The proposal has been reviewed on behalf of the Weld County Department of Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and Use by Special Review Permit for Open Mining (sand, gravel and stone) and processing of minerals, employee and equipment associated with operations parking, outside of subdivisions and historic townsites, in the A (Agricultural) Zone District. This project is north of and adjacent to CR 48.5 and is west of and adjacent to State Highway 257. Parcel numbers: 105903000027, 095734000030, 105903000045. Access onto CR 48.5. ACCESS Development Review has reviewed the application materials related to access. The application materials request that the access is onto CR 48.5 approximately 1,900 feet west of the intersection of CR 48.5 and State Highway 257. The applicant shall obtain an access permit for a location that meets the Minimum Access Spacing Criteria. Additionally, CDOT requires an access permit for the traffic that will use SH 257. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways. Please contact Mr. Tim Bilobran at the Greeley office (970-350-2163). Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access location with Development Review prior to laying out your site plan. All "preliminarily approved" accesses are subject to change during the access permitting process. Minimum access spacing widths and safe sight distances are shown in Weld County Code Chapter 8. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHTS -OF -WAY AND BRIDGES CR 48.5 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. The eastern 1.5 -mile portion of this road is maintained by Weld County. The property is bounded by State Highway 257. Contact the Colorado Department of Transportation (CDOT) to determine what right-of-way shall be shown on the submitted plat. Reference the documents creating the right-of-way. Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/publicworks/permits/. Per Sec 8-15-20 et seq, a Weld County Transport Permit is required for Extra -legal vehicles using Weld County roadways to ensure the operation and movement of Extra -legal Vehicles and Loads occur in a safe and efficient manner. Applicants can be found at: https://www.weld.gov/Government/Departments/Public-Works/Permits . Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC A Traffic Impact Study, stamped and signed by a professional engineer licensed in the State of Colorado was submitted. The Study identified two potential haul routes: • CR 48.5 west to CR 17, north to CR 54, west to CR 13, and south to Loveland Ready -Mix Concrete processing plant. OR • CR 48.5 east to SH 257, north to CR 54, west to CR 13, and south to Loveland Ready -Mix Concrete processing plant. Recent traffic counts (2020) on the County's portion of CR 48.5 counted 210 (AADT) vehicles per day with 17% trucks. The 85th percentile speed is 54 miles per hour. Recent traffic counts (2021) on this portion of CR 17 counted 4,552 (AADT) vehicles per day with 7% trucks. The 85th percentile speed is 54 miles per hour. Recent traffic counts (2019) on this portion of CR 54 counted 5,876 (AADT) vehicles per day with 12% trucks. The 85th percentile speed is 59 miles per hour. Recent traffic counts on this portion of SH 257 counted 10,100 vehicles per day. The proposed haul route to the west on CR 48.5 involves the intersection of CR 48.5 and CR 17. Approximately 0.5 miles of CR 48.5 and the southern portion of the intersection of CR 48.5 and CR 17 are in the Town of Johnstown. Additionally, 60 feet to the east of the centerline of CR 17 is the Great Western Railroad. The residential nature of this area is a concern and would be addressed by the referral request to the Town of Johnstown. The configuration of the intersection of CR 48.5 and CR 17 does not meet the safety criteria as specified in Chapter 8 of the Code. Specifically, the location of the railroad track does not allow for the needed auxiliary lanes that would be required for the proposed haul traffic from this mine; the queuing of trucks at this intersection would be adversely impacted by the proximity of the railroad track; the intersection has numerous utilities that would need relocated; and the intersection sight distance does not appear to be adequate for turning haul trucks. Development Review is not recommending the use of this haul route. Per CDOT's referral, the proposed haul route to the east on CR 48.5 would involve the upgrade of the intersection of SH 257 (i.e. southbound deceleration and north bound acceleration lanes) and CR 48.5 prior to the issuance of the CDOT access permit onto SH 257 and the triggered upgrade of the intersection of CR 54 and SH 257 in the future. Development Review is recommending the use of this haul route. TRACKING CONTROL Tracking control is required to prevent tracking from the site onto public roadways. For access to paved roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways. A variance request for alternatives to the tracking control requirement can be submitted to Development Review for review and consideration. This site requires double cattle guards and 100 ft. of asphalt or 300 ft. of asphalt. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UP -FRONT IMPROVEMENTS Development Review is requesting an Improvements and Road Maintenance Agreement for dust control, damage repairs to specified haul routes, triggered off -site improvements and up -front off -site improvements. Consideration may be given to proportional sharing of cost for these improvements. Based on the haul route recommended by Development Review, these improvements may include but are not limited to: • Paving CR 48.5 from the site access east through the intersection with SH 257; • The addition of auxiliary lanes (i.e. acceleration lane to the north and deceleration lane to the south) at the intersection of CR 48.5 and SH 257; • Triggered auxiliary lanes at the intersection of SH 257 and CR 54; and, • A proportional share of the improvements to the intersection of CR 54 and CR 13 that may include dedicated right-of-way. In the case that right-of-way is dedicated, the applicant may consider a Capital Contribution Front End Agreement. See Weld County Code Sec, 20-1-90 for more information. Improvements/Road Maintenance Agreement: An example agreement is available on the Weld County/Development Review website. It will detail the approved haul route, outline the required up -front off -site improvements, designate when other off -site improvements will be triggered, and include a maintenance agreement for the haul route. DRAINAGE REQUIREMENTS This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. Drainage Narrative: The applicant has submitted a preliminary drainage narrative. A final drainage narrative citing an acceptable drainage detention exception, from Sec 8-11-40 of the Code, with adequate documentation shall be submitted. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. If more than 1 acre is to be disturbed for construction of non -gravel pit items such as structures, parking lots, laydown yards etc, a Weld County grading permit will be required prior to the start of construction. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Development Review for more information. CONDITIONS OF APPROVAL A. An Improvements and Road Maintenance Agreement is required for upfront and triggered off -site improvements at this location. The improvements include but are not limited to: • Paving CR 48.5 from the site access east through the intersection with SH 257; • The addition of auxiliary lanes (i.e. acceleration lane to the north and deceleration lane to the south) at the intersection of CR 48.5 and SH 257; • Triggered auxiliary lanes at the intersection of SH 257 and CR 54; and, • A proportional share of the improvements to the intersection of CR 54 and CR 13 may include dedicated right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Development Review) 2. Show the Colorado Department of Transportation (CDOT) right-of-way for Hwy 257 on the plat along with the documents creating the right-of-way. (Development Review) 3. Show and label the access location onto CR 48.5, approved access width, and the appropriate turning radii on the site plan. Specify the access type. (Development Review) 4. Show and label the required tracking control. (Development Review) 5. Show and label the entrance gate if applicable. An access approach that is gated shall be designed so that the longest vehicle (including trailers) using the access can completely clear the traveled way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface be less than 35 feet. (Development Review) 6. Show and label the drainage flow arrows. (Development Review) 7. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. (Development Review) 3. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. (Development Review) 4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. (Development Review) 5. Prior to the release of building permits, the applicant shall be required to submit a complete access application for a "preliminarily approved" access location as shown on this plat. In addition to CR 48.5, the haul route also includes CR 17 that is a paved arterial roadway per the Weld County Functional Classification map, CR 50 that is a paved collector roadway per the Weld County Classification Map, and CR 13 (also known as Colorado Blvd) that is a paved arterial roadway per the Weld County Classification Map. The proposed haul route includes four bridge crossings: one on CR 48.5 (Thompson and Platte Ditch), two on CR 50 (Little Thompson Annex and Unnamed), and one on CR 13 (Hollsboro Ditch). The property is bounded by State Highway 257. Contact the Colorado Department of Transportation (CDOT) to determine what right-of-way shall be shown on the submitted plat. (LRM) received the letter dated July 22, 2022, from Melissa J King of Weld County Department of Public Works and the Department of Planning and Zoning. This letter serves as LRM's response to Department of Planning Public Works and the Department of Planning and Zoning's comments and recommendations. The County's comments are provided in italics, followed by LRM's response. LR111 Response The proposed access onto CR 48.5, approximately 1,305 feet west of the intersection of CR 48.5 and SH 257, is proposed and not existing. LRM is not requesting use of the existing access for mining. LRM submitted an access permit application to Weld County on September 8, 2021. LRM then submitted additional photos of the proposed access location on September 23, 2021, per the request of Weld County. LRM then submitted a new figure with a 65' turning radii on December 16, 2021, per the request of Weld County. The email correspondence is attached to this letter as Attachment 1. On September 13, 2022, Telesto/LRM asked for a revision to reflect a 28' wide drive instead of a 14' wide drive. It is our understanding that Weld County cannot issue the access permit until the USR application was submitted by LRM. The proposed access meets the minimum access spacing criteria in Weld County Code Sec. 8-14-30. Roads and Rights -of -Way and Bridges Comment CR 48.5 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right- of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. The eastern 1.5 -mile portion of this road is maintained by Weld County. LRM Response LRM has a recent ALTA survey that verifies CR 48.5 has a 60' ROW dedication, as shown in the extraction plan map. The Plan drawing has been amended to include the reception numbers for dedication documents. Comment The western 0.5 -mile portion of County Road 48.5 is under the jurisdiction of the Town of Johnstown. This portion is paved. The municipality has jurisdiction over use of the road. Please contact the municipality to verify any additional requirements that may be needed. The proposed haul route includes four bridge crossings: one on CR 48.5 (Thompson and Platte Ditch), two on CR 50 (Little Thompson Annex and Unnamed), and one on CR 13 (Hillsboro Ditch). Hwy 257 is not included has a truck haul route but may be used by the 6 employees. LRM Response The exiting 100' ROW shown on the USR map is from LRM's recent ALTA survey. As of September 2, 2022, Tim Bilobran of CDOT has requested a ROW of 75 feet from the centerline of SH257, which has been added to the USR map (Attachment 2). Note that this 75' ROW request encroaches on the Town of Milliken's easement. We acknowledge that Hwy 287 is not included as a truck haul route but may be used by the 6 employees. Comment Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. Traffic Comment Recent traffic counts (2020) on the County's portion of CR 48.5 counted 210 (AADT) vehicles per day with 17% trucks. The 85th percentile speed is 54 miles per hour. Recent traffic counts (2021) on this portion of CR 17 counted 4,552 (AADT) vehicles per day with 7% trucks. The 85th percentile speed is 54 miles per hour. Recent traffic counts (2021) on this portion of CR 50 counted 3,085 (AADT) vehicles per day with 10% trucks. The 85th percentile speed is 59 miles per hour. Recent traffic counts (2020) on this portion of CR13 counted 2,667 (AADT) vehicles per day with 22% trucks. The 85th percentile speed is 59 miles per hour. A preliminary Traffic Impact Study was submitted with the application. A final Traffic Impact Study, stamped and signed by a professional engineer licensed in the State of Colorado shall be submitted. LRM Response The County's comment is noted. The TIS is being modified to include the new proposed haul route utilizing WCR 17 and WCR 54, as discussed in a meeting with the County on September 20, 2022. For access to paved roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways. A variance request for alternatives to the tracking control requirement can be submitted to Development Review for review and consideration. This site requires double cattle guards and 100 ft. of asphalt or 300 ft. of asphalt. LRM Response Tracking control (temporary and permanent) will be implemented on site and shown on the amended Plan drawing. Improvements and Road Maintenance Agreement with Up -Front Improvements Comment Public Works is requesting an Improvements and Road Maintenance Agreement for dust control, damage repairs to specified haul routes, triggered off -site improvements and up- front off -site improvements. Consideration may be given to proportional sharing of cost for these improvements. These improvements may include but are not limited to: • Paving county -maintained CR 48.5 from the site access west, • Upgrade of CR 17 as it relates to the improvements associated with CR 17 and CR 48.5 intersection, • Upgrade of the intersection of CR 17 and CR 50 • Upgrade of intersection of CR 50 and CF 13, and • Upgrade of the bridges traversed on the haul route. Improvements/Road Maintenance Agreement: An example agreement is available on the Weld County/Development Review website. It is our understanding that this will change the improvements listed in the comment. As per our discussion on September 22, 2022 with the County, LRM will work with the County on the required agreements and consider any in -lieu contributions LRM can make towards County road improvements adjacent to LRM' s property. Drainage Requirements Comment This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. LRM Response See Attachment 3, Final Drainage Narrative. Comment Drainage Narrative: The applicant has submitted a preliminary drainage narrative. A final drainage narrative citing an acceptable drainage detention exception, from Sec 8-11-40 of the Code, with adequate documentation shall be submitted. Comment Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. LRM Response The only permanent structure being built on site will be construction of a bridge for the Big Thompson River crossing, which will disturb less than 1 acre. Temporary haul roads and stockpile locations will also be constructed and shift as mining progresses. If plans change to disturb more than 1 acre for non -gravel pit items, LRM will apply for the appropriate permits. CONDITIONS OF APPROVAL Comment An Improvements and Road Maintenance Agreement is required for off -site improvements at this location. Road maintenance includes, but is not limited to, dust control and damage repair to specified haul routes. Title 35, Article 5.5) declares that certain undesirable plants constitute a threat to the "continuous economic and environmental value of lands of the state" and requires that these "noxious weeds" be managed on private and public lands. The Act further declares that control of noxious weeds should use methods that are least damaging to the environment but also practicable and economically reasonable. Loveland Ready -Mix Concrete, Inc. (LRM) has prepared this weed management plan for the proposed Dunn Pit to meet the requirements of Weld County and the State. 2.0 WEEDS OF CONCERN The Weld County Noxious Weed Management Enforcement Policy follows the guidelines of the Colorado State Noxious Weed Act; it prioritizes noxious weed species into three lists. List A Species are not well established but are potentially a large problem to the State of Colorado and require mandatory eradication. Though none have been identified on the site, if any List A species are found they will be immediately eradicated in accordance with the Colorado State Noxious Weed Act. List A Species will be managed with appropriate herbicide applications. List A Species found in Weld County are summarized in Appendix A. List B Species will be managed with mowing and targeted herbicide application. Several List B noxious weeds that are currently observed onsite in small patches are Perennial pepperweed, Diffuse knapweed, Wild caraway, Hoary cress, and Common thistle. Appendix A presents List B species found in Weld County. List C Species will be managed with appropriate herbicide applications. List C Species found in Weld County are listed in Appendix A. 3.0 WEED MANAGEMENT Pre-existing weeds identified on site will be controlled through continued attention and spot application of the appropriate herbicides. Controlling the existing infestations is an important preventative measure that keeps weeds from spreading and increasing in size. The primary management methods to control weeds will be grazing, mechanical control, and herbicide control. Topsoil has supported grazing and other agricultural uses on this site for decades, however, if sufficient new grass growth does not occur within two seasons after planting, the soil base and weed growth will be re-examined, treated as necessary, and reseeded. Grazing Control is currently being utilized on site. Leased pasture is used to graze cattle. Since mining will be progressive, exposing limited areas at a time, remaining pasture will continue to be grazed until mining progresses to the point that grazing is no longer feasible. Care will be taken not to overgraze the remaining pasture areas. Mechanical Control will be performed through consistent mowing. Mowing is effective in keeping weeds under control and will prevent seed dispersal and provide suppression so that new grass growth may occur. LRM will mow problem areas and newly reclaimed areas at least two time per growing season to help eliminate weeds and establish new grass. Herbicide Control will be through herbicide applications tailored to the type of weed being treated. Any broadcast applications will be selective products that can be broadcast applied and not injure the grass species. Spot -spray applications of non -selective herbicides such as Roundup will only be used to control isolated noxious weeds. LRM 2 20210120 dtuin pit_weed management plan_final January 2022 TELETQ 4.0 WEED PREVENTION The reclamation and re -vegetation process can take several years to fully implement and achieve desired results. Early control and management of new weed infestations through identification, early detection and response will be utilized for disturbed areas that have been reseeded as a part of the reclamation process. Noxious weeds can become established on or near disturbed land very rapidly and have the capacity, capability, and potential to spread quickly to other areas. Noxious weed seeds and vegetative matter can be transported by means of animals, vehicles, shoes, waterways, and hay to name a few examples of transportation. Personnel should be aware of established noxious weed populations and the possible transport mechanisms on their property and surrounding properties. After an area has been successfully eradicated of noxious species or before establishment has taken place, LRM will either revegetate the disturbed area to minimize the chance of noxious weed establishment or promote a more active inspection program to maintain the bare ground conditions. If the disturbed land has desired species growing as a result of revegetation efforts, competition with noxious species will increase. Therefore, the potential and capability of the noxious weed to establish in the disturbed area is limited. 5.0 SUMMARY AND ADDITIONAL REFERENCES Weed management decisions vary according to plant life cycles, infestation size, and environmental conditions. A licensed applicator with experience in weed control management in Colorado will be used to prepare a plan for any application of herbicides used to control weeds on site. Other resources that may also be consulted are CSU Extension's "Weed Management for Small Rural Acreages -3.106" and the Weld County "Noxious Weed Management Enforcement Policy". All herbicide application plans will include the specific herbicide(s) to be used, the application rate, and the appropriate timing. Care will always be taken to prevent any overspray onto neighboring properties. (LRM) proposes the construction and operation of a new sand and gravel mine (Project). The Project will be located at the northwest corner of Colorado Highway 257 and Weld County Road 48'/2 in Weld County (Site; Figure 1). The proposed mining operations will include the recovery of sand and gravel resources to produce concrete to serve the Northern Colorado area. Weld County's Use by Special Review (USR) Drainage Requirements allow for the completion of a drainage narrative in lieu of a drainage report for certain land uses. LRM hereby requests an exemption to stormwater detention and presents this drainage narrative based on the Project's intended operational use as a gravel pit. PROJECT DESCRIPTION The Site is currently undeveloped and is used for cattle grazing and oil extraction. The proposed Project plans to develop the Site as a sand and gravel mine. Specific development activities include: • Constructing a Site access road and bridge from the proposed Site entrance northward across the Big Thompson River • Excavating three aggregate mine cells to a depth of approximately 30 feet, which will become unlined, groundwater -fed lakes • Hauling the mined aggregate to LRM's permitted Johnstown concrete, batch plant for processing • Reclaiming the mined slopes above the groundwater table and establishing new wetlands in and around the mined cells During mining, LRM will temporarily stockpile mined aggregate for approximately 1 -day to allow the material to drain before hauling. LRM will conduct reclamation concurrent to mining and anticipates no long-term storage of reclamation materials in the floodplain. Figure 2 shows the final configuration of the Project. The bridge will remain in place after mining is complete. EXISTING SITE HYDROLOGY Flow Patterns The Big Thompson River runs west to east through the center of the Site (Figure 1). Stormwater currently runs onto the Site, across the Site, and toward the Big Thompson River from the north, south and west. Stormwater is discharged from the Site along the eastern property line via the Big Thompson River. Ditches The Thompson and Platte Ditch is located approximately 500 feet to the south of the Site while the Hill and Brush Ditch adjoins a portion of the northwest property line (Figure 1). Hill and Brush Ditch return flows are discharged to the Big Thompson River approximately 200 feet upstream of the Site. There are no ditches located on the Site. Floodplain/Floodway Status The Site lies entirely within the 100 -year floodplain and almost entirely within the regulatory floodway (Figure 3). The County has issued a Flood Hazard Development Permit, FHDP21-0024, to LRM for the project (dated November 30, 2021). PROPOSED SITE HYDROLOGY Although Weld County' s USR Drainage Requirements allow an exemption for stormwater detention, LRM is still required to release detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site. Flow Patterns Upon completion of the Project, upgradient surface water runoff will be intercepted by the mining cells and will be released to the Big Thompson River in a controlled manner which complies with the requirements of the USR Drainage Requirements. The Project proposes to pass flood flows between the proposed mine cells and the Big Thompson River in the following manner (Figure 2): • Floodwater will enter cells Cl and C2 via overland flow or one of two pit inlet weirs along the Big Thompson River near the western Site boundary. 20220923 Drainage Narrative TELEST® $O LO t IONS. This weir was sized to limit pit discharges to the historical 1 -hour, 5 -year peak discharge rate during the 1 -hour, 100 -year runoff event (see the attached calculation set). • Floodwater will enter/exit cell C3 from/to the Big Thompson River via a pit inlet/outlet weir near the eastern Site boundary. However, cell C 1 provides enough effective storage below the pit inlet/outlet weir that there will be no discharge to the river during the 1 -hour, 100 -year runoff event (see the attached calculation set). Therefore, no hydraulic control structure specific to the 1 -hour, 100 -year runoff event was required on the cell C3 outlet to limit discharges to the 1 -hour, 5 -year historical peak discharge. Historic Peak Runoff Rates: a. 5 -year 1 -hour historic peak runoff rates were calculated for each basin to define the maximum developed release rates of the gravel pits b. As per USR Drainage Requirements, the Rational Method Peak Runoff Prediction Workbook as provided by the county was used to calculate the historic peak runoff from the basins during the 5 -year 1 -hour precipitation event. Urban Drainage workbook version 1.02a was downloaded from: https://www.weldgov.com/Government/Departments/Planning-and- Zoning/Development-Review c. Required workbook parameters for historic conditions were entered into the spreadsheet including: I. Basin area (calculations 1.a), ii. Percent imperviousness (2.0%; data and assumptions 1.c) iii. Time of concentration flow paths and slopes for historic runoff were derived by dividing each basin into three hydrologic components: overland flow, channelized flow (pasture), and channelized flow (waterway). i. Overland flow distance = 500 feet ii. Channelized flow (pasture) distance = Distance from end of overland flow to waterway iii. Channelized flow (waterway) distance = Distance from end of channelized flow (pasture) to basin outlet iv. Developed 100 -year 1 -hour runoff hydrographs were calculated for each basin so that runoff could be routed to the basin outlets for hydraulic structure sizing. Since the Rational Method Workbooks didn't have hydrograph calculation capabilities, this analysis chose the Standard Rational Hydrograph Method. This method uses the times of concentration, peak discharge rates and runoff coefficients from the Rational Method peak runoff calculations to develop triangular runoff hydrographs. Since the developed runoff coefficients for the North Basin was grater than 0.75, a receding limb factor of 1 was used for the basin. A receding limb factor of 1.33 was used for the South Basin. Runoff hygrographs are shown on the following page. Standard Rational Method The Standard Rational method simply computes the peak flow, Op = CIA_ The resulting hydrograph is an isosceles triangle. 30 Time (min) 9!;.ndard Rational method hydrographs peak al time, Tc and have a total duration equal to 2 x Tc. Ascending Limb (AL) You can specify an ascending limb factor as a multiple of Tc. This value will place the Time to Peak equal to Tc x AL. Unless you have a special situation that warrants this to be different, leave as 1.0, the default. Receding Limb (RL) This value extends the receding side of the hydrograph to Tc x RL. The default is 1.0 which produces the hydrograph as shown above. Calculated 100 -year 1 -hour developed runoff volumes: • North Basin = 401,526 cu. ft. • South Basin = 697,534 cu. ft. 4. Stage -Storage Relationships a. Stage -storage relationships were developed for pit cells C1 and C3 in order to determine how the developed runoff hydrographs would affect water elevations in the pits and in turn to size the associated outlet hydraulic structures. A stage -storage relationship was not developed for cell C2 because its water surface is controlled by an adjustable outlet weir (Detail B) which discharges to cell C3. The cell C2 water surface at the time of the runoff event should be at the elevation of the outlet. Therefore, cell C2 has no effective storage and for simplicity this analysis assumes that the runoff hydrograph will be passed instantaneously from cell C2 to cell C3. b. As shown in the Stormwater Management Plan Sheet 2 of the Drainage Narrative the predicted post -mining static water surface elevation of cell C1 is expected to be 4,737.5 ft and the post -mining static water surface elevations of cells C2 and C3 are expected to be 4,735.0 ft. Also, as shown on Sheet 2, the crest elevation of the cell C1 adjustable outlet weir (Detail A) will be 4,737.5 ft. Therefore, cell C1 has no effective storage and the incoming flood hydrograph will immediately cause discharges from the pit. Sheet 2 also shows that the riprap inlet/outlet weir of cell C3 is at an elevation of approximately 4,740.0 ft and 5 ft higher than the expected static water surface elevation in the pit. Therefore, cell C1 has 5 feet of effective storage before the incoming flood hydrograph will discharge to the river. c. Stage -storage relationships for cells C1 and C3 were developed in ACAD using the Site's mine plan. The cell C1 stage -storage relationship only shows the region above the outlet weir crest this cell has no effective storage. The cell C3 stage storage - storage relationship shows elevations from the expected static water surface to the riprap inlet/outlet weir. Stage -storage relationships are shown on the next page. The cell C3 developed 100 -year 1 -hour runoff volume as presented in calculations 3.1 was 697,534 cu. ft. Since the effective storage below the riprap inlet/outlet weir in cell C3 is 5,750,000 cu. ft. (calculations 4.c) there will be no expected runoff from the South Basin into the Big Thompson River as a result of the 100 -year 1 -hour storm event. Therefore, no hydraulic outlet structures are required on cell C3 to limit the pit discharge to the 5 -year 1 -hour peak runoff rate as determined in calculations 2.f. b. The cell C1 pit stage -storage relationship was used in conjunction with the rectangular contracted weir equation to route the developed 100 -year 1 -hour runoff hydrograph through the pit and to size the pit outlet weir. The width of the outlet weir was varied until the discharge rate was less than 5.15 cfs. Calculations are presented on the following page. iv. The resulting chosen weir width was 4.0 ft corresponding to a discharge of 2.16 cfs. This discharge occurred at the maximum pool height of 0.30 ft above the weir crest. A weir width of 4.0 feet was chosen over a wider width because it would limit the size of the downstream weir box. Since cell C1 has 3.5 ft or 3,500,000 cu. ft. of effective storage above the weir crest, the loss of discharge capacity resulting from a 4.0 ft weir width was determined to not be of concern. The mission of Colorado Parks and Wildlife (CPW) is to perpetuate the wildlife resources of the state, to provide a quality state parks system, and to provide enjoyable and sustainable outdoor recreation opportunities that educate and inspire current and future generations to serve as active stewards of Colorado's natural resources. CPW has a statutory responsibility to manage all wildlife species in Colorado; as such we encourage protection for Colorado's wildlife species and habitats through responsible development and land use planning. Our goal in responding to land use proposals is to provide complete, consistent, and timely information to all entities who request comments on matters within our statutory authority. One way we accomplish our mission is by responding to land use requests, as is the case for this proposed open gravel mine project. The protection of High Priority Habitats (HPHs) is of extreme importance to CPW. CPW recommends that all proposed projects be assessed to prevent the loss of habitat or fragmentation of habitat as well as to avoid, minimize, or mitigate impacts to wildlife species sensitive to development, which can include species of concern, big game winter concentration areas, raptor nests, and breeding and nesting habitats for ground -nesting birds. Note: The Bald Eagle is designated as an avian Priority Tier 2 Species of Greatest Conservation Need within CPW's 2015 Colorado State Wildlife Action Plan. This designation denotes that these species are in need of conservation attention in Colorado and are provided a relative degree of conservation management priority. • CPW has documented an active Bald Eagle nest in Township 5N, Range 67W, Section 33 which lies approximately one (1) mile west of the project boundary. While the 1/4 -mile and 1/2 -mile buffers extend outside of the project boundary, CPW recommends that pre - construction nest surveys be conducted by the applicant prior to any surface disturbance or occupancy. If a nest site is found within the project boundary, consultation with CPW is advised. • Mule Deer Severe Winter Range o Mule Deer Severe Winter Ranges are defined as that part of the overall winter range where 90% of the individuals are located when the annual snowpack is at its maximum and/or temperatures are at a minimum in the two worst winters out of ten. The entire project boundary lies within Mule Deer Severe Winter Range HPH. • Therefore, CPW recommends no initial ground disturbances, construction activities or occupancy within the project boundary from December 1 to April 30. o Furthermore, CPW recommends using wildlife -friendly fencing throughout the development, in particular, along the boundaries that borders the Big Thompson River. Wildlife -friendly fencing may include four -strand smooth wire as further discussed in CPW's "Fencing with Wildlife in Mind" brochure. • Aquatic Native Species o There are sensitive aquatic native species (fish and amphibians) located within the Big Thompson River. • Therefore, CPW recommends No Surface Occupancy and No Ground Disturbances (year-round) within 500 feet of the Ordinary High Water Mark of the Big Thompson River, as well as implementing appropriate storm water BMPs. • Noxious Weeds and Native Re -seeding o Also of importance to CPW is the revegetation of disturbed soils and the control of noxious weed species through the development of a noxious weed management plan prior to initiating construction activities. • Therefore, CPW recommends that native vegetation be retained on -site during the operational lifespan of the project, both as potential habitat for wildlife and to ensure successful reclamation of the project area, as noxious weeds could spread to adjacent habitats outside of the project area. • Wildlife Escape Ramps o During open pit and open trench mining operations, CPW recommends backfilling escape ramps in areas where steep slopes occur. Escape ramps will allow wildlife to safely exit an open pit or trench if they become entrapped. • Retention ponds o Ponds created by reclamation efforts can hold significant value to wildlife. To maximize the benefit, CPW recommends that ponds be designed to include irregular shorelines and one or more off -shore islands to provide cover, shelter and nesting areas for migratory birds. Islands should be at least 15' x 25' in size for every two surface acres of water in the pond. Shoreline and island slopes should be graded to a ratio of four (4) horizontal feet to every one (1) vertical foot of distance, with some areas having slopes no steeper than eight (8) horizontal feet to every one (1) vertical foot of distance. Such shallow areas will allow for the establishment of a variety of aquatic vegetation and invertebrate prey for waterfowl and shorebirds. Shorelines should be re - vegetated with native aquatic vegetation. LRM Response LRM notes CPW's recommendation and LRM believes little impact to the habitat will occur given that the permitted area is located on existing pastureland that has been actively grazed year -around by cattle for over 20 years. Additionally: • Of the approximately 114 permitted acres, 38 acres will consist of boundary offsets, perimeter buffering, and a 100 -foot buffer corridor along each side of the Big Thompson River. Active mining will be limited to approximate 5 acres phases, thus, limiting disturbance to less than 5% of the permitted mine site at any one time. • Operations will take place Monday through Friday, from 7:00 am to 5:00 pm. Obviously during severe winter weather, construction activities will be at a minimum. • Reclamation will commence concurrently following behind mining providing reclaimed areas for deer range. All reclamation will be carried to completion with all reasonable diligence with a goal to complete each phase within 5 years from the date each cell has been mined through. Additional information regarding the Reclamation Plan can be found in the permit documentation with Colorado Division of Reclamation Mining and Safety, M2021-059. 20220927 CPW TELESTO To: Kim Ogle Date: September 27, 2022 Page 3 Comment Furthermore, CPW recommends using wildlife friendly fencing throughout the development, in particular, along the boundaries that borders the Big Thompson River. Wildlife friendly fencing may include four -strand smooth wire as further discussed in CPW's "Fencing with Wildlife in Mind" brochure. LRM Response CPW's recommendation is noted. LRM plans no fencing along the river at this time. Existing fencing locations can be found in permit documentation with Colorado Division of Reclamation Mining and Safety, M2021-059. Aquatic Native Species Comment There are sensitive aquatic native species (fish and amphibians) located within the Big Thompson River. Therefore, CPW recommends No Surface Occupancy and No Ground Disturbances (year- round) within 500 feet of the Ordinary High water Mark of the Big Thompson River, as well as implementing appropriate storm water BMPs. LRM Response CPW's recommendation is noted. A wetland delineation/determination was conducted on behalf of LRM for the Dunn Pit location. A detailed survey of the present vegetation types, including quantitative estimates of cover and height for the principal species was provided in the Dunn Pit Permit Application M2021-059 Exhibit I, along with an evaluation of the significant wildlife resources in Exhibit H, as approved by the Colorado Division of Reclamation, Mining and Safety (DRMS). A 100' mining buffer from the OHWM on each side of the Big Thompson River will be provided. Other than at the proposed bridge crossing, LRM will stay out of the 100 -foot buffer and only be adjacent to it occasionally for short periods of time. Additionally, upgradient surface water runoff will be intercepted by the mining cells and will be released to the Big Thompson River in a controlled manner, which complies with the requirements of the USR Drainage Requirements. 20220927 CPW TELESTO To: Kim Ogle Date: September 27, 2022 Page 4 Noxious Weeds and Native Re -seeding Comment Also of importance to CPW is the revegetation of disturbed soils and the control of noxious weed species through the development of a noxious weed management plan prior to initiating construction activities. LRM Response CPW's recommendation is noted. LRM recently provided "Weed Inventory, Monitoring, and Control Plan" to Weld County. LRM plans to mine the site in 5 acre increments and reclamation will take place concurrently as mining progresses, ensuring vegetation and habitat is provided throughout most of the site during the operational lifespan of the project. Wildlife Escape Ramps During open pit and open trench mining operations, CPW recommends backfilling escape ramps in areas where steep slopes occur. Escape ramps will allow wildlife to safely exit an open pit or trench if they become entrapped. LRM Response CPW's recommendation is noted. LRM's approved mining plan requires slopes that are structurally stable at all times. Because it is a wet mining operation, there will be slopes of 2:1 to 3:1 at all times around the entire excavation area. Retention ponds Comment Ponds created by reclamation efforts can hold significant value to wildlife. To maximize the benefit, CPW recommends that ponds be designed to include irregular shorelines and one or more offshore islands to provide cover, shelter and nesting areas for migratory birds. The submitted material does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments regarding the proposed water supply. The application is in regards to a proposed sand and gravel mining operation known as the Dunn Pit, which will be operated under Colorado Division of Reclamation, Mining and Safety (DRMS) permit no. M-2021-059. The reclaimed land uses upon completion of the mining operation are proposed to be wildlife habitat, groundwater sourced ponds, and mitigated wetlands and open space. Comments regarding the reclamation permit were provided to the DRMS in a memo dated November 16, 2021. The deposit to be mined ranges from approximately 25 to 28 feet thick and is overlain by approximately 1 to 2 feet of sandy to clay loam top soil. An excavator will be used to wet mine material down to the bedrock. The applicant has submitted a request for a substitute water supply plan to this office and an application for a gravel pit well permit. The requested start date of the substitute water supply plan is January 2023, when the applicant expects to have obtained approval of all necessary permits. The consumptive use of groundwater at the site by evaporation, dust control, water retained in the mined product, and reclamation vegetation establishment is estimated to total 21.80 acre-feet during the first year of operation. The applicant has an agreement with the City of Loveland for the supply of replacement water necessary for the operation and approval of the substitute water supply plan. The final reclamation plan includes unlined ponds of exposed groundwater at the site. The ponds will be required to be included in a plan for augmentation decreed by the water court prior to final release of the site from their DRMS permit. A water supply station and portable toilets are proposed to be used for drinking and sanitation purposes. Stormwater will be diverted into the mining cells or allowed to flow through the site using historical channels in undisturbed portions of the site. No additional stormwater detention facilities are proposed. All stormwater runoff intercepted by this operation must infiltrate into the ground or be released to the stream system within 72 hours, otherwise the operator will need to make replacements for evaporation from the surface area of the intercepted stormwater. The applicant has conducted a baseline groundwater assessment to determine support geotechnical analyses, wetland mitigation decisions, and to assess potential impacts associated with the proposed sand and gravel mine. As part of the baseline groundwater assessment the applicant has constructed ten monitoring wells. Water levels will be collected at all monitoring wells monthly and water quality samples will be collected from five of the wells quarterly.
