RE: ACTION OF THE BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT,
USR23-0023, FOR A SOLAR ENERGY FACILITY (SEF) OUTSIDE OF SUBDIVISIONS
AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT -
THOMAS AND MARJORIE BROWN, C/O CBEP SOLAR 27, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of
October, 2023, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing
the application of Thomas and Marjorie Brown, 22509 County Road 54, Greeley, Colorado 80631,
c/o CBEP Solar 27, LLC, P.O. Box 1255, Sterling, Colorado 80751, for a Site Specific
Development Plan and Use by Special Review Permit, USR23-0023, for a Solar Energy Facility
(SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, on the
following described real estate, being more particularly described as follows:
S1/2 SE1/4 of Section 23, Township 5 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, on October 4, 2023, the Board heard all of the testimony and statements of
those present and reviewed the request of the Thomas and Marjorie Brown, c/o CBEP Solar 27,
LLC, and, having been fully informed, deemed it advisable to continue the matter to December 6,
2023, at 10:00 a.m., to allow the applicants adequate time to get a Good Neighbor Agreement
and a Crossing Agreement in place, and
WHEREAS, at said hearing on December 6, 2023, the Board heard all of the testimony
and statements of those present and reviewed the request of the applicant for a continuance and,
having been fully informed, deemed it advisable to continue the matter to January 17, 2024, at
10:00 a.m., to allow Thomas and Marjorie Brown, c/o CBEP Solar 27, LLC, additional time to get
a Good Neighbor Agreement and a Crossing Agreement in place, and
WHEREAS, at said hearing on January 17, 2023, the Board heard all of the testimony and
statements of those present and reviewed the request of the applicant for a continuance and,
having been fully informed, finds that this request be approved and the matter should be continued
to January 31, 2024, at 10:00 a.m., to allow Thomas and Marjorie Brown, c/o CBEP Solar 27,
LLC, additional time to get the Crossing Agreement finalized and signed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to January 31,
2024, at 10:00 a.m.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
