Department of Human Services (WCDHS) policy regarding the Child Welfare
Grievance Process.

Brief description of the problem/issue: Senate Bill 23-210 was signed into law on May 24, 2023, that repeals
the use of Citizen Review Panels. Due to this, the Department is requesting to remove County Code, Chapter
10 - Social Services policy regarding Child Protection Citizen Review Panel Procedures and Conflict Resolution
Processes and add new WCDHS policy regarding the Child Welfare Grievance Process.
The removal from County Code and addition to DHS policy has been reviewed by involved Department staff and
reviewed/approved by Legal (Byron Howell). Both a redlined copy of County Code and clean copy of the new
DHS policy are attached for your reference.
What options exist for the Board?
• Approval to remove Chapter 10 of County Code and add new WCDHS policy regarding the Child Welfare
Grievance Process.
• Deny approval to remove Chapter 10 of County Code and add new WCDHS policy regarding the Child
Welfare Grievance Process.
Consequences: WCDHS will not have a correct policy regarding the Child Welfare grievance process.
Impacts: WCDHS will not be in compliance with Colorado Revised Statute 19-3-211

3. Testimony. At the request of -the complainant or the subject employee, the Citizen Review Panel may,
as part of its review, take informal testimony submitted voluntarily and without oath or fee by experts
or other individuals, including Department personnel. Such testimony is not subject to cross
examination or ob:ection by tie parties to tie grievance, but Citizen Review Panel members may ask
any pertinent questions o' witnesses wio appear. The Pane may a so request and receive information
from any other county or city and county that may be pertinent to the grievance. The Citizen Review
Panel may not receive any testimony unless the testimony is directly related to a grievance properly
referred.
4. Attendance. No persons other than members of the Citizen Review Panel, complainant, his or her
nonlega representative, sub'ec- ema oyee, nis or ier non ega representative and Acministrative
Liaison may attend the hearing. All other persons who are asked to testify may be present only while
giving testimony. No legal representatives of either the complainant or the subject employee may
attend the hearing.

CHAPTER 2 — CHILD WELFARE
ARTICLE I — GENERAL
Sec. 2.1.70. — Grievance Process.
A. Purpose
This policy outlines the process for the resolution of grievances filed against the county
department concerning the conduct of county department personnel in the pet formance of
their duties relating to children who may be neglected or dependent
B. Filing a grievance
All grievances must be submitted in writing and mailed to the Weld County Child Welfare
Director at the Weld County Department of Human Service, PO Box A, Greeley, CO 80632
The grievance shall include the complainant's full name and mailing address, applicable
case/assessment name and number (if known), a short but specific statement of the
complainant's grievance, and the resolution desired by the complainant
Once a grievance is received, the Child Welfare Director or designee has 35 days from the
receipt of the grievance to issue a written response to the complainant The Child Welfare
Director shall attempt to resolve any complaints informally If the grievance is not resolved
to the complainant's satisfaction, the complainant may file a grievance with

The original reviewer/approver on this was Byron Howell but Bruce has also reviewed/approved.
Actually, we want to remove Chapter 10 completely from County Code, it is no longer valid. The new policy that is
reflected on the last page is actually going to be added to our internal DHS Policy manual. Additions to our DHS Policies
no longer need to be on the BOCC agenda for approval or resolutions (Just approved via PA).
Does that make sense?
