WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Confidentiality Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Neighbor to Neighbor, Inc., commencing February 1, 2024, and ending January 31, 2025, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Confidentiality Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Neighbor to Neighbor, Inc., be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. DEPARTMENT: Human Services DATE: February 13, 2024 PERSON REQUESTING: Jamie Ulrich, Director, Human Services Brief description of the problem/issue: The Department is requesting to enter into a Confidentiality Agreement with Neighbor to Neighbor, Inc, a nonprofit housing organization located in Larimer County. The purpose of this agreement is to define the roles of Weld County and Neighbor to Neighbor related to the client confidentiality of emergency rent and utility assistance applications. The term of this agreement is February 1, 2024 through January 31, 2025 and may be renewed annually upon written agreement of both parties. The Board entered into a prior Confidentiality Agreement with Neighbor to Neighbor on March 24, 2021 known to the Board as Tyler# 2021-0840, which expired on December 31, 2023. What options exist for the Board? • Approval of the Confidentiality Agreement between Weld County Department of Human Services and Neighbor to Neighbor, Inc. • Deny approval of the Confidentiality Agreement between Weld County Department of Human Services and Neighbor to Neighbor, Inc. Consequences: Weld County will not have an Agreement in place with Neighbor to Neighbor. Impacts: Weld County could have a delay in services for families applying for rent and utility assistance. Neighbor to Neighbor, is a nonprofit housing organization located in Larimer County. The parties are the primary Northern Colorado providers of emergency rental and utility assistance services for households requesting emergency rent and/or utility assistance. Both parties agree to maintain client confidentiality, to share information in an effort to avoid duplication, and to use client information for the sole purpose of processing requests for rental and/or utility assistance. Each party will maintain confidential information in confidence and will use reasonable efforts to prevent the disclosure to unauthorized third parties unless disclosure is required pursuant to C.R.S. 24-72-202 et seq or other Colorado law. Each party will use the confidential information only for the purposes of distributing emergency rent and/or utility assistance unless another use, such as complying with open records laws, is required by law. No term or condition of this agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections, or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now or hereafter amended. The parties have entered into this Confidentiality Agreement as of the date first set forth above.
