C/O KERR-MCGEE OIL AND GAS ONSHORE, LP
A public hearing was conducted on February 21, 2024, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 21, 2023, and duly published
December 27, 2023, in the Greeley Tribune, a public hearing was scheduled for February 7, 2024,
to consider the request of Cervi Enterprises, Inc., do Kerr-McGee Oil and Gas Onshore, LP, for
a Site Specific Development Plan and Use by Special Review Permit, USR23-0040, for a 190 -foot
Telecommunication Antenna Tower in the A (Agricultural) Zone District. On January 16, 2024, the
Weld County Offices were closed due to inclement weather conditions and the scheduled
Planning Commission hearings were rescheduled to later dates; therefore, an updated notice
dated January 18, 2024, and duly published January 20, 2024, in the Greeley Tribune,
rescheduled this matter to February 14, 2024, at 10:00 a.m., to allow the case to be heard by the
Planning Commission on February 6, 2024; however, when the case was originally heard on
February 7, 2024, the Board continued the case to February 21, 2024, at the request of the
applicant, to allow the matter to be heard by a full quorum of the Board, thus the hearing for
February 14, 2024, was cancelled. Karin McDougal, Deputy County Attorney, made this a matter
of record.
�----' Chair Ross reviewed the procedures to follow should this case result in a tie vote due to
four (4) Commissioners being present and Commissioner Freeman being excused. In response
to Chair Ross, Matt Wells, on behalf of the applicant, indicated he has not had any direct
conversations with any Commissioners regarding this case.
El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal,
described the site location, and relayed 13 referrals were sent out, eight (8) were received back,
three (3) with comments, and five (5) without comments. He described the existing, permitted

access onto U.S. Highway 34, utilizing unmaintained right-of-way for County Road (CR) 69, and
relayed the traffic information indicates there will be 20 round trips per day, during construction,
operation traffic will be as needed, annually. He stated the applicant submitted a Drainage Report,
which included an Accepted Exception to Stormwater Detention and historic drainage flows will
be maintained. Mr. Gathman explained the proposed tower will support operations of the Bronco
Comprehensive Development Plan, to be operated by Kerr-McGee Oil and Gas, and there will be
no full-time, on -site employees. He described the surrounding properties and their uses, stated
the existing telecommunication tower, constructed in 1991, cannot accommodate the proposed
equipment plan, thus, the proposed tower will communicate with surrounding towers. Mr.
Gathman entered the favorable recommendation of the Planning Commission into the record, as
written, and displayed images of the site and surrounding views.
El Lauren Light, Department of Public Health and Environment, stated portable toilets may be
utilized during construction.
Mr. Wells, complimented staff for their summary of the application, and narrated a slide show
presentation (Exhibit E).
El In response to an inquiry from Edwin Grant, Greeley resident, Chair Ross confirmed the
location is off U.S. Highway 34.
In response to Chair Ross, Mr. Wells indicated he had reviewed, and agreed to abide by, the
Conditions of Approval and Development Standards, as presented.
_! The Board reviewed the Conditions of Approval and Development Standards, and no
changes or corrections were made.
Ei Commissioner Saine moved to approve the request of Cervi Enterprises, Inc.,
do Kerr-McGee Oil and Gas Onshore, LP, for a Site Specific Development Plan and Use by
Special Review Permit, USR23-0040, for a 190 -foot Telecommunication Antenna Tower in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards, as presented. The
motion was seconded by Commissioner Buck, and it carried unanimously. There being no further
discussion, the hearing was completed at 11:40 a.m.
