RE: FINDINGS AND ORDER: AUTHORIZE ABATEMENT OF DANGEROUS BUILDING
LOCATED AT 3716 YOSEMITE DRIVE, GREELEY, COLORADO 80634
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 29-2-80 of the Weld County Code, and the International
Conference of Building Officials known as the Uniform Code for the Abatement of Dangerous
Buildings, the Board has established standards and procedures for the abatement of dangerous
buildings by repair, rehabilitation, demolition, or removal, and
WHEREAS, said property (Parcel #070512300004) located at 3716 Yosemite Drive,
Greeley, Colorado 80634, and being further described as Lot Four (4), Block Seven (7),
HILL -N -PARK, a subdivision located in the South Half (S1/2) of Section 26, Township 5 North,
Range 66 West of the 6th P.M., County of Weld, State of Colorado ("the Property"), and
WHEREAS, the 1970 Embassy II Mobile Home, bearing vehicle #3JE6512ER3N227998,
has been deemed by Weld County Building Official, Robert Godin, to be a dangerous building,
pursuant to the definitions of the Weld County Code, and
WHEREAS, notice of a public hearing was duly published on April 13, 2024, in the Greeley
Tribune, and six (6) letters were sent by certified mail on April 12, 2024, and
WHEREAS, the Board held a public hearing on April 29, 2024, for the purpose of hearing
the testimony regarding this matter, at which time purported property owners, including
Clinton Vickery and occupants, were noticed and were not present, and
WHEREAS, after hearing all of the testimony and statements of Robert Godin, Chief
Building Inspector, and the Weld County Attorney's Office at said hearing, and the
recommendation of staff, the Board deems it advisable to Order purported property owners,
including Clinton Vickery and the occupants of 3716 Yosemite Drive, to abate the building by
securing the building with fencing, within ten (10) days of said hearing, or not later than May 9,
2024, and
WHEREAS, if the building is not adequately secured by the purported property owners or
occupants, the Board deems it advisable to authorize the Weld County Department of Planning
Services to enter the property and construct fencing around the building to attempt to secure the
building.
WHEREAS, if the building is not adequately secured by the fencing, the Board deems it
advisable to authorize the Weld County Department of Planning Services to proceed with the
demolition of the building, and that the final costs of such abatement work (fencing or demolition
performed by the County) become a lien on the property, pursuant to Section 29-2-60.M of the
Weld County Code (adding Section 801.2.1 to the Uniform Code for the Abatement of Dangerous
Buildings, 1997 Edition).

FINDINGS AND ORDER: AUTHORIZE ABATEMENT OF DANGEROUS BUILDING LOCATED

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that an Order of Abatement be, and hereby is, issued to the purported property
owners and occupants of said property, including Clinton Vickery, pursuant to Section 29-2-80 of
the Weld County Code, whereby the following actions are ordered to abate the dangerous building
of the property:
1. That the owners and/or occupants construct a fence around the building to attempt to
secure it from being accessed, and therefore, abate the dangerous condition by May 9,
2024.
2. That the Chief Building Official and Weld County Department of Planning Services are
authorized to enter the property and take action to construct the fence on the property
if the owners and occupants of the property fail to do so by May 9, 2024.
3. That the Chief Building Official and Weld County Department of Planning Services are
authorized to enter the property and take action to have the dangerous building
demolished if the fencing fails to secure the building and/or abate the dangerous
condition.
BE IT FURTHER RESOLVED that due to the health hazard posed by the property, the
Weld County Attorney's Office is directed to take action to vacate any authorized and
unauthorized tenants from the residence on the property and to initiate additional enforcement
actions as necessary.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to record this Resolution in the records of the Weld County Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 29th day of April, A.D., 2024.

Clinton James Vickery:
This letter is to inform you that I have determined that the mobile home located at 3716
Yosemite Drive is a dangerous building as defined by Section 302 of the 1997 Uniform Code for
the Abatement of Dangerous Buildings as adopted by Chapter 29 of the Weld County Code. I
have found the building is in such a condition as to make it immediately dangerous to the life,
limb, property, or safety of the public or occupants. IT IS HEREBY ORDERED THAT THE MOBILE
HOME BE VACATED IMMEDIATELY.
I have found the mobile home has been damaged by fire to such an extent that the structural
strength or stability is less than the minimum requirements of the building code. The building is
unfit for human habitation due to fire damage, decay, dilapidation, and inadequate sanitation
facilities. Additionally, there is a substantial amount of rubbish and garbage on the premises
that poses a danger to the safety of the public or occupants.
I have determined that this residence is a dangerous building and that it must be abated. You
are hereby ordered to take the following steps necessary to abate this building by the dates
that appear below.
1. The mobile home must be vacated immediately. The mobile home must be secured in such a
manner that prevents entry. The building must be secured by January 15, 2024.
2. It is further ordered that all rubbish and garbage be removed from the property by January
15, 2024.
2. It is further ordered that the mobile home be demolished and all debris be removed from the
site. Prior to demolishing the building, a demolition permit shall be required. The demolition
permit shall be obtained by January 10, 2024.
Failure to comply with this order may result in the abatement work being performed under the
direction of Weld County and the costs thereof charged to you as the owner of the property.
You, or any person having any record title or legal interest in the building or premises may
appeal this action to the Weld County Building Code Board of Appeals provided the appeal is
made in writing, as provided in Chapter 5 of the Uniform Code of the Abatement of Dangerous
Buildings, as adopted by reference in Chapter 29 of the Weld County Code. Such notice shall be
filed in our office within 30 days from the date that this notice is served to you, either

Notice of Abatement Proceedings and Public Nuisance Hearing
Notice is hereby given that the following property described as: Lot four (4), Block seven (7),
Hill -N -Park, a subdivision located in the South half (S1/2) of Section 26, Township 5 North,
Range 66 West of the 6th P.M., Weld County, Colorado, also known as 3716 Yosemite Drive,
Greeley, Colorado 80634, contains a structure that the Weld County Building Official has deemed
as a dangerous building and Weld County staff has reason to believe that the property constitutes
a public nuisance.
You are hereby notified that pursuant to the 1997 Uniform Code for the Abatement of Dangerous
Buildings, as adopted by Chapter 29 of the Weld County Code, a public hearing will be held in
the Chambers of the Board of County Commissioners of Weld County, Colorado, Weld County
Administration Buiding, 1150 O Street, Assembly Room, Greeley, Colorado 80631. You may be
present at the hearing. You may be, but need not be, represented by counsel. You may present
any relevant evidence and will be given full opportunity to cross-examine all witnesses testifying
against you. If you have an interest in the property or questions, contact the Weld County
Attorney's Office at (970) 336-7235.
If a court reporter 's desired, please advise the Clerk to the Board, in writing, at least five (5) days
prior to the hearing. The cost of engaging a court reporter shall be borne by the requesting party.
