Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Deputy County Attorney, Karin McDougal Department of Planning Services representative, Diana Aungst The following business was transacted: ='' I hereby certify that pursuant to a notice dated November 14, 2024, and duly published November 17, 2024, in the Greeley Tribune, a public hearing was conducted on January 17, 2024, to consider the request of Sharp Trust, for a Site Specific Development Plan and Rural Land Division Final Plan, RLDF23-0002, for the Creation of Three (3) Lots in the A (Agricultural) Zone District. At said hearing the Board continued the matter to April 24, 2024, to allow the applicant, staff and the Board adequate time to review Code and legal options. On April 24, 2024, the Board continued the matter to May 22, 2024, to allow staff and the Board additional time to review Code options. Karin McDougal, Deputy County Attorney, made this a matter of record. = Diana Aungst, Department of Planning Services, provided the history of the case and stated on April 24, 2024, the Board gave staff direction to review Code language related to RLDFs, and in turn, staff proposed Code Ordinance #2024-08, which added language to allow for omittance of the requirement of an internal road, if certain criteria had been met. She relayed the Ordinance had gone through two readings, with the final reading scheduled soon. Commissioner Freeman suggested a Condition of Approval (COA) that the RLDF not be recorded until after the final reading of the Code Ordinance #2024-08. =." Donovan Sharp, applicant, stated he had nothing to add. No public testimony was offered concerning this matter. Ms. Aungst presented language for a new COA #1.A, regarding the timing of recording the RLDF plat and the Board agreed to the change, and Commissioner James expressed support for approving the application with the new COA. In response to Commissioner Saine, Ms. Aungst CG; pL C ER/MWoftivi KR/kw) .7/30/24 2024-0091 PL0529 HEARING CERTIFICATION - SHARP TRUST (RLDF23-0002) PAGE 2 clarified the displayed map, which showed an internal road, was created prior to the Code Ordinance, and confirmed the application meets the criteria to not have an internal road. In response to Chair Ross, Mr. Sharp indicated he had reviewed, and agreed to abide by, the Conditions of Approval, as amended. Ms. McDougal explained if Code Ordinance #2024-08 did not pass on the final reading, Mr. Sharp would be unable to satisfy the condition and would have to come back before the Board to seek approval of the original application, and Mr. Sharp agreed. Commissioner Freeman clarified the language of the proposed changes and asserted it is applicable for specific circumstances. Ms. Aungst agreed and outlined the criteria that would have to be met. Commissioner James moved to approve the request of Sharp Trust for a Site Specific Development Plan and Rural Land Division Final Plan, RLDF23-0002, for the Creation of Three (3) Lots in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 10:20 a.m. This Certification was approved on the 5th day of June, 2024.
