AUTHORIZING CHAIRMAN TO SIGN WAIVER OF SERVICE OF HEARING AS REQUESTED BY
THE OIL AND GAS CONSERVATION COMMISSION OF THE STATE OF COLORADO:
WHEREAS, the Board of County Commissioners, Weld County, Colo-
rado, received a request from the Oil and Gas Conservation Commission of
the State of Colorado, to sign a waiver of service of the notice in the
matter of the promulgation and establishment of field rules to govern
operations in the Pierce Field, Weld County, Colorado, and,
WHEREAS, the Board believes it to be to the best interests of
the County to sign said waiver.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners
of Weld County, Colorado, that the Chairman of the Board be and he is
hereby authorized to sign waiver of service, a copy of which is hereto
attached and made a part of this resolution.
The above and foregoing resolution was, on motion duly made
and seconded, adopted by the following vote:

WAIVER OF SERVICE
CAUSE NO, 104
WHEREAS, on June 19, 1961, Woods & Deffke, Inc., a Colorado corpora-
tion, filed with the Commission an application for an exception to Order No. 104-1,
for a well to be drilled 300 feet east and 300 feet south of the northwest corner of the
Southwest Quarter MSW4 ' of Sec 'ion 26, Township 8 North, Range 66 West of the 6th
P.M., in the Pierce Field, Weld County, Colorado: and
WHEREAS, by its Notice of Hearing of June: 23, 1961, the Commission gave
notice that it would consider said application at a hearing to be held on Tuesday,
July 25, 1961, at 10 a.m. , in Room 320C, State Capitol, Denver, Colorado; and
WHEREAS, the Colorado Oil and Gas Conservation Act provides that where
there is an application for an exception to an established well spacing pattern, a
Notice of Hearing to be held on such application shall be served on the interested
parties in the same manner as is provided in the Rules of Civil Procedure for the
service of process in Civil Actions in the District Courts of Colorado; and
WHEREAS, the Commission requests Waiver of Service of the Notice of said
hearing;
NOW, THEREFORE, the undersigned interested party hereby certifies that
it hereby waives service of the Notice of said hearing in the manner required by the
Act, and hereby consents that the hearing upon said application may be had upon the
day and at the time and place named in the Commission's Notice of June 23, 1961,
or the day to which such hearing may be continued or adjourned.

NOTICE OF HEARING
TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:
On May 24, 1957, the Commission issued its Order No, 104-1, which
established 80 -acre drilling and spacing units for the production of oil and gas
from the Lyons reservoir underlying the Pierce Field, Weld County, Colorado,
with the permitted well for each drilling unit to be located in the approximate
center of the NWI or the SEI of each quarter section, not closer than 600 feet
from the boundary line of such quarter -quarter section.
On June 19, 1961, Woods & Deffke„ Inc., a Colorado corporation, filed
with the Commission an application for an exception to said Order No. 104-1, for
a well to be drilled 300 feet east and 300 feet south of the northwest corner of the
Southwest Quarter (SWe) of Section 26, Township 8 North, Range 66 West of the
6th P.M, , in said Pierce Field,
NOTICE IS HEREBY GIVEN, that The Oil and Gas Conservation Com-
mission of the State of Colorado, pursuant to said application, has set the above
entitled matter for hearing on:
DATE: Tuesday, July 25, 1961
TIME: 10 a.m.
PLACE: Room 320C, State Capitol
Denver, Colorado
Pursuant to said hearing in the above entitled matter, at the time and
place aforesaid, or at any adjourned meeting, the Commission will enter such or-
ders as it deems appropriate to prevent the waste of oil and gas, either or both, in
the operation of said field, with particular reference to rules regulating the spac-
ing of wells, and practices relating to the drilling and completion of said wells in
said field.
