PUBLIC AUCTION
BE IT RESOLVED, that the following described real estate together with
improvements thereon, to -wit:
The East 138 feet of Lot Eleven (11), in Seaman and
Cranford's Subdivision of the E': of Block 161, in the
City of Greeley, Weld County, Colorado,
is no longer of any specific usefulness for any purposes of the county govern-
ment or functions, and therefore, the same is hereby ordered sold at public
auction on February 20, 1960, at 1:CO o'clock in the afternoon on said day by
Claude Redman, a licensed auctioneer, at the premises of the property above
described known and numbered as 1541 11th Avenue, Greeley, Colorado.
BE IT FURTHER RESOLVED that said sale be advertised by said auctioneer
in the customary manner and that said sale be advertised by the Board of County
Commissioners at the expense of the County by publication of notices of the
sale in newspapers having circulation within the City of Greeley and surround-
ing area; that all such advertising and notices shall give notice that the
County of Weld reserves the right to reject any and all bids.
BE IT FURTHER RESOLVED that the Board of County Commissioners execute
and deliver to the person or persons, firm or corporation to whom said propertu
is struck off at said public sale, a deed to said property in the customary
form, and that such purchaser be furnished with the existing abstract of title
to said premises extended to date at the expense of the County, all upon payment
of the purchase price for said property in cash.

Time is the essence hereof, and if any payment or any other condition hereof is not made, tendered,
or performed by purchaser as herein provided, then this contract shall be void and of no effect, and both
parties hereto released from all obligations hereunder, and all payments made hereon shall be retained
by the undersigned agent as liquidated damages; provided, however, that in the event of such forfeiture
any payments made hereunder shall be divided between said agent and seller, one-half thereof to the
agent but not to exceed a sum equal to _S -% commission and the balance to the seller.
In the event the seller fails to approve this instrument in writing within days from
date hereof, or, if title is not merchantable and written notice of defects is given to the seller or agent
within the time herein provided for delivery of deed, and shall not be rendered merchantable within
days after such written notice, then this contract shall be void and of no effect, and each party hereto
shall be released from all obligations hereof and the payments made hereunder shall be returned forth-
with to purchaser upon return of the abstract to seller.
Upon approval hereof by the seller, this agreement shall become a contract between seller and pur-
chaser and shall inure to the benefit of the heirs, successors, and assigns of said parties.

East Half (EZ) of Block One Hundred Sixty-
one (161), in the City of Greeley, Weld
County, Colorado, according to the recorded
map or plat thereof.
I have examined the accompanying abstract of title. From
such examination it is my opinion, given for your sole benefit
and reliance, that good and merchantable title to said property
is vested in WELD COUNTY, A MUNICIPAL CORPORATION, subject only
to its inclusion within Northern Colorado Water Conservancy
District and to Master Road Plan adopt -13 . e City of Greeley.
