Home My WebLink About20242596.tiffRESOLUTION RE: APPROVE AMENDMENT #1 TO AGREEMENT FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) CHIEF ELECTED OFFICIAL AND ONE -STOP OPERATOR, AND AUTHORIZE CHAIR, DEPARTMENT OF HUMAN SERVICES, AND WORKFORCE DEVELOPMENT BOARD TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Amendment #1 to the Agreement for the Workforce Innovation and Opportunity Act (WIOA) Chief Elected Official and One -Stop Operator between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Workforce Development Board, and the Colorado Department of Labor and Employment, commencing July 1, 2024, and ending June 30, 2025, with further terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Amendment #1 to the Agreement for the Workforce Innovation and Opportunity Act (WIOA) Chief Elected Official and One -Stop Operator between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Workforce Development Board, and the Colorado Department of Labor and Employment, be, and hereby is, approved. ESWC was selected, through an open competitive bid process, to be the local One -Stop Operator for the Weld County Regional Planning Area, with the Board of County Commissioners acting as the Chief Elected Official. The agreement between the Weld County Workforce Development Board (WCWDB), ESWC and the Chief Elected Official, known as Tyler ID# 2017- 2712, outlines roles and responsibilities between parties while demonstrating compliance with the Workforce Innovation and Opportunity Act (WIOA) of 2014. The current agreement is in perpetuity and after a review by the State of Colorado, they are now requesting that an end be added. As a result, the Department is requesting approval to amend the current contract to add an expiration date of June 30, 2025. What options exist for the Board? • Approval of the WCWDB, Chief Elected Official, and the One -Stop Operator Agreement Amendment #1. • Deny approval of the WCWDB, Chief Elected Official, and the One -Stop Operator Agreement Amendment #1. Consequences: Employment Services of Weld County, acting as the One -Stop Operator, will not have an end date for the current agreement. Impacts: Employment Services of Weld County, acting as the One -Stop Operator, will be out of compliance with the Colorado Department of Labor and Employment. Select or re -certify the one -stop operator through utilization of the Weld County Procurement Process. The selection will be made through a competitive bid process every four (4) years. 2. Paragraph IV., D., ESWC's Responsibilities as the One -Stop Operator to the WCWDB, and the Governing Board, is hereby amended as follows: 5. Outreach a. Promote the services of the America's Job Center, including development of outreach materials and management of the Workforce Development Center's Facebook, Linkedln and other digital media pages with the support and under the direction of the Weld County Department of Human Services and the Governing Board. 3. Paragraph VIII., Terms of Agreement, is hereby amended as follows: This Agreement becomes effective upon signature by the Governing Board and WCWDB and shall stay in effect until June 30, 2025; or until such time as: 1) parties act to rescind the Agreement; 2) federal or state authority ceases for the local implementation of job training programs; or 3) either party who wishes to rescind the Agreement provides written notice of the desired rescission at lease thirty (30) days prior to the conclusion of the fiscal year, whereupon the effective date of the rescission would then be the close of that fiscal year. • All other terms and conditions of the Original Agreement remain unchanged.
