A public hearing was conducted on September 25, 2024, at 10:00 a.m., with the following present:

The following business was transacted:
hereby certify that pursuant to a notice dated August 13, 2024, and duly published
August 16, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request
of Scott Peterson, c/o SunShare Solar, LLC, dba Starlily Solar, LLC, for a Site Specific
Development Plan and Major Amended Use by Special Review Permit, 1MJUSR24-20-0011, for
a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural)
Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record.
IR Molly Wright, Department of Planning Services, stated the case was previously heard, before
the Planning Commission, on September 3, 2024, prior to the Planning Commission hearing, the
applicant had requested additional change to the solar panel layout. She relayed staff supported
the change as it further supports the compatibility of the area. She explained since Planning
Commission, the applicant has requested an additional change to the solar layout and the access
location, and an updated map was received on September 24, 2024, (Exhibit D); therefore, staff
requests this major amendment be referred back to staff for further review of the proposed
changes, as well as proper notification to the surrounding property owners (SPOs) who are
impacted by the requested changes.
No public testimony was offered regarding this request.

ie Commissioner Freeman moved to refer the case back to planning staff for re-evaluation of
the request. The motion was seconded by Commissioner James, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:03 a.m.
This Certification was approved on the 9th day of October, 2024.
