HomeMy WebLinkAbout20240900.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, APRIL 17, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 17, 2024, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair — EXCUSED Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of April 3, 2024, as printed, Commissioner James moved to approve. Commissioner Freeman seconded the motion and it carried unanimously. le CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on April 3, 2024, as follows: 1) USR23-0039 — Public Service Company of Colorado, an Xcel Energy Company. Commissioner James seconded the motion. Upon a roll call vote of three (3) to one (1), the motion carried, with Commissioner Saine recused. AMENDMENTS TO AGENDA: There were no amendments to the Agenda. CONSENT AGENDA: There being no public testimony concerning Partial Vacation, VAC24-0002, of Two -Lot Recorded Exemption, RECX17-0213, for Removal of Lot B — Reginia Alter, Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. fa PROCLAMATIONS: 1) NATIONAL CRIME VICTIMS' RIGHTS WEEK - APRIL 21-27, 2024: Chair Pro-Tem Buck read the proclamation for the record. Michael Rourke, 19th Judicial District Attorney, expressed his gratitude for the recognition by the Board, stated it has been an honor highlighting those who serve the victims' adovcate community, and further noted that Weld County is fortunate to have access to amazing partner organizations serving victims. Mr. Rourke shared victims are often are at their lowest point in life and face Minutes, Wednesday, April 17, 2024 Page 1 2024-0900 BC0016 navigating the criminal justice system, emphasizing the importance of victim advocates. Mr. Rourke recognized the following representatives who were present: City of Greeley Police Department Law Enforcement Victim Services, Weld County 19th Judicial District Administrive Office, Lutheran Family Services, Town of Frederick Police Department Law Enforcement Victims Assistance, Catholic Charities, Weld County Department of Human Services, A Woman's Place, Lifestories Child and Family Advocacy Center, and the Weld County 19th Judicial District Attorney's Office. Lastly, he invited the Board to the annual Victims' Rights Event scheduled for Friday, April 19, 2024, located at the Riverside Library and Cultural Center in Evans, Colorado, beginning at 8:30 a.m. The Commissioners, in turn, thanked Mr. Rourke for his efforts for restorative justice in the community and expressed their pride in the longstanding services provided by Weld County agencies that advocate on behalf of victims. Mr. Rourke further recognized the agencies who were not present: SAVA (Sexual Assault Victim Advocate) Center, Intervention, Weld County Sheriff's Office, Probation Victim Services, City of Brighton Police Department Law Enforcement Victim Advocates, Town of Erie Police Department Law Enforcement Victim Advocates, and Colorado Legal Services. (Clerk's Note: The group gathered for a photo opportunity.) El WARRANTS: 1) GENERAL WARRANTS - APRIL 16, 2024: Commissioner James moved to approve the General Warrants, as printed. Commissioner Freeman seconded the motion and it carried unanimously. BIDS: 1) PRESENT BID #62400066, INFOBLOX MAINTENANCE AND SUPPORT — DEPARTMENT OF INFORMATION TECHNOLOGY: Toby Taylor, Purchasing Department, stated five (5) bids were received and staff will make a recommendation on May 1, 2024. • 2) PRESENT BID #62400067, CISCO MAINTENANCE AND SUPPORT — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Taylor stated three (3) bids were received and staff will make a recommendation on May 1, 2024. • 3) PRESENT BID #62400074, CLASS 6 AGGREGATE BASE SUPPLY - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor stated four (4) bids were received and staff will make a recommendation on May 1,2024. fi NEW BUSINESS: 1) CONSIDER STANDARD FORM OF AGREEMENT FOR RECREATIONAL/EDUCATION SERVICES FOR COLORADO WORKS SUMMER ACTIVITIES PROGRAM, PROVIDER LIST, RATES, AND RELEASE OF LIABILITY AND AGREEMENT TO HOLD HARMLESS AND INDEMNIFY, BETWEEN DEPARTMENT OF HUMAN SERVICES AND VARIOUS PROVIDERS, AND AUTHORIZE CHAIR TO SIGN AGREEMENTS CONSISTENT WITH SAID FORM: Jamie Ulrich, Director of the Department of Human Services, stated the program is offered annually every summer and is funded through the Temporary Aid for Needy Families (TANF) Program to provide eligible youth with a voucher to participate in summer activities. Commissioner Freeman moved to approve said standard form agreement, list, rates, and authorize the Chair to sign agreements consistent with said form. Seconded by Commissioner James, the motion carried unanimously. • 2) CONSIDER CONTRACT ID #7995 EXPENDITURE AUTHORIZATION AND WORK PLAN FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) PROGRAM FUNDS FOR WAGNER PEYSER 10% GOVERNOR SUMMER JOB HUNT PROGRAM, AND AUTHORIZE CHAIR PRO-TEM TO SIGN ELECTRONICALLY: Ms. Ulrich stated the Governor Summer Job Hunt Program is also a great opportunity for youth during the summer because it provides staff support in workforce centers to serve Minutes, Wednesday, April 17, 2024 Page 2 2024-0900 BC0016 youth who are seeking job opportunities. She noted this program is grant funded through the Colorado Department of Labor and Employment. Commissioner Saine moved to approve said said expenditure authorization and workplan, and authorize the Chair Pro-Tem to sign electronically. The motion was seconded by Commissioner James and it carried unanimously. IE 3) CONSIDER CONTRACT ID #7996 EXPENDITURE AUTHORIZATION AND WORK PLAN FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) PROGRAM FUNDS FOR FOREIGN LABOR CERTIFICATION (FLC) GRANT, AND AUTHORIZE CHAIR PRO-TEM TO SIGN ELECTRONICALLY: Ms. Ulrich stated the expenditure authorization provides funding to assist employers in the agricultural industry to fill temporary and seasonal positions, and she noted this program is grant funded through the Colorado Department of Labor and Employment. In response to Commissioner Saine, Ms. Ulrich confirmed each individual has proper work authorization. Commissioner James moved to approve said expenditure authorization and workplan, and authorize the Chair Pro-Tem to sign electronically. The motion was seconded by Commissioner Freeman and it carried unanimously. 4) CONSIDER CONTRACT ID #8005 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR PRO-TEM TO SIGN - ANDREA SINDEN: Ms. Ulrich stated the contract is for a new certified foster care home located in Loveland, Colorado. Commissioner Freeman moved to approve said contract and authorize the Chair Pro-Tem to sign. Seconded by Commissioner James, the motion carried unanimously. El 5) CONSIDER CONTRACT ID #8004 SCOPE OF SERVICES FOR GALLUP ACCESS (WORKPLACE SURVEY SUBSCRIPTION BASIC) AND AUTHORIZE CHAIR PRO-TEM TO SIGN AND SUBMIT ELECTRONICALLY - GALLUP, INC.: Jason Chessher, Director of the Department of Public Health and Environment, stated the scope of services is for one (1) year and provides access to metrics generated by the anonymous employee engagement survey platform for those employed at the Weld County Department of Public Health and Environment, for the amount of $3,000.00, which will be grant funded. Commissioner Saine discussed her concerns with the potential conflicting information obtained from this platform and from the Qualtrics platform that is currently utilized county -wide. Commissioner Freeman moved to approve said scope of services and authorize the Chair Pro-Tem to sign and submit electronically. The motion was seconded by Commissioner James. Upon a roll call vote, the motion passed three (3) to one (1), with Commissioner Saine opposed. El 6) CONSIDER CONTRACT ID #8008 MEMORANDUM OF UNDERSTANDING FOR RESIST PEER MENTORING PROGRAM, A WELDWAITS AFTERSCHOOL MENTORING PROGRAM, AND AUTHORIZE CHAIR PRO-TEM TO SIGN - WELD COUNTY SCHOOL DISTRICT 6: Mr. Chessher stated the Memorandum of Understanding (MOU) acts as a facilities use agreement with School District 6 for a resiliency program designed for students transitioning from elementary school to middle school. Commissioner James moved to approve said MOU and authorize the Chair Pro-Tem to sign. Commissioner Freeman seconded the motion and it carried unanimously. 7) CONSIDER ESTABLISHING NEIGHBORHOOD TO BE SERVED, DESIGNATE COMMISSIONER TO MAKE ON -SITE INSPECTION, AND SET HEARING DATE CONCERNING APPLICATION FOR HOTEL AND RESTAURANT (COUNTY) LIQUOR LICENSE - RIGO'S MEXICAN RESTAURANT, LLC, DBA RIGO'S MEXICAN RESTAURANT: Karin McDougal, Deputy County Attorney, stated the Resolution is regarding a new liquor license application from Rigo's Mexican Restaurant, LLC, located at 711 "O" Street, Greeley, Colorado. She further stated the purpose of the Resolution is to establish the neighborhood to be served, which is indicated by the legal description in the Resolution, designate Commissioner Freeman to inspect the premises, and set a hearing date for Minutes, Wednesday, April 17, 2024 Page 3 2024-0900 BC0016 May 20, 2024, at 9:00 a.m., to consider the liquor license application. Commissioner Freeman moved to approve the Resolution. The motion was seconded by Commissioner James and it carried unanimously. N1 PUBLIC COMMENT: No public comment was offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:24 a.m. These Minutes were approved on the 1st day of May, 2024.
