RE: APPROVE GRADUATE SCHOOL OF SOCIAL WORK AGENCY AGREEMENT AND
AUTHORIZE CHAIR TO SIGN - UNIVERSITY OF DENVER, GRADUATE SCHOOL OF
SOCIAL WORK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Graduate School of Social Work Agency
Agreement between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and the
University of Denver, Graduate School of Social Work, commencing upon full execution of
signatures, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Graduate School of Social Work Agency Agreement between
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Human Services, and the University of Denver,
Graduate School of Social Work, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of June, A.D., 2024.

Brief description of the problern/issue: The Weld County Department of Human Services (WCDHS) is
requesting to enter into a Social Work Agency Agreement to offer both employees and non -employees internship
opportunities through the University of Denver (DU). This agreement will become effective on the date last
signed and will automatically renew for one-year periods upon the anniversary of the effective date unless sooner
terminated. Legal (B. Howell) has reviewed and approved the agreement.
What options exist for the Board?
Approval of the Graduate School of Social Work Agency Agreement with DU.
Deny approval of the Graduate School of Social Work Agency Agreement with DU.
Consequences: WCDHS will not have a Graduate School of Social Work Agency Agreement with DU.
Impacts: WCDHS will not be able to offer non -employee and employee internship opportunities
with DU.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
There is no cost associated with the agreement.
Recommendation:
• Approval of the University of Denver Graduate School of Social Work Agency Agreement and authorize
the Chair to sign.

The University of Denver and its Graduate School of Social Work ("School") and Weld County
Department of Human Services ("Agency") mutually agree that Agency will provide a field placement
for educational and on-the-job training experiences that would be beneficial to graduate social work
students of School.
This Agreement will become effective on the date last signed below ("Effective Date") and will remain
in effect for the period of one year. This Agreement shall automatically renew for one year periods
upon each anniversary of the Effective Date unless earlier terminated. Any termination by Agency
shall not be effective, at the election of School, as to any student participating in the educational and
on-the-job training experience under this Agreement until said student has completed the experience,
not to exceed the then -current academic term of five (5) months.
During this period of time, Agency and School will mutually agree on the student assignments and
accepted level of academic preparation required for each student.
Agency and School mutually agree to follow the standards and guidelines of field instruction as
outlined in the prevailing Field Manual of the University of Denver Graduate School of Social
Work, incorporated into this Agreement by reference. The Field Manual is updated each academic
year on School's website:

as soon as the Field Manual is published on the website. If there are any material changes to the
Field Manual impacting Agency, School will notify Agency by email prior to the change being published
and becoming effective. Agency's acceptance of students for field placement constitutes Agency's
agreement to be bound by changes to the Field Manual.
Each party agrees that, for purposes of the field placement, no student in the educational or on-the-
job training experience will be deemed to be an employee of School or Agency. Each party agrees
that the students will be in a learning situation and that the primary purpose of the placement is
for the students' learning. It is further understood that, for purposes of the field placement, the
student shall not at any time replace or substitute for any Agency employee. This Agreement shall
not govem any employment relationship that may exist between the student and Agency.
Agency shall keep confidential any student records obtained or created by Agency in accordance with
the requirements of the Family Education Rights and Privacy Act (20 U.S.C. § 1232 g) ("FERPA")
and the rules and regulations promulgated thereunder and the School's FERPA policy at
https://www.du.eduireaistrar/privacv/index.htrd.
Each party agrees to comply, at its own expense, with the provisions of all state, local, federal and
tribal laws, regulations, ordinances, requirements and codes which are applicable to this Agreement.
Without limiting any liabilities or any other obligation of the Agency, the Agency shall maintain the
minimum insurance coverage below, as applicable:
1. Commercial General Liability, with minimum limits of $1,000,000 per occurrence, and
$2,000,000 aggregate, and endorsed to add "University of Denver and its affiliates, agents,

trustees, officers and employees" as an "Additional Insured as respects their interests" with
reference to this Agreement.
2. Workers' Compensation insurance with statutory amounts as required by law.
a. Agency agrees to adhere to all state Workers' Compensation laws applicable to
intemships. In the case of unpaid intemships, School will provide Workers'
Compensation in accordance with Colorado law.
3. Professional Liability insurance appropriate to the Agency's profession, with minimum limits
of $1,000,000 per occurrence or claim and $3,000,000 aggregate.
4. Directors and officer liability (D&O) with minimum limits of $1,000,000 per occurrence, and
$2,000,000 aggregate.
5. Automobile Liability insurance with a minimum of $1,000,000 combined single limit (applicable
only if Agency is requiring student to drive as part of the duties of the internship).
6. Other insurance coverage if required for additional services under terms set forth in any
Attachment to this Agreement agreed to by the parties.
Certificates of Insurance acceptable to School shall be issued and delivered prior to the
commencement of the services defined in this Agreement. Failure on the part of Agency to meet and
maintain these requirements for the duration of the Agreement shall constitute a material breach of
contract, upon which School may immediately terminate this Agreement.
Nothing contained in this Agreement shall be construed to create a joint venture, partnership, agent
or employment relationship between School and Agency.
No term or condition of this contract shall be construed or interpreted as a waiver, express or implied,
of any of the immunities, rights, benefits, protections or other provisions, of the Colorado
Governmental Immunity Act, C.R.S. §§24-10-101 et seq., as applicable now or hereafter amended.
Neither party has the authority to act for the other party or to bind the other party in any respect
whatsoever, or to incur any debts or liabilities in the name of or on behalf of the other party.
The parties agree that in the performance of this Agreement there will be no discrimination
against students, employees, or other persons related to race, color, sex, religion, creed, age,
national origin, sexual orientation, disability, gender expression, gender identity, genetic background,
veteran status or marital status.
The person signing for each party below represents that they have the proper signature authority
to bind their respective party to the terms of this Agreement.
