WEST OF AND ADJACENT TO LOT A OF RECORDED EXEMPTION, RECX15-0069 -
WELD COUNTY DEPARTMENT OF PLANNING SERVICES
A public hearing was conducted on December 11, 2024, at 10:00 a.m., with the following present:
Commissioner Kevin D. Ross, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Mike Freeman — EXCUSED

Commissioner Lori Saine

The following business was transacted:
El I hereby certify that pursuant to a notice dated November 27, 2024, a public hearing was
conducted to consider the request of the Weld County Department of Planning Services, for a
Resubdivision, RES24-0008, to vacate approximately 326 feet of right-of-way, described as the
northern portion of Cimarron Court, west of and adjacent to Lot A of Recorded Exemption,
RECX15-0069. Karin McDougal, Deputy County Attorney, made this a matter of record.
El Chair Ross reviewed the procedures to follow should this case result in a tie vote due to
four (4) Commissioners being present and Commissioner Freeman being excused.
Molly Wright, Department of Planning Services, presented a brief summary of the proposal,
described the location of the right-of-way, historical use of the portion of road, and the sign
posting. Ms. Wright displayed images of the site and surrounding views.
Elizabeth Relford, Department of Planning Services representative, narrated a PowerPoint
presentation (Exhibit B), relaying the history of the portion of property, and the purpose for the
request primarily for safety reasons. She relayed the Colorado Department of Transportation
(CDOT) deeded the property to Weld County, via a Quit Claim Deed, to complete Weld County
Way, maintaining access to O Street; however, the side -by -side lots created two separate
accesses next to each other. She stated Weld County Way is identified as a collector road, which
is a safer scenario for the access. She relayed a Lot Line Adjustment will be required, in addition
to this Resubdivision, to eliminate the access easement and resubdivide Lot B, which is this
request. She pointed out the new access for Cimarron Court.

In response to Commissioner Buck, Ms. Relford confirmed the residents in the subdivision
are aware of the change.
Ei No public testimony was offered concerning this matter.
fi The Board reviewed the Conditions of Approval (COA), and plat notes, and no changes or
corrections were made.
In response to Chair Ross, Ms. Relford indicated she had reviewed, and agreed to abide by,
the Conditions of Approval, as presented.
Commissioner James moved to approve the request of the Weld County Department of
Planning Services for a Resubdivision, RES24-0008, to vacate approximately 326 feet of
right-of-way, described as the northern portion of Cimarron Court, west of and adjacent to Lot A
of Recorded Exemption, RECX15-0069, based on the recommendations of Planning staff, with
the Conditions of Approval, as presented. The motion was seconded by Commissioner Buck, and
it carried four (4) to one (1), with Commissioner Freeman excused. There being no further
discussion, the hearing was completed at 10:13 a.m.
This Certification was approved on the 30th day of December, 2024.
