RE: RESUBDIVISION, RES24-0001, TO VACATE ROAD RIGHTS -OF -WAY PER THE MAP
OF UNION COLONY LANDS SUBDIVISION - SUNSET INDUSTRIAL, LLC
A public hearing was conducted on June 12, 2024, at 10:00 a.m., with the following present:
Commissioner Kevin D. Ross, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Mike Freeman
Commissioner Scott K. James
Commissioner Lori Saine
Also present:

County Attorney, Bruce Barker

The following business was transacted:
1 = I hereby certify that pursuant to a notice dated May 30, 2024, and duly published June 2,
2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Sunset
Industrial, LLC, for Resubdivision, RES24-0001, to vacate road rights -of -way per the map of
Union Colony Lands Subdivision. Bruce Barker, County Attorney, made this a matter of record.
Diana Aungst, Department of Planning Services, presented a brief summary of the proposal,
described the sign posting and the location of the site. She relayed ten (10) referrals were sent
out, six (6) responded with conditions or without concerns, and four (4) did not respond. She
stated the rights -of -way were created in 1891, for the subdivision of lands by Union Colony of
Colorado, the applicant has submitted a Change of Zone (COZ) to clean up a split zoning on the
property and will eventually submit a USR request. She explained the vacation of the rights -of -
way, herein described, has not and will not be utilized in the construction of roads and it is
configured in such a manner as to interfere with future development, preventing title and legal lot
issues in the future. Ms. Aungst displayed images of the site and surrounding views.
J. C. York, J & T Consulting, represented the applicant and was available to answer
questions.
El No public testimony was offered concerning this matter.
The Board reviewed the Conditions of Approval, and no changes or corrections were made.
In response to Chair Ross, Mr. York indicated, on behalf of the applicant, they have reviewed,
and agreed to abide by, the Conditions of Approval, as presented.

Ei Commissioner James moved to approve the request of Sunset Industrial, LLC, for
Resubdivision, RES24-0001, to vacate road rights -of -way per the map of Union Colony Lands
Subdivision, based on the recommendations of Planning staff, with the Conditions of Approval,
as presented. The motion was seconded by Commissioner Buck, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:16 a.m.
This Certification was approved on the 26th day of June, 2024.
