Our names are Kendra and Ron Tempest, 619 CR 19, and we are residents of the AG Residential area in Brighton, near the intersection of CR 19 and CR2. We are writing to express our strong opposition to the proposed zoning change by WW, LLC. from Agriculture Residential to Commercial C3 in our neighborhood. The primary reason for our disagreement is the issue of compatibility. Our area is predominantly residential, with over 30 out of 39 lots already developed as homes. Introducing a Commercial C3 zone in this established residential community would significantly disrupt the character and harmony of our neighborhood. The increased commercial activity would likely lead to higher traffic volumes, noise, and other disturbances that are incompatible with a rural residential setting. While I understand that the Opportunity Zone designation is intended to promote economic growth, I believe it is more appropriate to focus such development in areas that are already commercial or industrial in nature. Specifically, the area east of County Road 19, which has existing commercial businesses and no residences, that would be a more suitable location for such zoning changes. Additionally, I would like to address a specific concern regarding the infrastructure claims made by WW, LLC. They have stated that water and sewer services will be provided by Todd Creek Village Metropolitan District. As a customer of Todd Creek Water, I can confirm that they do not provide sewer services, only water. This indicates that WW, LLC does not have a viable solution for sewage management for the proposed C3 zoning change. This misrepresentation further underscores the unsuitability of the proposed zoning change for our area. I am Bill Wycoff and live at 333 County Road 17 with my spouse, Adriann. We moved there in 1982. I appreciate this opportunity to present our family's thoughts and positions regarding the change of zone case. For us the situation has not radically changed from the Spring of 2017. As expected, and presented then, there are now a few more houses and families. And more under construction. There are also more horses, chickens and livestock. But nothing in the way of commercial. People are drawn to the area because of its rural character and that it is in Weld County. Our family has farmed the Southwest corner of the section in focus since acquiring the 80 acres in 1990. Some things have changed. Three large lots with houses have been established and ownership of the remaining 60 plus belongs to Thornton through their use of Eminent Domain. However, we have an open-ended lease with Thornton to keep the land in agricultural production for as long as either Adriann or I live there. Not far away, at the SE corner of Highway 7 and Quebec (CR 17 becomes Quebec South of Hwy.7) there is signage offering 20 commercial acres for sale. That makes sense as Quebec will soon be four lanes there and large developments going in to the South. However, this request is out of harmony with what has been evolving in its nearby area. It is hard to accept that night clubs, taverns, hotels, car washes, gas stations, etc. could be in harmony with the large lot and agricultural uses surrounding it. Your predecessors in 2017 rejected a similar change to commercial proposal. That rejection resulted in a Court review. It was the case of WW, LLC v. The Board of County Commissioners of Weld County. The court supported the decision of those Commissioners. Our family's hope is that you will reject this request to let the area continue to evolve along the same path as it has to date. We appreciate you hearing us out one last time regarding the proposed zoning change directly behind our property. I know you were unable to attend in person due to prior commitments. We wanted to reach out in hopes that you have had a chance to review the hearing from that day but feel there was a strong case made against the compatibility of changing the zoning of this parcel to C3. Talking with all the neighbors in the area I think we all agree that East of CR 19 within the established opportunity zone make sense for commercial consideration as there was already two existing businesses that were under the USR development that were recently converted to C3, however the West side of CR 19 is completely different and is all Ag/residential. We understand this proposed parcel now sits in an opportunity zone but there is nothing we heard in the hearing that said it must be approved for a zoning change just simply because it is in an opportunity zone and that compatibility should be a larger driver on a decision such as this. I know speaking with our attorney they stated that they have represented other folks where such requests were denied in an opportunity zone similar to our situation stating lack of compatibility. We hope that you rule as your predecessors did in 2017 as lack of compatibility is what drove the denial then and nothing has materially changed in the area and ask that you vote to protect and keep the area west of CR 19 ag/residential. Applicant preciously sought a i055 change (USRR17-O016) for this land to install trailer storage, but it was DENIED in 2017 and found not to compatible to the surrounding area, and the commissioners at the time [Barbara ,jfkyngy'yg was our representative) fought for us and agreed that this was not the appropriate area to locate such businesses and the land should remain Agricultural and Residential Zoning. Adams county plans to develop the land directly adjiacent ,[south) tattle applicants land .as residential, and stated that'this proposal is most likely not consistent with Adams •County Comprehensive Plan". We also STRONGLY feel that this is not the right area for an "'Opportunity Zone., and we are failing to understand what the requirements were for selecting these zones,, and who had a say in them_ These "Tones.' did not exist when we fought the'USR change in 2S17, which was denied.. Applicant does snot want to Work with the sunrounding home owners. We reached out to him several years ago when we saw plans that he was potentiiallly going to develop the landwith 1,2 acre residences, but we suspect that because of his previous denial of his trailer storage plan, he refused to call or email us back Applicant again did not reach out nor have a community meeting with all the offset home/property owners. If for some reason this does get passed, wve would (like to see visuoll mitigations in place that include 101: development setback, from, the property boundary, 1V-12' berms with trees that are required to remain alive that need water) just like you require oil and gas facilities in the, area. Please take these points into consideration when making a decision on Wednesday, and ask yourself if this was directly in your hack yard would you be finewith that? Kevin, My objection to the zone change is that adding a commercial property to our neighborhood would be out of place. We purchased our property around 6 years ago because it was surrounded by rural agricultural property and would provide a great location for our retirement home. We have since built our home and have a backyard patio and outdoor cooking area overlooking the Walker property. Adding a commercial business in this area would dramatically degrade our ability to use our backyard as intended. As one of the properties bordering Mr. Walker's property I note that 87% of the adjacent properties are residential / agricultural with only one being business commercial. Although one of the applicant's adjacent properties appears to be commercial it is actually the personal property of my Bidwell who intends to build his retirement home there.
