Home My WebLink About690238.tiffRESOLUTION WHEREAS, it is apparent to the Board of County Commissioners, Weld County, Colorado, that there is an urgent need to establish a means for the collection of delinquent personal property taxes, and WHEREAS, there appears to be approximately $35,000.00 past due personal property taxes requiring immediate attention, and WHEREAS, Professional Finance Company, Weld County, Colorado, has submitted a proposed agreement to collect such delinquent personal taxes on a contingency basis, and WHEREAS, the Board believes it to be in the best interest of the County to enter into such an agreement on the basis recited therein. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that said agreement with Professional Finance Company, copy of which is attached hereto and made a part hereof by reference, be, and it hereby is approved. BE IT FURTHER RESOLVED, that the Board be and it hereby is authorized to execute the agreement as submitted and to make the same effective forthwith. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of February, 1969. M. Mike LOUSTALET, County Treasurer of Weld County, Colorado, here- inafter referred to as Treasurer, and PROFESSIONAL FINANCE COMPANY of Weld County, Colorado, here- inafter referred to as Company. WITNESSETH: WHEREAS, the Treasurer has the obligation to collect all taxes on personal property in Weld County, Colorado, and WHEREAS under certain circumstances the Treasurer has been unable to collect such personal property taxes, because the present whereabouts of the taxpayer is unknown as well as the personal property upon which the assessments were made may not be within Weld County, Colorado, and the existence of such items of personal property are unknown, and WHEREAS Company has resources available so that it may be better able to locate delinquent personal property taxpayers, either inside the State of Colorado or throughout the other states, and WHEREAS Commissioners and the Treasurer desire to retain the services of the Company in handling certain of the delinquent personal property collection matters in the Treasurer's office, and the Company desires to attempt collection of these items referred by the Commissioners and Treas- urer. NOW THEREFORE in consideration of the mutual covenants, it is agreed as follows: 1. That the Treasurer after approval by the Commissioners may deliver to the Company at various times during the term of this Agreement lists of delinquent personal property accounts which will include the name of the taxpayer, the last known address of the taxpayer, together with the amount of the tax including interest and penalties due and owing. -1- 2. Company agrees to make a written itemized acknowledgement to Treasurer of the delinquent personal property tax accounts and to make every reasonable effort to collect the amount due from every delinquent taxpayer referred to by Treasurer. 3. Company shall proceed on the accounts turned over for collection in the usual high standards attributable to collection agencies and make remission of all proceeds to the Weld County Treasurer in accordance with said standards. In addition, the Company shall make and deliver an item- ized statement showing the amounts of said collections. 4. Commissioners will remit in accordance with their accounting pro- cedure 33-1/3 % of all collections made by Company and 50% of tions made as a result of Company forwarding a delinquent tax another collection agency. Said payments shall be based upon all collec- account to the itemized account furnished the Treasurer as set forth herein. All parties hereto shall cooperate in any Court actions that need to be filed by Company in the collection of said accounts. The Company shall bear all expenses con- cerning Court costs or otherwise. 5. This Agreement may be terminated by either Company or Commissioners upon 90 days written notice and upon termination, the Company will return to Treasurer all lists provided by Treasurer and will remit to Treasurer all collections and Commissioners will remit back fees of Company as set forth in the above paragraph.
