RE: APPROVE VACATION, VAC24-0022, OF AMENDED USE BY SPECIAL REVIEW
PERMIT, AMUSR-630 - ARMSTEAD RANCH, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 3, 1987, the Board approved Amended Use by
Special Review Permit, AMUSR-630, for an Open -cut Mining Pit on an additional nine (9) acres,
in the A (Agricultural) Zone District, for Armstead Ranch, LLC, on the following described real
estate, to -wit:
Part of the SW1/4 of Section 31, Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Armstead
Ranch, LLC, c/o Glen Eastin, 219 State Highway 52, Erie, Colorado 80516-9315, to vacate
Amended Use by Special Review Permit, AMUSR-630, to meet Condition of Approval #1.A of Lot
Line Adjustment, LLA24-001, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Amended Use by Special Review Permit, AMUSR-630, be, and hereby is,
vacated.

NARRATIVE: The applicants have been conditionally approved by the Department of Planning Services on
February 22, 2024, for a Lot Line Adjustment. Condition of approval 1.A. states:
1.A. Use by Special Review Permit AMUSR-630, reception # 02111714, for an open -cut gravel mining
operation in the A (Agricultural) Zone District is located Lot B of LLA24-0001. The gravel mining
status per the Colorado Division of Reclamation and Mining safety is identified as "revoked and
terminated" a complete USR vacation request letter shall be submitted to the Department of
Planning Services. A written statement requesting to vacate AMUSR-630 shall be provided to the
Department of Planning Services. A USR vacation hearing shall be held before the Board of County
Commissioners prior to recording the Lot Line Adjustment plat.
In order to address this Condition of Approval the applicant submitted a letter to the Department of Planning
Services received a request. dated September 26, 2024, to vacate AMUSR-630. AMUSR-630 is for a gravel
pit that has been fully reclaimed per the Division of Reclamation and Mining Safety (DRMS).
AMUSR-630 was approved by the Board of County Commissioners on June 3, 1987, and the map was
recorded with the Weld County Clerk and Recorder on August 25, 1987 under reception #2111714. The
AMUSR was approved for An Amendment of Use by Special Review for open -cut mining pit on an additional
nine acres — Weld County Corporation.
The Department of Planning Services is recommending approval of this vacation.

As we discussed, it is my opinion that Mr. Glen Eastin has the authority to sign for Joan and Richard
Armstead regarding the lot line adjustment by the Weld County Planning Commission. •
An order appointing a conservator vests title to all of the property of the protected person in the
conservator as trustee. Colo. Rev. Stat. § 15-14-421(1). Letters of conservatorship are.evidence of
vesting title of the protected person's assets in the conservator. Colo. Rev. Stat. § 15-14-421(2).
Under Colo. Rev. Stat. § 15-14-425(2), a conservator has a wide range of powers, including the authority
to perform a wide range of actions without any further authorization, if acting reasonably and in an
effort to accomplish the purpose of the court, unless the order of appointment limits the authority of
the conservator.
As pertinent here, the conservator is empowered to:
• Manage, develop, improve, exchange, partition, or abandon an asset of the estate;
• Make ordinary or extraordinary repairs or alterations to buildings;
• Pay or contest any claim or settle a claim against the conservatorship estate or the protected person;
• Prosecute or defend actions, claims, or proceedings in any jurisdiction for the protection of the assets
of the estate and of the conservator in performance of fiduciary duties;
• Execute and deliver all instruments that will accomplish or facilitate the exercise the powers vested in
the conservator.

Not being an attorney— I cannot clearly identify that Mr. Eastin can sign on behalf of the
applicant. The Conservatorship refers to a power of attorney: Does the applicant
happen to have a copy of the power of Attorney? I am going to be asked where is it that

Narrative:
The proposed application seeks to adjust a lot line between parcel #s 1313-31-3-00-007 and 1313-31-3-
00-008, now known as Lots A and B of LLA24-0001. The lot line adjustment will shift the boundaries of Lot
A to the south and expand the boundary to the east and west. After the lot line adjustment is approved and
recorded, Lot A will contain an existing outbuilding along with the existing residential improvements (the
residence was constructed in 1971). There is a Quonset building that appears to be near the proposed east
property line for proposed Lot A. There is an old gravel mining AMUSR (AMUSR-630) on proposed Lot B
that was approved by the Board of County Commissioners in 1987. There is no mining activity occurring
on the property and the gravel permit (M19840070) status is delineated as "revoked and terminated" per
the Colorado Division of Reclamation and Mining Safety database. The smaller parcel (Lot A) was
` deeded/created prior to 1972. The deed was recorded on November 12, 1971.
Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative -review that
the Lot Line Adjustment Overview and Standards per Sections 24-10-10 and 24-10-20 of the Weld County
Code have been met. This Lot Line Adjustment is approved with the following conditions of approval in
accordance with information submitted in the application and the policies of Weld County.
0. Prior to recording the plat:
A. Use by Special Review Permit AMUSR-630, reception # 02111714, for an open -cut gravel mining
operation in the A (Agricultural) Zone District is located Lot B of LLA24-0001. The gravel mining
status per the Colorado Division of Reclamation and Mining safety is identified as "revoked and
terminated" a complete USR vacation request letter shall be submitted to the Department of
Planning Services. A written statement requesting to vacate AMUSR-630 shall be provided to the
Department of Planning Services. A USR vacation hearing shall be held before the Board of County
Commissioners prior to recording the Lot Line Adjustment plat.
B. An acceptable Traffic Narrative is required.
C. The existing Quonset structure to be located on Lot B may not meet the required offset from the
westem boundary of proposed Lot A. Weld County Planning recommends that the lot line be
located a minimum of 3 -feet or 1 -foot for every 3 -feet of building height, whichever is greater per
• Section 23-3-70 of the Weld County Code. In the altemative the applicant shall do one of the
following:
i. The applicant shall submit a Nonconforming Structure application to the Department . of
Planning Services for this structure
ii. The applicant shall provide evidence that ,a complete demolition permit to remove the Quonset
building has been submitted to the Weld County Department of Building Inspection.

3) The property owner or operator shall be responsible for controlling noxious weeds on the site,
pursuant to Chapter 15, Article I and II, of the Weld County Code.
4) Access on the sites shall be maintained to mitigate any impacts to the public road including
damages and/or offsite tracking.
5) The historical flow pattems and runoff amounts will be maintained on the site.
6) Water service may be obtained from Left Hand Water District.
7) The parcels are currently not served by a municipal sanitary sewer system. Sewage disposal may
be by on -site wastewater treatment systems (OWTS) designed in accordance with the regulations
of the Colorado Department of Public Health and Environment, Water Quality Control Division, and
the Weld County Code in effect at the time of construction, repair, replacement, or modification of
the system.
•
8) Activity or use on the surface of the ground over any part of the OWTS must be restricted to that
which shall allow the system to function as designed and which shall not contribute to compaction
of the soil or to structural loading detrimental to the structural integrity orcapability of the component
to function as designed.
9) A Flood Hazard Development' Permit is required forall construction or development occurring in
the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA)
FIRM Community Panel Maps # 08123C -2056F and 2058F date November 30, 2023 (Boulder
Creek). Any development shall comply•with all applicable Weld County requirements, Colorado
Water Conservation Board requirements as described in Rules and Regulations for Regulatory
Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts
59, 60, and 65. The FEMA definition of development is any man-made change to improved or
unimproved real estate, including by not limited to buildings or other structures, mining, dredging,
filling, grading„paving, excavation, drilling operations, or storage.of equipment and materials.
10)'FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any
development activities, the owner should contact Weld County to determine if the floodplain
boundaries have been modified.
11).Priorto the release of building, permits, the applicant shall submit a recorded deed°describing the
Lot upon which the building permit is requested with the building permit applications. The legal
description on such deed shall include the Lot designation and Lot Line Adjustment number.
12) Prior to the release of building permits, the applicant shall submit evidence to the Department of
Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and
dependability.
13) All proposed or existing structures will or do meet the minimum setback and offset requirements
for the zone district in which the property is located. Pursuant to the definition of setback in the
Weld County Code, the required setback is measured from the future right-of-way line.
14) All buildings shall comply with the setback from oil and gas wells per Section 23-4-700, as
amended.
15) Building permits may be required, for any new construction, set up of manufactured structures, or
change of use of existing buildings per Section 29-3-10 of the Weld County Code.. Buildings and
structures shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2018 International Building
Codes, 2018 International Energy -Code, 2020 National Electrical Code, and Chapter 29 of the Weld
County Code. A Building Permit Application must be completed and two (2) complete sets of
engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be
submitted for review. A Geotechnical Engineering Report, performed by a Colorado registered
engineer, shall be required or an Open Hole Inspection. A building permit must be issued prior to
the start of construction.

16) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the
County Facility Fee, County -Wide Road Impact Fee, and Drainage Impact Fee Programs.
17) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most
-abundant mineral resources, including, but not limited to, sand and .gravel, oil, natural gas, and
cbal..Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the
State's commercial ,mineral deposits are essential to the State's economy; (b), the populous
-counties of the state face a critical shortage of such deposits; and (c) such deposits, should be
extracted according to a rational plan, calculated to avoid waste of such deposits and "cause the
least practicable disruption of the ecology and quality of life of the citizens of the populous counties
'of the state.
'Mineral resource locations are widespread throughout the County and -people moving into these
• areas must recognize the various impacts associated with this development. Often times, mineral
• resource sites are fixed to their geographical and, geophysical locations. Moreover, these resources
are protected property rights and mineral ownersshould be afforded the opportunity to extract the
mineral resource,
18) 'WELD COUNTY'S RIGHT TO .FARM -STATEMENT: Weld. County is one of the most productive
agricultural counties in the United States, typically ranking in Hie top ten counties in the country in
total market value of agricultural products sold. The rural areas of Weld County may be open and
spacious, but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with long-standing agricultural
practices and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural areas: open views, spaciousness,. wildlife, lack of
city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms,
those features which attract urban dwellers to rural Weld County would quickly be gone forever
•
Agricultural users of the land should not be expected to change their long-established agricultural
• practices to accommodate the intrusions of urban users into •a -rural ,area. Well -run agricultural
activities will generate off -site impacts, including noise from tractors and equipment; slow -moving
farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads,; odorfrom
animal confinement, silage and manure; smoke from ditch buming; flies and mosquitoes; hunting
and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the -use of pesticides
' and fertilizers in the fields, including the use of aerial spraying . It is common practice foragricultural
producers to utilize an accumulation of agricultural machinery and supplies to assist in their
agricultural Operations. A concentration of miscellaneous agricultural materials often produces a
visual disparity between rural and urban areas of the County.'Section 35-3.5-102, C.R.S., provides
that an agricultural operation shall not be found to be a public or private nuisance if the,agncultural
operation alleged to be a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Water has been,' and continues to be, the lifeline for the agricultural community. It is unrealistic to
assume that ditches and reservoirs may simply be moved "out of .the way" of. residential
development. When moving to the County, property owners and residents must realize. they cannot
take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right
to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice
the size of the State of Delaware) with more`than three thousand seven hundred (3,7.00) miles of
State and County roads outside of municipalities. The sheer magnitude of the -area to be served
`stretches available resources. Law enforcement is based on responses to complaints more than
on patrols of the County, and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire: Fire protection is usually provided by
volunteers who must leave their job's and_ families to respond to emergencies. County gravel roads,
no matter how often they are ,bladed, will not provide the same kind of surface expected from a
paved road. Snow removal priorities' mean that roads from subdivisions'to arterials may not be
cleared for several days after a major snowstorm. Services iri rural areas, in many cases, will not
be equivalent to municipal. services. Rural dwellers must, by necessity, be more self-sufficient than

urban dwellers. •
People are exposed to different hazards in the County than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand bum, puncture vines, territorial farm dogs and
livestock, and open'buming' present real threats. Controlling children's activities is important, not
only for their safety, but also for the protection of the farmers livelihood.
2. Next Steps:
Per Section 24-10-50 of the Weld County Code: The Lot Line Adjustment revised draft plat shall be
submitted once an application is approved. The applicant shall electronically submit the draft plat in
PDF format to the Department of Planning Services for Planning and Public Works review. Planning
staff will send the draft plat back to the applicant with redline comments to be incorporated in the revised
plat. There may be subsequent rounds of review. Upon approval of the draft plat and completion of the
conditions of approval, the applicant shall submit the signed and notarized approved plat to the
Department of Planning Services. The approved plat shall be recorded in the Office of the Weld County
Clerk and Recorder by the Department of Planning Services. The approved plat and additional
requirements shall be recorded within one hundred twenty (120) days from the date the administrative
review was signed or from the"date of approval by the Board of County Commissioners. The applicant
shall be responsible for.paying'the recording fee.
3. Enforcement:
Per Section 24-10-60 of the Weld County Code:
A. If the Lot Line Adjustment plat has not been recorded within one hundred twenty (120) days from
the date the Staff Report was administratively signed or the date of approval by the Board of County
• Commissioners, or if an applicant is unable to meet any of -the conditions within one hundred twenty
(120) days of approval, the Director of Planning Services may grant an, extension fora period not
to exceed one (1) year, for good cause shown, upon a written request by the applicant. If the
applicant is unwilling to• meet any of the conditions of approval or the extension expires, the
. application will be forwarded to the Board of County Commissioners for reconsideration. The entire
• application may be considered for denial by the Board of County Commissioners. Altematively, the
Board of County Commissioners may consider upholding, modifying or removing the contested
conditions of approval.
•
B. .The property owner shall comply with the recorded plat notes and lot configuration. Noncompliance
may result in locking of !the lots -and withholding Weld County permits. _
C. The Board of County Commissioners shall have the power to bring an action to enjoin any
subdivider from selling, agreeing to sell or offering to sell subdivided land before a plat for such
subdivided land has been approved and recorded per Section 30-28-110(4), C.R.S.
4. Plat Recording Process: •
Per Section 24-1040.1 of the Weld County Code: Upon completion of the conditions of approval and
acceptance of the plat, the'plat may be submitted for recording with the recording fee to the Planner.
The plat shall be signed and notarized by the property owners.. If approved by the, Department of
Planning Services, the Planning Director shall sign the plat. If approved by the Board of County
Commissioners, the Chair of the Board shall sign the plat.
Per Section 24-10-40.J of the Weld County Code: The Department of Planning Services shall submit
the plat to the Weld County Clerk and Recorder for recording.
Per Section 24-10-40.K.of the Weld County Code: The Lot Line Adjustment is approved and binding
the date the plat is recorded with the Weld County Clerk and Recorder.

Per Appendix 5-J of the Weld County Code, should the plat not be recorded within the required one
hundred twenty (120) days from the date the Administrative Review was signed, a $50.00 Recording
Continuance fee shall be assessed foreach additional three (3) month period that the plat has not been
recorded, beyond the initial one hundred twenty (120) days.
Recording New Deeds:
The applicant shall create and record deeds for all the newly created lots; deeds shall include the legal
description of each lot and the reception of the Lot Line Adjustment plat. New deeds are required even
if lots will remain under the_ same ownership. Failure to do so may create issues with the proper
assessment of the lots by the Weld County Assessor's Department and may create a clouded chain of
title.

MINING PIT ON AN ADDITIONAL NINE ACRES -- WELD COUNTY
CORPORATION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 3rd day of June, 1967, at the hour of 2:00 p.m. in
the Chambers of the Board for the purpose of hearing the
application of Weld County Corporation, 219 Highway 52, Frie,
Colorado 80516, to amend a Use by Special Keview for an open -cut
mining pit on an additional nine acres on the following described
real estate, to -wit:
Part of the NWT SW1 NE1 SW1 SW1 SW1 and the
SEA SW1 of Section 31, Township 2 North, Range
68 West of the 6th P.M., Weld County, Colorado
WHEREAS, said matter was originally considered by the Board
on May 27, 1987, and continued to this date to allow Development
Standard #4 to be rewritten, and
WHEREAS, said applicant was represented by Timothy Beaton,
Attorney; the District 6 Water Users Association was represented
by Jeffery J. Kohn, Attorney; and Central Colorado Water
Conservance District was represented by Kim Lawrence, Attorney,
and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall he approved for the following reasons:
1. The submitted materials are in compliance with the
application requirements of Sections 24.7, 44.1, 44.2
and 44.3 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24.4.2 of the Weld County Zoning Ordinance as follows:

The site, as proposed by the application, is, within
the resource conservation area as depicted by the
Weld County Extraction Plan Map 1975, and the U.S.
Geological Survey Map 1974. The area, as
identified, contains the source for the best
quality gravel for concrete aggregate and .road
materials. The Weld County Extraction Plan states
that extraction shall be encouraged in resource
conservation areas. It further states that not
only will the extraction be encouraged .in these
areas, but uses which would preclude the extraction
of these resources will- be discouraged. The
Comprehensive Plan Policies and Goals allow the
adoption of regulations which would .permit
,development of sand and gravel, and other mineral.
resources on agricultural land.
b The proposed use is consistent with the intent of
the Agricultural District and is provided for as a
Use by Special Review because of its potentially
greater, impact on the district. The Weld County
Extraction Plan states that the impacts of surface
mining in nonirrigated areas will be less severe
than those mining operations located on irrigated
areas. The factors used for determining the degree
of severity are sparsely populated areas, less crop
production on a per/acre basis, and the impacts on
water distribution systems. The proposed site is
located•on nonirrigated land. Thus, as an overall
approach, extraction will be accommodated in these
areas so long as appropriate extraction and'
reclamation standards are followed. •
c. At the present time, there exist two Use by Special
Review permits on this section: USR-630:84:26 and
USR-448:80:38. Roth are• operational open -cut
mining pits. The proposed use' will continue to be
compatible with the existing surrounding land uses
and with the future development of the surrounding
area as projected by the Weld County Comprehensive
Plan •and the Town of Erie, as indicated in, a
telephone conservation with Henry M. Epstein, Town
Manager, on May 12, 1987. -
1. The subject site is in a Flood Hazard Overlay
District area. Development, Standards address this
concern.

Amend USR-630:87:17
1. The Use by Special Review permit is for an amendment to Use
by Special Review permit #630:84:26 for an open -cut gravel
mining operation on an additional nine acres, more or less,
as submitted in the application materials on file 'in the
Department of Planning Services and subject to the
Development Standards stated herein.
2. The open -cut gravel operation, shall comply with Section 44.4,
Operation Policies. 'Any violation of these regulations shall
be grounds for enforcement of Section 44.5, Cancellation of
Permit.
3 Vehicular traffic shall ingress and egress onto County Line
Road, as shown on the submitted amended Use by Special Review
plat..
4. The applicant shall fill in all of the pits created by the
gravel mining operation on the nine acres which are the
subject of this amendment so that no open water surface area
is left exposed on this acreage. Applicant shall apply to
the State Engineer on or before June 8, 1987, for a well
permit to allow the removal of ground water for gravel
washing or other beneficial uses. The owner of the land
being mined has agreed to and shall provide two acre-feet of
water annually to offset the gravel washing use from one of
the following water rights, either Boulder and Weld County
Ditch or CTB, to be' diverted and returned or delivered to
Boulder Creek, for the period of mining on these nine acres.
5 All operations on said described parcel shall be in
conformance with the Weld County Food Hazard Regulations
including:
A. NO fill, berms, or stockpiles shall be placed in the one
hundred (100) ,year flood plain of Boulder Creek which
would obstruct passage of flood flows; and
B. All fuel tanks, septic tanks, temporary buildings, and
any other hazardous items that might wash away during
flooding shall be securely anchored and adequately flood
proofed to avoid creation of a health hazard. Following
completion of.mining, all temporary buildings shall be
removed.

6. The amended Use by Special Review plat shall show a topsoil
berm along the southern boundary of the subject site prior to
extracting sand and gravel from Phase'I or Area I in order to
mitigate noise impacts on,the Smith Mobile Home Park'.
7 ,The access road servicing Amended USR-630:84:26 shall be
paved for a distance of twenty (20) feet from County Line
Road to avoid gravel and dirt contamination of the County
Line Road pavement.
•
8. The following signage shall be placed•along County Line Road:
A. ,One stop sign at the. intersection'of the access road and
County Line Road to stop trucks .and other vehicles prior
to their -entrance onto County Line Road;
One sign at the intersection of the access road and•
County Line Road indicating no right -turn to direct
trucks and other vehicles_ prior to their entrance onto
County Line .Road of the specified south -bound haul
route; and
C. Two advisory signs placed Borth and south of the access
road advising the traveling public of "trucks entering
highway" and with an advisory speed of thirty-five (35)
miles per hour.
9. Any stockpiled soil should either be seeded to a quick cover
grass or legume or covered 'with straw mulch at the rate of
two tons_per acre._
10. Fugitive dust shall be controlled at all times.
11. The required Emissions Permit -shall be obtained from the Air
Pollution Control Division, Colorado Department of Health,
and amended to reflect the increased size of the operation.
12. The required NPDES Permit shall be obtained from the Water
Quality Control Division of the Colorado Department of.
Health, and amended, if appropriate, for the increased size
of operation.
13. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24.5 of the
Weld County Zoning Ordinance.
14. The property owner or operator shall .be responsible for
complying with the Operation Standards of Section 24.6 of the
Weld County Zoning Ordinance.

15. Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time -in order to
insure the activities carried out on the property comply with
-the Development Standards stated herein and all applicable
Weld County Regulations. -
.The Use by Special Review area shall be limited to the plans
_shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall' be filed in the office of
the Department of Planning Services.
17. The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be 'reason for
revocation of the permit by the Board of County
Commissioners.
