Until I hear from Chief Beach, I have the following recommendations. The facility will require to have an Emergency Response Plan (ERP), I did see a draft plan and we can work with this template. The main concern I have is with the BESS Units on site. I would like to make sure the Fire department is provided the proper training to deal with a hazmat emergency call for these types of units. Can you please let us know your view and feedback on this? - Fire Dept Response: Juniper trees don't pose a fire hazard if alive. • Horus Question: What are your major concerns that we should integrate into the planning and development process for the projects? Fire Dept Response: We are not familiar with utility -scale solar projects, so I will need to enquire with other fire districts (ie near Fort Lupton) to understand better their experience and potential concerns with utility -scale solar projects to answer this question. Based on experience, weeds and mitigation is a big concern for us. • Horus Question: There is a water well onsite, and therefore we are planning on utilising it by having a water tank to be used for panel cleaning but also to be used by the Fire Department in case of emergencies. What are your thoughts? Fire Dept Response: A water tank on the projects site which can be used by the Fire District in the area would be very helpful. Horus should determine how much water is needed for the projects and then work out as much there is left available for the Fire Department to use based on the size of the tank. Also the Fire Department shall be allowed to enter at any time using a knox box key to open the gates (ie with a code and without the need of having material keys). Also the project layout must respect the Fire code spacing regulations to allow enough space for fire trucks to turn. • Horus Question: What are next steps? - Fire Dept Response: please send me a dwg and pdf layout of the projects and the Dust & Weed mitigation plan, so that we can review and provide comments. • Horus sent the requested information on July 14th 2023 and October 11th 2023 and no response was received to date. 1 Southeast Weld Conservation District P.O. Here are our comments, which apply to both USR2024-0012 and USR2024-0013: • The Tri-State switching station will need to be larger than 2 acres. We typically require 10 to 15 acres for a switching station. • Tri-State has concerns with the proposed Project schedule. Operation of the facility is proposed for Summer of 2026, but execution of a LGIA, procurement of switches and other materials, and 1041 permitting for a switching station will not be feasible by 2026. • Item 19 of the Questionnaire addendum states that Tri-State will permit, operate, and build a short 0.1 -mile long overhead 230kV gen-tie line. Tri-State will not build the developer's gen-tie line. We would build the lines to connect our switching station to our existing line, but the line to connect the generation facility to the last span outside our switching station would be permitted and built by the developer. Please let me know if you have any questions. Thanks, Steve H. Do not click links or open attachments unless you recognize the sender and know the content is safe. Hi Melissa, CDOT's comments on the Prospect and Janus Solar Facility TIS are as follows: 1) The study mentions construction traffic is anticipated to be in the year 2024. How long is the construction phase intended to last? More than a year? 2) The study needs to identify which access points along CO 79 warrant the need for a new access permit both temporarily and for the long term per the State Highway Access Code. This includes the site direct access and each WCR intersection intended to be used by the solar facility. If any access point is intended to be improved either temporarily or for the long term and if traffic is increasing by 20% or more either temporarily or for the long term, a new access permit is required for that access/intersection along the highway. 3) The study should also reference whether or not any auxiliary lane improvements are warranted per the State Highway Access Code in the long term. This analysis should be based on the site generated and background traffic counts in the area. If no warrants are met per the SHAC, then the study needs to say so. 4) A CDOT Access Permit is definitely required for the direct access point from CO 79 to the site. The applicant will need to apply and be sure the property owner is signing the application and that proof of ownership (i.e. copy of the deed) is included. The Prospect Solar garden will be located east of Hwy 79 and between Weld County Road 4 and 6 on either side of CR 73 (TIN, R62W Sec. 30 a T1 N, R63W Sections 25, 26, 34 and 35), on existing agricultural lands. They are located approximately 13 miles SE of the town of Hudson. Colorado Parks and Wildlife has previously commented on this project on May 17, 2023, and sent the letter directly to the consultant West, Inc. The mission of CPW is to perpetuate the wildlife resources of the state, to provide a quality state parks system, and to provide enjoyable and sustainable outdoor recreation opportunities that educate and inspire current and future generations to serve as active stewards of Colorado's natural resources. CPW has a statutory responsibility to manage all wildlife species in Colorado and promote various recreational opportunities throughout Colorado. One way we achieve this goal is by responding to referral comment requests. CPW appreciates the early consultation from Horus Capital, West Inc. and Weld County because it can lead to a responsibly developed project that works toward achieving state solar goats while protecting sensitive wildlife species, habitats, and time frames. We Jeff Davis, Director, Colorado Parks and Wildlife Parks and Wildlife Commission: Dallas May, Chair • Richard Reading, Vice -Chair • Karen Bailey, Secretary • Jessica Beaulieu Marie Haskett • Jack Murphy • Gabriel Otero • Duke Phillips, IV • James Jay Tutchton • Eden Vardy recognize renewable energy development is important to meeting the State's greenhouse gas reduction goats and improving our climate resiliency. CPW appreciates that the developer included our previous recommendations in their proposed project and that the project was planned outside of High Priority Habitat. The recommendations that were included in the Environmental Conservation Measures document that CPW approves included: • Nest surveys for raptors and other migratory birds, as well as wildlife surveys for Swift fox dens. Appropriate buffers and timing stipulations will be followed. • The solar facility will be checked weekly, either remotely or in person (or escape structures are installed inside the fenced area), to allow animals to escape if they become trapped within the facility. They will report mortalities, trapped or injured wildlife, or other reportable incidents to the local District Wildlife Manager (Erin Priest 970-939-1214). They plan to document and report these findings to CPW annually for three years. • Minimize fencing to the maximum extent practicable, and use wildlife -friendly fencing. • Design of the project to discourage the use of perching or nesting substrates by birds including on structures like transmission lines, substation and switchyard components and in compliance with the standards described in Avian Powerline Interaction Committee (APLIC) documents: APLIC 2006 and APLIC 2012. • A weed mitigation plan, erosion control and plans to restore disturbed habitats and hasten the recovery of natural habitats. • Educate/instruct all employees, contractors, and site visitors to avoid harassment and disturbance of wildlife, especially during reproductive (e.g., courtship and nesting) seasons. • Deep structure foundation holes and trenches will not be left open overnight and will be covered. • Inclusion of a minimum 250 ft wide north -south wildlife movement corridor along Sand Creek. Dear Ms. Brunner, Thank you for the opportunity for Colorado Parks and Wildlife (CPW) to comment on Horus Capital's proposed Prospect Solar Project (Solar Project). This proposed photovoltaic Solar Project is located approximately 12 miles northeast of Denver International Airport, and about 12 miles southeast of the Town of Hudson. It is our understanding that this Solar Project would be at most 2,098 acres to produce upwards of 260 megawatts of alternating current (MWac), and is currently slated to begin construction in 1Q 2025 with a Commercial Operation Date (COD) by 3Q 2026. CPW also understands that there will be a new collector substation, a switchyard, and approximately 1,000 feet of new above -ground transmission lines to tie to the adjacent existing infrastructure. CPW appreciates that Horus Capital and Western EcoSystems Technologies (WEST) have initiated early consultation with CPW because it can lead to a responsibly -developed project that works toward achieving state solar goals1 while protecting sensitive wildlife species, habitats, and time frames. We recognize renewable energy development is important to meeting the State's greenhouse gas reduction goals and improving our climate resiliency. The mission of CPW is to perpetuate the wildlife resources of the state, to provide a quality state parks system, and to provide enjoyable and sustainable outdoor recreation opportunities that educate and inspire current and future generations to serve as active stewards of Colorado's natural resources. CPW has a statutory responsibility to manage all wildlife species in Colorado; as such, we encourage protection for Colorado's wildlife species and habitats through responsible energy development and land use planning. One way we achieve this goal is by responding to referral comment requests, as is the case for this project. CPW encourages developers to afford the highest level of protection to Colorado's High Priority Habitats (HPHs)2. 1 https://energyoffice.colorado.gov/climate-energy/ghg-pollution-reduction-roadmap 2 https://cpw.state.co.us/Documents/Conservation-Resources/Energy-Mining/CPW HPH-Map-Layers.pdf Jeff Davis, Director, Colorado Parks and Wildlife Parks and Wildlife Commission: Carrie Besnette Hauser, Chair • Dallas May, Vice -Chair • Marie Haskett, Secretary • Taishya Adams Karen Bailey • Betsy Blecha • Gabriel Otero • Duke Phillips, IV • Richard Reading • James Jay Tutchton • Eden Vardy Horus Capital's Prospect Solar Project — CPW Comments (5/17/23) Page 2 of 4 HPHs are defined as sensitive wildlife habitats where CPW has sound spatial data3 and scientifically -backed best management practice recommendations to help developers with the siting process to minimize any impacts. RECOMMENDATIONS FOR THIS PROJECT CPW appreciates that this Solar Project is sited entirely outside of mapped HPHs, though this Project is bisected by the north -flowing Sand Creek and West Sand Creek. Therefore, CPW encourages the following recommendations for this Solar Project to avoid and minimize their impact on this and other likely occurring wildlife species: • Big Game Movement Corridors O Although this Solar Project is outside of any mapped HPHs and the two creeks have a very minimal riparian corridor, the biggest impact from this Solar Project will be the loss of open space and the fragmentation of existing and accessible big game habitats. Therefore, CPW appreciates our recent conversations that focused on incorporating at least one north -south movement corridor along the creeks in the final site plans by using creative siting solutions without compromising MWs. Note, 250 feet should be considered the bare minimum width, and the longer the proposed corridor, the wider the corridor should be. ■ Furthermore, corridor entrances should not be 90 -degree angles, but more of an inviting funnel, as shown below in the right image. • Pre -construction Nesting Surveys O Please complete pre -construction nesting bird surveys in the disturbance areas (panels, layout yards, access roads, transmission lines, etc.) for the following species and send us the results prior to construction: ■ Burrowing Owls' (if prairie dog towns are present) between March 15 to August 31. ■ Tree and ground -nesting raptors5 - if construction begins between December 1 to July 15 (depending on the species observed). ■ Migratory songbirds - if construction begins between April 1 to August 31. 3 https://www.arcgis.com/home/item .html?id=190573c5aba643a0bc053e6f7f0510b7 4 https://cpw.state.co.us/Documents/WildlifeSpecies/LivingWithWildlife/Recommended-Survey-Protocol-Burrowing-Owls.pdf 5 https://cpw.state.co.us/Documents/WildlifeSpecies/LivingWithWildlife/Raptor-Buffer-Guidelines.pdf Horus Capital's Prospect Solar Project — CPW Comments (5/17/23) Page 3 of 4 • Fencing O Minimize fencing to the maximum extent practicable, and use wildlife -friendly fencing6 as much as possible. O For specific wildlife exclusion fencing specifications around the Solar Project, CPW recommends that any installed fencing should be eight feet in height, have round -capped posts (e.g., so wildlife isn't impaled), smooth top wire to the fence (e.g., no top barbed wire) (or if two top strands are needed, ensure they are at least six inches apart). The bottom wire can be barbed but should be four inches or less from the ground. O Also, CPW recommends that other non -security fencing in the immediate vicinity is removed to the extent practicable and with landowner consent. O CPW recommends that the solar facility is checked weekly (or escape structures are installed inside the fenced area) to allow deer to escape if one becomes trapped within the facility. • General habitat recommendations O Avoid development near mapped streams and wetlands. O Develop a noxious weed management plan prior to construction and regularly implement it so noxious weeds do not spread to adjacent habitats. O Please use CPW's restoration seed mix for mule deer HPH (with landowner permission) (we can email it to you separately if desired). O CPW requests that security lighting is kept to a minimum, and ideally, motion sensor lights are installed. CPW appreciates the opportunity to review this project and provide comments and recommendations to avoid and minimize impacts on wildlife resources. Do not click links or open attachments unless you recognize the sender and know the content is safe. Dear Diana Aungst We have reviewed the June 11, 2024 above -referenced proposal for a Site Specific Development Plan and Use by Special Review Permit for a 1041 Major Facility of a Public Agency, USR24-0013, including a 199 megawatt AC Solar Energy Facility on 1500 acres, a 100 megawatt AC Battery Energy Storage System, a step-up substation, transformer and maintenance facilities, and a 230kV interconnecting transmission line to connect to a new TriState Switching Station. This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. Estimates on the water demands for this project were not provided. A copy of well permit no. 322682 was included in the referral material. This permit was approved pursuant to CRS 37-90-105 for a well on a tract of land of 160 acres described as the SW1 /4 of Section 24, Township 1 North, Section 63 West of the Sixth P.M., Weld County. Water from this well may be used for domestic purposes inside 2 single family dwellings, and the watering of 4 of the owner's own large non-commercial domestic animals (per single family dwelling), irrigation of 2,000 square -feet of lawn and garden and the watering of livestock on range and pasture. As permitted this well cannot be used for the proposed solar facility, unless the well is re -permitted to operate pursuant to a Determination of Water Rights and a Replacement Plan to be approved by the Groundwater Commission. The submittal indicates that stormwater detention structure(s) may be constructed as a part of this project. The Applicant should be aware that unless the structure can meet the requirements of a "storm water detention and infiltration facility" as defined in Designated Basin Rule 5.11, the structure may be subject to administration by this office. The Applicant should review Rule 5.11 to determine whether the structure meets the requirements of the Rule and ensure any notification requirement is met.
