Re: Update on Grant Application for Competency Restoration Services

The Board approved our department to apply for grant funding from the State, through
Colorado Competency Solutions, to develop local programs aimed at assisting individuals
undergoing competency restoration as part of their criminal proceedings. This application was
also supported by the 19th Judicial District Courts, as well as the District Attorney and Public
Defender offices.
Unfortunately, I recently received notice from Colorado Competency Solutions that they have
decided to pause the review of all current proposals and will not be accepting any new
applications at this time. The State is improving its compliance with the timeframes for
admitting individuals to the State Hospital, resulting in fewer fines, and is now prioritizing its
financial commitments to already funded projects. They have assured me that if circumstances
change, they will reach out regarding our application.
This news is disappointing, especially considering the significant effort everyone dedicated to
the application. I have already informed the Court, District Attorney, and Public Defender
offices, and they all agree that the proposed programs would have significantly enhanced our
local services for this challenging population. For now, the application is on hold. I will maintain
contact with Colorado Competency Solutions, and should anything change, I will keep you
updated.

RESOLUTION
RE: APPROVE GRANT APPLICATION FOR COMPETENCY RESTORATION SUPPORT
SERVICES FOR PRERESTORE AND PRECONNECT PROGRAMS, AND AUTHORIZE
DEPARTMENT OF JUSTICE SERVICES TO SUBMIT ELECTRONICALLY -
COLORADO COMPETENCY SOLUTIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Grant Application for Competency
Restoration Support Services for the PreRestore and PreConnect Programs from the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Justice Services, to the Colorado Department of Justice Services,
Office of Civil and Forensic Mental Health, Colorado Fines Committee, and Colorado Competency
Solutions, commencing January 1, 2025, and ending December 31, 2025, with further terms and
conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Grant Application for Competency Restoration Support Services
for the PreRestore and PreConnect Programs from the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Justice Services, to the Colorado Department of Justice Services, Office of Civil and Forensic
Mental Health, Colorado Fines Committee, and Colorado Competency Solutions, be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Doug Erler, Director of the
Department of Justice Services, be, and hereby is, authorized to electronically submit said
application.
