Federal Mineral Lease Act Board for the past twelve (12) years and referenced this item of business results from fund monies from the Federal Mineral Lease Program. He indicated the amount varies from year to year, but the amount is divided between the Water Testing Program and the Haul Route Program (HARP). Cheryl Pattelli, Chief Financial Officer, clarified the current estimated amount is $1,200,000.00, but is subject to change. Commissioner Freeman moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. Minutes, Monday, April 15, 2024 Page 2 2024-0866 BC0016 • 3) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR PAYMENT OF FEDERAL MINERAL LEASE FUNDS FOR WATER TESTING PROGRAM FUNDING AND AUTHORIZE CHAIR TO SIGN - FEDERAL MINERAL LEASE ACT DISTRICT: Commissioner Freeman commented the Water Testing Program began in 2011 and the funding is estimated in the amount of $52,000.00, which has increased slightly from years past to accommodate for the rise in costs associated with the testing process. Commissioner Freeman moved to approve said agreement and authorize Chair to sign. Seconded by Commissioner James, the motion carried unanimously. 4) CONSIDER EXTENSION OF TEMPORARY CLOSURE OF CR 39 BETWEEN CRS 70 AND 74: Amy Mutchie, Department of Public Works, requested the Board extend the closure for one (1) week, at the request of Goodell Construction, said extended closure to begin April 19, 2024, and go through April 26, 2024, due to adverse weather delays. In response to Chair Ross, Ms. Mutchie confirmed message boards will be updated with the new dates. Commissioner James moved to approve said extended temporary closure. The motion was seconded by Commissioner Buck, and it carried unanimously. • 5) CONSIDER SETTLEMENT AND RELEASE AGREEMENT, AND AUTHORIZE CHAIR TO SIGN - COLORADO PUBLIC EMPLOYEES' RETIREMENT ASSOCIATION (PERA): Bruce Barker, Weld County Attorney, stated the agreement is the result of over -payment of contributions by Weld County, Weld County employees, and 21 active Weld County retirees. Neither benefits nor the amounts contributed will change and the active members and Weld County will receive a refund for the overpayment. He further stated each of the retirees will need to partake in their own settlement agreement to receive the same refund. Chair Ross applauded staff for their tireless efforts to resolve this issue on behalf of employees and active retirees to ensure the best possible outcome. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James, and it carried unanimously. • PUBLIC COMMENT: No public comment was offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
