Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services representative, Diana Aungst Department of Public Health and Environment representative, Lauren Light Planning and Zoning Development Review representative, Mike McRoberts Planning and Zoning Development Review representative, Dawn Anderson The following business was transacted: I hereby certify that pursuant to a notice dated April 17, 2024, and duly published April 19, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Tiriel and Brenda Bassett, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0007, for a Campground (up to three [3] spaces for tiny homes/RVs) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. fi Diana Aungst, Department of Planning Services, presented a brief summary of the proposal, described the sign posting and the location of the site. She relayed 18 referrals were sent out, 13 agencies responded without concerns or included conditions that have been addressed through Development Standards (DS) and Conditions of Approval (COA), and five (5) referral agencies did not respond. She stated the site will be known as B's Teeny Tiny Community, and consists of two parcels, Lot A and Lot B, with the applicants' residence located on Lot B. She explained guests on the site will be comprised mostly of traveling, working professionals, with a maximum capacity of six (6) people, will the time of stay not to exceed 180 days, or six (6) months, as defined in the Weld County Code. Ms. Aungst stated the existing driveway is surfaced with recycled asphalt and/or gravel, employees are family members, and all guests will be screened. She stated commercial vehicles will not be allowed on the site, and dog breed and weight will be restricted and enforced for guests with pets. She relayed the applicant is currently in violation, under CCV23-00191, initiated due to the presence of a tiny home parking on the site without the necessary Weld County Zoning and Building Permits; however, approval of this request will correct the violation. Ms. Aungst shared the site is located within the Coordinated Planning Agreement area of the City of Fort Lupton, and the Towns of Firestone, Mead, and Platteville, thus Notices of Inquiry (NOI) were sent but the responses expressed no annexation interests. She shared the site is also located within the Urban Growth Boundary and the three (3) mile referral area of the City of Fort Lupton and the Towns of Firestone, Mead, and Platteville, and the Town of Platteville's Comprehensive Plan is intended to encourage the sustainability of the regional agricultural and energy economy, discourage leap -frog development and ensure lands develop in a systematic and cost-conscious manner. She further relayed the site is located within the Town of Firestone's Urban Growth Boundary and is depicted on the Town's Master Plan map with a designation of Rural Low Density. She shared, per the Development Review staff, the site will be utilizing two (2) existing accesses onto County Road (CR) 21, which is a paved road and classified as a collector road, according to the Functional Classification Map. She relayed daily traffic counts indicate approximately 595 vehicles per day, with 12% trucks, and the 85th percentile speed is 60 MPH. She further stated the traffic information submitted indicates RV -sized tiny homes will be entering and exiting the site approximately four (4) to eight (8) times per year, with two (2) to four (4) passenger vehicle round trips, per day, per campground site. She stated a Road Maintenance Agreement including, but not limited to, dust control and damage repair to specified haul routes, and a Final Drainage Report with detention plan is required, and a Weld County Grading Permit will be required if disturbing more than one (1) acre. Ms. Aungst entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. In response to Chair Ross, Ms. Aungst confirmed the site will need to be graded to provide drives for the parking spaces of the tiny homes, and for vehicles to drive around the tiny homes, explaining a grading permit will likely be unnecessary. In response to Commissioner Freeman, Ms. Aungst explained working professionals will be the typical guest. Mike McRoberts, Planning Services - Development Review, explained a Road Maintenance Agreement is requested due to the possibility of rental to campers on a weekly or monthly basis, which would increase traffic. Lauren Light, Department of Public Health and Environment, stated the existing residence is served by the Central Weld County Water District, with a septic system permitted to service the two (2) existing residences. She explained the tiny homes will also be served by the Central Weld County Water District, and a new septic system will be installed; however, the application will need to be amended to include three (3) tiny homes. She stated the Department has included one (1) COA and five (5) DS to be adhered to, and there are no outstanding items with the request. In response to Commissioner James, Ms. Light explained an easement will be required if one of the lots is sold, and Ms. Aungst added the campground address will be utilized and lot spaces will be identified for emergency response vehicles, in the event of an emergency. Tiriel and Brenda Bassett, applicants, stated they have not previously communicated with any of the Commissioners regarding this request, narrated a PowerPoint presentation, and stated the bulk of the septic system will be on one lot. In response to Commissioner Saine, Mr. McRoberts explained the site does not currently qualify for Exception 12, Chapter 8-11-40-I, since recycled asphalt has an impervious value of 75 percent, whereas road base or gravel has an impervious value of 40 percent. Mr. Bassett stated they intend to remove the crushed asphalt and replace it with gravel or road base to increase the imperviousness, to allow for qualification of the exception. In response to Commissioner Saine, Mr. McRoberts stated the applicant could 2024-1458 PL2912 HEARING CERTIFICATION - TIRIEL AND BRENDA BASSETT (USR24-0007) PAGE 3 propose a variance request, and they are working with an Engineer to come up with a solution to meet an exception. Ms. Anderson explained, according to the Weld County Engineering and Construction Manual, criteria for an exception has to be submitted by the applicant. Ms. Bassett indicated they have reviewed the Conditions of Approval and Development Standards and requested an exception to the length of stay being limited to six months or 180 days, although Ms. McDougal explained a Temporary Use, as defined in the Weld County Code, Section 23-1-90, is not more than six (6) months. El The Board discussed the Conditions of Approval and Development Standards, striking COA #1.F (Road Maintenance Agreement) and DS #15 (Compliance with Road Maintenance Agreement). The Board agreed to both the aforementioned changes. In response to Chair Ross, Mr. and Ms. Bassett indicated they had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. Commissioner James moved to approve the request of Tiriel and Brenda Bassett for a Site Specific Development Plan and Use by Special Review Permit, USR24-0007, for a Campground (up to three [3] spaces for tiny homes/RVs) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Saine, and it carried unanimously.
