Good morning, all,
I'm trying to get things cleared off my desk before I retire in December and found the following email conversations from
2018 and an Original Subdivision Bond for the above referenced case. I don't believe we've ever received an answer on the
Subdivision Bond and, of course, even if it doesn't apply anymore (date on it 3/27/18), we need to do something with it. It's
in the amount of $181,720.00. Does anyone know anything about this one? I believe it's Chris Gathman's case. Chris, are
you aware of the status of this Bond?

As I am attempting to clean off my desk, there are a few follow-up collateral/improvements agreements needing
attention... please review the (entire) email string below and respond accordingly. I still have the $181,720.00... received
4/30/18 from Ben Zadel, NCC, 303.434.6599, effective 3/27/18... we have not accepted it thru resolution because to
date, I have no information on a site inspection and potential amendment to the IA or collateral. I need to know if old
collateral needs to be released, if this new collateral is an accurate amount considering the IA is from 2010... last I heard
Chris and Evan were going to inspect the site. Let me know how you wish to proceed.

The email below is from June 1 and we are heading toward July 1st — just touching base as I still hold a recently
submitted Subdivision Bond for $181, 720.00... and there is a current collateral for $13,121.00 regarding landscape
improvements that need to be inspected. Two inspections need to happen — have the current collateral improvements
been made?... and if so — then I can potentially release the $13,121.00 — if they are complete and if the applicant
submits a formal request. Part two — is the inspection for the items on the Exhibit list related to the $181,720.00 to see if
we can move forward based on the stipulation of the improvements agreement and accept this new collateral as the
developer moves into the next phase?

Frank, the $181k was sent to me recently — guessing for the other improvements on the Exhibit list. I have not processed
it yet because we could not figure out what was going on. I only technically hold the 13k from 2010, which sounds like I
need to hold onto.
Evan, thank you for contacting them. I thought all exhibits were attached to the IA — and required? So we are not going
to accept this new collateral for further improvements that ARE IN the IA? Why? And do I send it back to him?

Tisa,
I have talked with NCC regarding this collateral. They were under the impression that they were still required to have
$181,720.00 in collateral, so when they recently changed banks, they thought that they needed to provide that amount
in collateral from the new bank. I let them know that we are only requiring the $13,121.00 at this point for warranty
collateral. I am working with them to update the collateral because they have switched banks. We are not releasing any
additional collateral at this point because they have not completed the landscaping requirements. Chris verified this
with a recent site visit.

I am still holding this recently submitted collateral and had provided the contact information to PW and documentation
from sleuthing (attached) in hopes someone on that end could advise regarding the large Subdivision Bond for
$181,720.00 and the improvements listed in the exhibits? I also requested advisement regarding current collateral held
$13,121.00 and if those improvements (also in the exhibits) had been inspected to know if this should bean acceptance
in conjunction with a release.

Just let me know how to proceed once an inspection has taken place and PW has communicated with the developer as
this IA dates back to 2010.

I am not aware of anything regarding this bond. I know that the City of Thornton owns the parcel now, Fort Lupton
maintains the roads (CR18/CR25), and it is in our jurisdiction. I am not able to find the Improvements Agreement
between the County and Thornton, that they are referring to. Basically I am no help on this.
