RE: APPROVE AMENDMENT #1 TO TASK ORDER CONTRACT FOR TUBERCULOSIS
PREVENTION AND CONTROL PROGRAM, AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment #1 to the Task Order
Contract for the Tuberculosis Prevention and Control Program between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Public Health and Environment, and the Colorado Department of Public Health
and Environment, commencing July 1, 2023, and ending June 30, 2025, with further terms and
conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Amendment #1 to the Task Order Contract for the Tuberculosis Prevention
and Control Program between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Public Health and
Environment, and the Colorado Department of Public Health and Environment, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of June, A.D., 2024, nunc pro tunc July 1, 2023.

Brief description of the problem/issue:
For the Board's review and approval for placement on the agenda is a contract amendment between the
Colorado Department of Public Health and Environment (CDPHE) and the Weld County Board of County
Commissioners on behalf of the Weld County Department of Public Health and Environment (WCDPHE).
This contract amendment # 1 is for the continuation of the Tuberculosis (TB) Prevention and Control program
in Weld County. The term for this amendment is from July 1, 2024, to June 30, 2023, and the contract provides
up to $46,000 in funding for TB programs, all of which is State funding. The TB program has seen a 100%
increase in confirmed and suspect TB cases over the past 3 years.
What options exist for the Board?
With the approval of the Board, this contract amendment allows for continued funding for TB prevention and
control activities in Weld County. These activities include testing, diagnostic services, case and contract
investigation and monitoring, treatment for latent and active TB, and providing education and outreach
regarding TB prevention and control.
If the Board declines approving this contract amendment, the WCDPHE will not receive external funding to
provide the public health core service of TB prevention and control in Weld County. These services would then
become 100% county funded.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): TB prevention and control are core
public health functions conducted exclusively by our department for our community. The total expenses for
this program are anticipated to be $334,690 in FY25. The total anticipated revenue is $178,555 to include this
grant and medical insurance reimbursement.
Recommendation: I recommend approval to place this contract on a future Board agenda for formal action.

1. PARTIES
This Amendment (the "Amendment") to the Original Contract shown on the Signature and Cover
Page for this Amendment (the "Contract") is entered into by and between the Contractor, and the
State.
2. TERMINOLOGY
Except as specifically modified by this Amendment, all terms used in this Amendment that are
defined in the Contract shall be construed and interpreted in accordance with the Contract.
3. AMENDMENT EFFECTIVE DATE AND TERM
A. Amendment Effective Date
This Amendment shall not be valid or enforceable until the Amendment Effective Date
shown under the State Controller Signature. The State shall not be bound by any provision of
this Amendment before that Amendment Effective Date, and shall have no obligation to pay
Contractor for any Work performed or expense incurred under this Amendment either before
or after the Amendment term shown in §3.B of this Amendment.
B. Amendment Term
The Parties' respective performances under this Amendment and the changes to the Contract
contained herein shall commence on the Amendment Effective Date shown under the State
Controller Signature or July 1, 2024, whichever is later, and shall terminate on the
termination of the Contract or June 30, 2025, whichever is earlier.
4. PURPOSE
The Parties entered into the agreement to provide diagnostic, patient education and treatment
services for individuals with suspected/known latent TB infection (LTBI) and those classified
with Class A and Class B TB status or who are suspected of having active TB. Also for
individuals who are identified as newly arrived refugees, asylees and other high risk persons with
LTBI.
The Parties now desire to renew for an additional term and change the current Contract
Maximum Total following reason: to renew for an additional term.
5. MODIFICATIONS
The Contract and all prior amendments thereto, if any, are modified as follows:
A. The Contract Maximum Amount table is deleted and replaced with the Current Contract
Maximum Amount table shown on the Cover Page for this Amendment.
B. The Contract Initial Contract Expiration Date on the Contract's Signature and Cover Page
is hereby deleted and replaced with the Current Contract Expiration Date shown on the
Signature and Cover Page for this Amendment.
C. The Parties now agree to modify Exhibit B — Statement of Work of the agreement. Exhibit
B — Statement of Work is deleted and replaced in its entirety with Exhibit B- Statement of

6. LIMITS OF EFFECT AND ORDER OF PRECEDENCE
This Amendment is incorporated by reference into the Contract, and the Contract and all prior
amendments or other modifications to the Contract, if any, remain in full force and effect except
as specifically modified in this Amendment. Except for the Special Provisions contained in the
Contract, in the event of any conflict, inconsistency, variance, or contradiction between the
provisions of this Amendment and any of the provisions of the Contract or any prior modification
to the Contract, the provisions of this Amendment shall in all respects supersede, govern, and
control. The provisions of this Amendment shall only supersede, govern, and control over the
Special Provisions contained in the Contract to the extent that this Amendment specifically
modifies those Special Provisions.

STATEMENT OF WORK

These provisions are to be read and interpreted in conjunction with the provisions of the contract specified
above.
I.
Entity Name: Weld County Department of Public Health and Environment
II. Project Description: This project serves to implement a Tuberculosis (TB) program to diagnose,
treat and prevent the spread of TB in the community. TB is spread from person to person through
the air, can affect the lungs or other parts of the body, and can cause serious illness or death. TB
remains the primary infectious disease killer in the world. The Colorado Department of Public
Health and Environment (CDPHE) is funded by state general fund dollars and the Centers for
Disease Control and Prevention (CDC) to reduce the impact of TB on individuals and
communities in CO. The Division of Disease Control and Public Health Response (DCPHR) also
supports TB health service activities as a part of the mandatory Class A and B medical testing
process for Refugees and Immigrants entering the United States. This project seeks to reduce TB
in CO by ensuring access to TB screening, testing, treatment and preventive services for those at
elevated risk for TB. The project also seeks to ensure that patients with active TB disease can
complete treatment. To support TB treatment completion, the project will utilize incentives and
enablers to aid patients with treatment adherence. Incentives may include gift cards for food to
support nutrition and reduce medication -related side effects. Enablers include support for
transportation or access to a smart phone to facilitate directly observed therapy as required by CO
statute for people with pulmonary TB. The project will collect vital statistics, and enable the
technological capability needed to evaluate and manage patients with confirmed or suspected TB.
The program seeks to reduce TB in CO by funding TB programs to evaluate and treat people at
highest risk for TB infection and disease including close contacts to patients with pulmonary TB.
Key program goals are to connect at -risk individuals including Refugees born in endemic areas to
appropriate medical care, control epidemiologic outbreaks, and protect the health of the residents
of Colorado.
III. Definitions and Abbreviations:
1. AFB - acid -fast bacilli smear; a rapid test used to detect infectious mycobacteria
2. Asylee — individuals who, on their own, travel to the United States and subsequently apply for and
receive a grant of asylum.
3. CDC — Centers for Disease Control and Prevention
4. CDPHE — Colorado Department of Public Health and Environment
5. Class A — All applicants who have tuberculosis disease. This also includes applicants with
extrapulmonary tuberculosis who have a chest x-ray suggestive of pulmonary tuberculosis disease,
regardless of sputum smear and culture results. These applicants are not cleared for travel until
completion of treatment unless a waiver is granted.
6. Class B1 TB, Pulmonary — Applicants who have signs or symptoms, physical exam, or chest x-ray
findings suggestive of tuberculosis disease, or have known HIV infection, but have negative AFB
sputum smears and cultures and are not diagnosed with tuberculosis disease. This classification
also includes applicants who were diagnosed with tuberculosis disease by the panel physician,
refused DOT treatment, and are returning after treatment and completion of 1 -year wait. If all

parts of the examination are complete, travel clearance is valid for 3 months from the date final
cultures are reported as negative.
7. Class B1 TB, Extrapulmonary - Applicants diagnosed with extrapulmonary tuberculosis with a
normal chest x-ray and negative sputum smears and cultures. Travel clearance is valid for 3
months from the date final cultures are reported as negative.
8. Class B2 TB, LTBI Evaluation — Applicants who have a positive IGRA or TST but otherwise have
a negative evaluation for tuberculosis. The IGRA result or size of the TST reaction, the applicant's
status with respect to LTBI treatment, and the medication(s) used must be documented. For
applicants who had more than one IGRA or TST, all dates and results and whether the applicant's
IGRA or TST converted must be documented. Contacts with a positive IGRA or TST ≥5 mm must
receive this classification in addition to a Class B3, Contact Evaluation classification (if they are
not already Class BO TB, Pulmonary, B1 TB, Pulmonary, B1 TB, Extrapulmonary, or Class A
TB). Travel clearance is valid for 6 months from the time the evaluation is complete.
9. DOT — Directly Observed Therapy
10. HIV— Human Immunodeficiency Virus
11. IGRA — interferon gamma (y) release assay (whole blood TB test)
12. LEP — limited English proficiency ( (OPI) provider only)
13. LTBI — Latent Tuberculosis Infection
14. OPI — over -the -phone interpretation
15. Refugee — any person who is outside his or her country of nationality or habitual residence and is
unable or unwilling to return to or seek protection of that country due to a well-founded fear of
persecution based on race, religion, nationality, membership in a particular social group, or
political opinion.

IV. Work Plan:
Goal #1: Prevent and control TB infection and active TB disease throughout the Contractor's jurisdiction.
Objective #1: No later than the expiration date of the contract, support Tuberculosis prevention and control activities
throughout the agency's jurisdiction.
Primary Activity #1
The Contractor shall evaluate and treat all patients with suspected or confirmed TB.
Sub -Activities #1
1. The Contractor shall provide, or arrange for, chest x-rays and interpretations for
individuals with suspected or confirmed TB.
2. The Contractor shall provide interpretations for individuals with suspected or confirmed
TB, as necessary.
3. The Contractor shall collect specimens for mycobacteriology testing on all persons
suspected of having TB.
4. The Contractor shall arrange for the transportation of the specimens to the state lab for
testing.
5. The Contractor shall arrange for the placement of patients who require isolation.
a. The Contractor shall contact CDPHE TB Program for assistance.
b. The Contractor shall contact CDPHE to request reimbursement from CDPHE for
those costs incurred by the Contractor in isolating a patient.
6. The Contractor shall provide, or arrange for, the treatment of patients with suspected or
confirmed active TB, including DOT.
7. The Contractor shall ensure adherence and completion of TB treatment, using incentives
and enablers as needed to achieve this.
8. The Contractor shall record 95% of all HIV testing result rates among suspect and confirmed
cases of active TB disease, and enter that information into the CDPHE TBdb.
9. The Contractor shall offer an HIV antibody test to 100% of persons diagnosed with active
TB disease.
a. The Contractor shall provide an HIV antibody test for those clients with a test result

rate >95%, regardless of their age or the apparent absence of risk factors for HIV
infection.
10. A minimum of once a month, the Contractor shall monitor and evaluate those persons on
treatment for suspected or confirmed active TB disease, via in -person assessment by a qualified
nurse or registered clinician.

Primary Activity #2
The Contractor shall ensure that all contacts to newly identified infectious TB cases are
identified and evaluated.
Sub -Activities #2
1. The Contractor shall perform a focused history, symptom review and, TB testing as
indicated for confirmed contacts to patients with pulmonary TB.
2. The Contractor shall provide, or arrange for, chest x-rays and interpretations for contacts
who have newly identified TB infection or symptoms of active TB.
3. The Contractor shall provide, or arrange for, the treatment of contacts who are diagnosed
with TB infection.
4. The Contractor shall provide, or arrange for, an HIV antibody test for all persons with TB
infection and risk factors for HIV or who originate from an area where HIV is endemic.
5. The Contractor shall inform all individuals who refuse testing of the risks associated with
HIV/TB co -infection.
6. The Contractor shall monitor persons with TB infection during treatment, and evaluate
anyone who develops symptoms of medication -related toxicity.
7. The Contractor shall ask all TB clients about current health insurance enrollment and
offered materials to become insured if not currently insured.
8. The contractor shall use incentives and enablers to address barriers to evaluation or
treatment. Some examples but not a complete list of incentives and enablers include gift
cards for groceries, mobile phone support, and transportation to and from clinic.
9. The Contractor shall submit preliminary and final information to the CDPHE TB Program
electronically for each contact investigation. An example of the data to be collected is
available at the following link, Tuberculosis Contact Investigation Record.
Primary Activity #3
The Contractor shall provide or arrange for the TB evaluation of newly arrived refugees,
asylees, and other eligible individuals with a Class B TB designation.
Sub -Activities #3
1. A minimum of thirty (30) calendar days of the Contractor's receipt of written notification
from CDPHE of the arrival of a Class B immigrant or refugee, the Contactor shall provide,
or arrange for, a TB screening that may include medical evaluation, IGRA, chest
radiograph, and sputum specimens for AFB smear and culture if indicated.
2. Upon completion of testing and examination, the Contractor shall complete, sign, and date
the CDC 75.17 form or Class B Tuberculosis Follow Up worksheet, and return it within
ninety (90) days to:

The Contractor shall identify, investigate, and evaluate persons with a high risk of LTBI which
include close contacts to pulmonary TB patients and Class B designates.
Sub -Activities #4
1. The Contractor shall offer an HIV antibody test to 100% of persons with LTBI and
provide, or arrange for, HIV antibody test with a test result rate >80%.
a. The Contractor shall record 80% of all HIV antibody testing result rates for
LBTI patients into the CDPHE TBdb.
2. A minimum of once a month, the Contractor shall monitor and evaluate persons with LTBI
during treatment for all such patients.

The Contractor shall provide clients printed resource and referral materials that direct them to
the nearest community Medicaid and Connect for Health Colorado enrollment location(s),
including online enrollment options.
The Contractor shall discuss current health insurance enrollment status with each client for the
purposes of becoming insured if not currently insured.

1. The content of electronic documents located on CDPHE and non-CDPHE websites and
information contained on CDPHE and non-CDPHE websites may be updated periodically
during the purchase order term. The Contractor shall monitor documents and website
2. content for updates and comply with all updates. The Contractor shall complete the
appropriate treatment as stated in the CDPHE TB Manual. The CDPHE TB Manual is
available on the State of Colorado website
https://www.colorado.gov/pacific/cdphe/colorado-tb-manual and is incorporated and made
part of this Contract by reference.
3. CDPHE will provide templates and instructions for any additional information requests.
Report forms are subject to revision and the Contractor agrees to use the most recent
version.
4. The Contractor shall make efforts to increase the percentage of persons that complete
LTBI treatment and maintain or improve on that rate thereafter.
5. The Contractor shall share data of suspected or confirmed active TB disease results, and
include the following information in the state TB database or similar electronic health
record:
a. reason for initiating
b. patient name
Standards and
c. date of birth
Requirements
d. country of birth
e. date arrived in U.S.
f. demographic information
g. locating information
h. provider information
i. TB risk factors
j. results of diagnostic testing
k. results of mycobacteriology including susceptibility results

6. For those persons identified with active TB, the Contractor shall report to CDPHE:
a. patient name

7. The Contractor shall complete tests including the following:
a. smears for acid -fast bacilli, (using concentrated fluorescent method)
b. isolation of mycobacteria (using rapid methods)
c. identification of Mycobacterium Tuberculosis complex (MTB) (using rapid
methods)
d. susceptibility testing (isoniazid, rifampin, ethambutol, and pyrazinamide) on
isolates of MTB.
8. The Contractor shall obtain and document an HIV testing result for 95% of suspect and
confirmed cases of active TB disease, and enter that information into the Contractor's
electronic medical record before TB treatment begins, and no later than the end date of this
contract.
8. The Contractor shall obtain and document an HIV testing result for 80% of all LBTI
patients in the Contractor's electronic medical record no later than the end date of this
contract.
9. The Contractor shall provide culturally appropriate patient education and information
pertaining to TB treatment and the follow-up plan.
10. The Contractor shall provide services in patient's preferred language using medical
interpretation resource.
11. The Contractor shall complete 100% of all RVCT fields no later than the end date of this
contract.
12. The Contractor shall discuss current health insurance enrollment and offered materials
with the client for the purposes of becoming insured if not currently insured.
a. The Contractor shall ask all TB clients about current health insurance enrollment
including Medicaid, and offer resource materials no later than the last business
day of each month.
13. The Contractor shall provide or arrange for treatment and ensure completion of therapy.
14. The Contractor shall provide a final report via email or CDPHE TBdb to the TB
Program's Data Coordinator when a contact investigation is completed.
15. The Contractor shall provide all other necessary laboratory testing and medical
evaluation services to identify TB.
16. The Contractor shall report information as requested by CDPHE via a secure web -based TB
case/contact management system (CDPHE TB database or the Contractor's electronic
medical record)
17. For confirmed cases of TB, the Contractor shall include all data elements identified in
the "Report of Verified Case of Tuberculosis (RVCT)", which is incorporated herein by
this reference, made a part of this contract and is available at the following link:
RVCT and is incorporated and made part of this contract by reference.
18. The Contractor shall provide CDPHE with the medical insurance information for those
patients who have medical insurance.
19. The Contractor shall provide consultation services, as needed, to providers in its
service area regarding TB reporting, screening, treatment, and follow-up.
20. The Contractor shall provide printed resource, referral and Medicaid and Connect for
Health Colorado enrollment materials for clients with Limited English Proficiency
(LEP).
a. Contractors that routinely offer enrollment services on -site are exempt from this
requirement because the services provided go beyond this minimum requirement.
21. The Contractor shall use LEP, Over -the -Phone Interpretation (OPI) to communicate
with clients.
a. The Contractor shall provide a monthly reimbursement DOT/Diagnostic
invoice according to the following criteria:
i. The monthly DOT/Diagnostic invoice must be provided
with supporting documentation confirming use is TB -related.

ii. The Contractor shall request monthly DOT/Diagnostic reimbursement no
later than the last business day of the month following the invoicing month.
22. The Contractor shall complete the Semi -Annual Progress Report per the following
criteria:
a. The Semi -Annual Progress Reports must cover July -December and January -
June.
b. The Contractor shall complete the Semi -Annual Progress Report using the

Expected Results of the
Activity
1. New TB cases shall be diagnosed, documented and treated.
2. Patients with existing or newly diagnosed TB or LTBI shall be treated, as appropriate.
3. Newly arrived refugees, asylees, and other eligible individuals with Class B
designation receive treatment.
4. In order to facilitate and improve client access and enrollment in health insurance,

V. Monitoring:
CDPHE's monitoring of this contract for compliance with performance requirements will be conducted
throughout the contract period by the CDPHE Contract Monitor. Methods used will include a review of
documentation determined by CDPHE to be reflective of performance to include progress reports Methods
used for contract monitoring will include review of documentation reflective of performance to include:
invoices, evidence of data entered by the contractor into an automated statewide system statewide TBdb
database, timeliness and quality of recommendations provided. The Contractor's performance will be
evaluated at set intervals and communicated to the contractor. A Final Contractor Performance Evaluation
will be conducted at the end of the life of the contract.

The Contractor will be notified in writing within 15 calendar days of discovery of a compliance issue.
Within 30 calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to
determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be
completed. The action(s) and time line for completion will be documented in writing and agreed to by both
parties. If extenuating circumstances arise that requires an extension to the time line, the Contractor must
email a request to the CDPHE Contract Monitor and receive approval fora new due date. The State will
oversee the completion/implementation of the action(s) to ensure time lines are met and the issue(s) is
resolved. If the Contractor demonstrates inaction or disregard for the agreed upon compliance resolution
plan, the State may exercise its rights under the provisions of this contract.
