The Property cannot be occupied by any user that will use the improvements in the same manner the Property has been utilized in the past. Hampton Yard 10 Page 2 Petitioner contends the use of the Property is severely impaired as currently there is no allowable use Nor does Petitioner have the ability to resolve the issue regarding an allowable use in the foreseeable future Petitioner contends the existing improvements have no contributory value Background Petitioner acquired the Property in May 2022, as an investor, for the purpose of securing an income stream At the time of acquisition, Petitioner's intent was to lease the Property to a new tenant, utilizing the Property in the same manner as the Property had historically been utilized by the Seller, a light industrial use Once purchased, the Property was offered for lease The listing Broker placed a sign advertising the Property as available for lease and published marketing information Upon placing the Property on the market for lease, the City immediately contacted Petitioner, informing of the municipal use codes and that a site plan will be required due to a change in use Petitioner discovered the historic use cannot continue The historic use is not "grandfathered in " Petitioner has discussed the issue with the City of Dacono and City Council on multiple occasions The City's position is that all property owners included in the (1986) planned development of Wilmar Subdivision must agree to and submit an entirely new and acceptable development plan to the City for approval The City has indicated the historical use of the Property is no longer acceptable under the City of Dacono's approved plan Another property within the Wilmar Subdivision has had a similar experience In that instance, on May 23, 2022, the City of Dacono issued a Cease -and -Desist notice to that property owner within the Wilmar Subdivision The City demanded all uses not permitted under the Municipal Code of the City of Dacono cease within 90 days unless and until a site plan and industrial district use has been applied for subject to the SIA Resolution and the approval of the Planning Commission and City Council The city's action resulted in the tenants of that property vacating the premises The owner of that property has attempted to sell his property ever since The owner of that property has indicated there are no interested prospective buyers under the current circumstances with the City Petitioner has contacted the other landowners within Wilmar Subdivision Not all landowners within Wilmar Subdivision are agreeable to the creation of a new development plan If all the landowners within the Wilmar Subdivision become motivated to agree to create a new development plan, there will be costs, time spent, and risk involved to create a new development plan and go through the approval process successfully Petitioner has not found base period sales of other properties with similar impairments Petitioner has reviewed the Weld County Assessor's website for relevant vacant land sales information Two sales of a similar land size, shown in the Assessor's vacant land sale database are as follows Hampton Yard 10 Page 3 Vacant land sales from the Weld County Assessor website data RECEPTION ACCOUNT ACCOUNTS SALE TOT SALE NO NO I N SALE LAND TYPE SALE DATE SALE PRICE IMP SP/ SF COUNT 4742701 4773244 R0565901 1 R0911101 1 16.88 Vacant 7/30/21 $480,200 0 14.98 Vacant 11/3/21 $500,000 0 $0.65 $0.77 Petitioner contends the Property should be valued at no more than $.70 per square foot for the land. Abatement Request: The subject properties are represented by tax agent Brenda Fearn of Sterling Property Tax Specialists, Inc Brenda Fearn submitted 2 abatements for the 2023 tax year under a single cover letter These two properties were also appealed in 2024 resulting in a County Board of Equalization hearing on 10/14/2024. The CBOE denied in full the 2024 appeal for R7949099 and held the Assessor Value of $383,179 However, the appeal on R0277395 was denied in part and CBOE set the value at $1,106,821 at the recommendation of the Assessor due to a discovery that the permitted uses on the property changed. The result was a combined value of $1,490,000 for 2024 Analysis* The commercial team reviewed the appealed accounts for 2023 and the documents submitted by the petitioner The changes in permitted uses were in effect prior to January 1st, 2023 so the 2023 values should be synchronized with the 2024 values set by the CBOE The 2024 values were set based on the new permitted uses which resulted in a lower value after applying the market and income approaches to value. Reconciliation and Summary: The 2023 and 2024 appeals on these properties lead to the discovery that the permitted uses of the properties changed prior to January 1st, 2023. This change warranted a lower value for one of the parcels as determined by the market and income approaches to value, therefore, the CBOE lowered the value for tax year 2024.
