RENTAL CONTRACT
This agreement made this 4th day of November 19.1L4, The Potato Growers Co-op-
erative Company, Eaton, Colorado, (hereinafter called Company)

Whereas, the Patron is now purchasing or contemplates purchasing petroleum
products from Company for use upon premises of said Patron at Ault city
and state of Colorado and has requested the Company to furnish and install on
said premisecertain equipment for more safer and economical storage and handling
of said petroleum products.
Now therefore in consideration of premises and the sunroof $ lxp paid to the
Company by said patron, the receipt of which is hereby acknowledged, it is agreed
as follows:
1. The Company hereby agrees to furnish the patron the following equipment for
storing and handling the petroleum products purchased by said Patron from the
Company, To -Wit: 1 Erie Electric Pump with fittings. Pump # Erie 843
2. The Company hereby grants to said patron the right to use the equipment above
described so installed upon said patrons premises, upon following terms and
conditions.
A. Said equipment shall be used by patron for sole purpose of storing and
handling petroleum products purchased from the above named Company only.
B. Said Patron at his own cost and expense agrees to maintain equipment in
good condition so long as he shall continue to use the same.
C. Said Patron shall pay any and all ad -valorem taxes that may he assessed
against said eouipment.
D. :";aid equipment is and shall remain property of the company.
E. Patron shall keep eouipment clear of all encumbrances and will not
remove said equipment from premises, nor sell, transfer, encumber, or
in any manner dispose of same or attempt so to do durin€ the existence
of this rental contract.
F. If the Patron at anytime used said eouipment for any other purpose than
set forth in 2 (A) hereinabove or ceases for 6n days to purchase
substantial amount of his requirements of petroleum products from
Company, or if said patron violates any other of the above mentioned
Conditions, the company shall have the right without notice to enter
upon the premises of patron with men, trucks, and such other appliances
as may be necessary to take away and remove said equipment, without
recourse to any legal proceedings for that purpose.
3. The Patron agrees to accept said equipment and take possession thereof under
terms hereof and does further agree for himself, his heirs, executives,
administrators, to exonerate and save harmless, protect the indemnity of the
Company from any and all loss, damage, claims, suits, or action at law or
otherwise, judgements and costs lehich shall arise or grow out of any injury to
persons or property caused or resulting from leakage or explosion from said
tank or equipment whether caused by improper construction or negligence of
either party, or otherwise.
L, This agreement shall continue for a period of one year from its date and there-
after, subject to the ric,ht of either party, with or without cause upon ten-day
notice (written) to the other party and upon such cancellation the Company
shall remove said equipment from said premises.
5. Upon the termination of this agreement by whatever means affected the Company
shall have the right to enter upon said premises and remove said equipment,
doing whatever necessary for that purpose provided however, that at any time
prior to the beg._:ming of the removal of said equipment from said premises, the
Patron may purchase said equipment by paying cash to the Company the value
thereof, which is hereby fixed and agreed to be "a 175.0
