HomeMy WebLinkAbout20240460.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, FEBRUARY 26, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, February 26, 2024, at the hour of 9:00 a.m. CA ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of February 12, 2024, as printed, Commissioner Saine moved to approve. Commissioner Buck seconded the motion and it carried unanimously. El READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinance #2024-01 by audio. The motion was seconded by Commissioner Buck, and it carried unanimously. _= AMENDMENTS TO AGENDA: There were no amendments to the Agenda. % CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion and it carried unanimously. PROCLAMATIONS: 1) ROOSEVELT ROUGHRIDERS' DAY, CLASS 4A STATE CHAMPIONSHIP FOR CO-ED CHEERLEADING - FEBRUARY 26, 2024: Chair Ross read the proclamation for the record. Haley Sanchez, senior, thanked the Board for their recognition and stated she and the team were proud to represent Weld County at the state competition. In response to Chair Ross, the team and coaches introduced themselves for the record. Each commissioner, in turn, congratulated the team for their excellence and encouraged the team to remember the feeling of their accomplishment, as well as the hard work, and the sacrifice it takes to be a champion. Cassidy Almgren, senior, and Madeline Sansone, junior, thanked the Board for the opportunity to be recognized and stated this is one (1) of the best years they have experienced and are grateful for the hard work of their teammates and for their parents, coaches, and community who helped lead them to success. In response to Chair Ross, the team and coaches introduced themselves for the record. Each Commissioner, in turn, expressed their pride in having so many elite athletes representing Weld County at state, congratulated the team on their third consecutive year earning the state championship, and thanked the parents and communities supporting the team. (Clerk's Note: The group gathered fora photo opportunity.) El WARRANTS: 1) GENERAL WARRANTS - FEBRUARY 23, 2024: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. El 2) COMMISSIONER WARRANTS (KEVIN D. ROSS) - FEBRUARY 23, 2024: Commissioner James moved to approve the Warrant, as printed. Commissioner Buck seconded the motion, and upon a roll call vote of four (4) to zero (0), the motion carried, with Commissioner Ross recused. El BIDS: 1) APPROVE BID #62400007, SUV SMALL 4 DOOR 4X4 OR AWD (QTY 1) - DEPARTMENT OF FLEET SERVICES AND 19TH JUDICIAL DISTRICT ATTORNEY'S OFFICE: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Johnsons Auto Plaza, for a total amount of $29,105.00. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner Buck, and it carried unanimously. NEW BUSINESS: 1) CONSIDER CONTRACT ID #7838 INTERGOVERNMENTAL AGREEMENT FOR RESURFACING OF EAST 168TH AVE AND AUTHORIZE CHAIR TO SIGN - ADAMS COUNTY: Joshua Holbrook, Department of Public Works, explained the County entered into a Memorandum of Understanding (MOU) with Adams County, in 2014, for shared maintenance costs, including those defined as major construction projects. He cited two (2) areas that have been identified for resurfacing and indicated that Adams County will provide the advertising and construction administration, and Weld County will contribute $1,474,275.14. Commissioner James moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Saine, and it carried unanimously. 2) CONSIDER TEMPORARY CLOSURE OF CR 13 BETWEEN CR 50 AND SH 60: Amy Mutchie, Department of Public Works, presented on behalf of Connell Resources, who is the contractor for the Town of Johnstown, for a closure to begin on March 4, 2024, and go through March 25, 2024, for the installation of a 36 -inch steel casing for a 24 -inch sanitary sewer main. She explained the reason for open cutting is due to a fiber optic line which services the Towns of Johnstown, Milliken, and Mead, and would shut down those areas if the line were to be compromised. Ms. Mutchie indicated the detour route is paved. Commissioner Freeman moved to approve said temporary closure. The motion was seconded by Commissioner James, and it carried unanimously. 3) CONSIDER TEMPORARY CLOSURE OF CR 72 BETWEEN CRS 29 AND 31: Ms. Mutchie presented on behalf of Connell Resources and North Weld County Water District, for a closure to begin on March 4, 2024, and go through March 11, 2024, for the installation of a 48 -inch casing pipe for a new 30 -inch water main for the North Weld County Water District. She stated the detour route is paved and Minutes, Monday, February 26, 2024 Page 2 2024-0460 BC0016 installation needs to be complete before farming operations begin this spring. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner James, and it carried unanimously. 4) CONSIDER DECLARATION OF CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Cheryl Pattelli, Chief Financial Officer, referenced the listed equipment (Exhibit A), and recommended approval for sale at auction. Commissioner Freeman moved to approve said declaration of certain equipment as surplus property, approve sale at auction, and authorize the Controller to sign any necessary documents. The motion was seconded by Commissioner James, and it carried unanimously. El 5) FIRST READING OF CODE ORDINANCE #2024-01, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS OF THE WELD COUNTY CODE (APPENDIX 8-0 - FUNCTIONAL CLASSIFICATION MAP): Commissioner Freeman moved to continue Code Ordinance #2024-01, to March 25, 2024, at 9:00 a.m. Chair Ross concurred that continuing the First Reading is the best course of action. The motion was seconded by Commissioner James. After discussion, Evan Pinkham, Department of Planning Services, confirmed the general idea for the Functional Classification Map is for future growth and traffic, and stated this is nothing which would immediately affect property owners. Chair Ross acknowledged the request to provide proper notification to residents clarifying their scope of work. In response to Chair Ross indicating he will be absent on March 25, 2024, Commissioners Freeman and James amended their motions to continue Code Ordinance #2024-01, to March 27, 2024, at 9:00 a.m. to allow fora full quorum of the Board to be present. There being no further discussion, the motion carried unanimously. El PUBLIC COMMENT: There was no public comment offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2024-01 was approved on First Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
