HomeMy WebLinkAbout20241407.tiffT..))//epot WELD COUNTY CODE ORDINANCE 2024-06 raj IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that Chapter 29 Building Regulations of the Weld County Code, be, and hereby is, repealed and re-enacted, with amendments, to read as follows. CHAPTER 29 BUILDING REGULATIONS ARTICLE II - Code Standards Amend Sec. 29-2-70. National Electrical Code. The publication of the National Fire Protection Association, known as the National Electrical Code, 2020 2023 Edition, NFPA No. 70-2020 2023, is incorporated by this reference as a part of this Building Code for the purpose of establishing standards for the inspection of electrical installations and issuance of electrical permits in the County, with the following amendments: A. - No change. B. Add Section 210.52(J) to read as follows: 210.52(J) Sump Pit Receptacle Outlets. A 125 -volt, single-phase, 15- or 20 -ampere receptacle outlet shall be installed adjacent to and within 1-836" of the sump pit. This receptacle outlet shall be on a dedicated branch circuit and shall be GFCI protected. Remainder of Section — No change. PAGE 1 2024-1407 ORD2024-06 • Amend Sec. 29-2-90. International Energy Conservation Code. The publication of the International Code Council, Inc., known as the International Energy Conservation Code (IECC), 2018 2021 Edition, is incorporated by this reference as a part of this Building Code, with the following amendments: A. and B. — No change. Delete C. C Sections C109 and R109 are deleted in their entirety. Add New Sec. 29-2-95. Colorado Model Electric Ready and Solar Ready Code. The publication of the State of Colorado Enemy Office, known as the Colorado Model Electric Ready and Solar Ready Code, published June 1, 2023, is incorporated by this reference as part of this Building Code, with the following amendments: A. Section 101.1 is amended to read as follows: 101.1 This Code shall be known as the Electric Ready and Solar Ready Code of the County of Weld and shall be cited as such. It is referred to herein as "this Code". B Section 102.1.2 is amended to read as follows: 102.1.2 Weld County may authorize, upon appeal, a waiver from the requirements of this Code where, owing to a declared natural disaster that has destroyed buildings or resulted in other exceptional and extraordinary circumstances, Weld County determines that the enforcement of the provisions of this Code will result in unnecessary hardship. Section 102.2 is amended to read as follows: 102.2 Weld County may authorize, upon appeal, a waiver from the requirements of this Code to an applicant who proves by a preponderance of the evidence that compliance with this Code will result in a substantial cost differential to the applicant. Such a waiver shall be permitted only until the cost differential for compliance with the remaining requirements of this Code reach one percent or less. To meet the burden of proof, the applicant shall provide substantiation of the asserted cost differential, by quotes or other licensed design professional analyses. D Section 108.4 is amended to read as follows: 108.4 Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to fines established by Weld County. E Section 109.3 shall be amended to read as follows: The Board of Appeals shall consist of members who are qualified by experience and training and are not employees of Weld County. PAGE 2 2024-1407 ORD2024-06 Amend Sec. 29-2-95100. Uniforminternational Swimming Pool; and Spa and Hot Tub Code. The publication of the International Association of Plumbing and Mechanical Of€icia-l-s Code Council, known as the Uniforminternational Swimming Pool and Spa and Hot Tub Code (ISPSC), 2006 2018 Edition, 4, 5 and 6, is incorporated by this reference as a part of this Building Code for the purpose of providing minimum requirements and standards for the inspection of swimming pools, spas and hot tubs, and the issuance of swimming pool, spa and hot tub permits in the County._; ants; Delete A. A. References within this code to "UPC" shall be considered amended to read "-" Delete B. B. Amend Section 309.4 to read: "All pool, spa and hot tub suction outlets shall be listed Amend Sec. 29-2400105. State and (Federal rRequirements. Remainder of Section — No change. BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Municode to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid.
