Consequences: There will not be a current MOU in place. Impacts: WCDHS will not be able to utilize the services provided by Project 1.27 regarding sharing information on precertification homes and supporting families at risk of child removal. Project 1.27 Application and Training Program This program is designed to qualify families to provide foster care or adoption services. The information in this agreement will be made available to applicable Department workers and Project 1.27 families. Orientations For the purposes of standardized foster and adoption qualification, it is agreed that Project 1.27 Parent Orientations meet all requirements of the State and the Department. Foster and Adoptive Parent Training In compliance with the Colorado Child Welfare Practice Handbook, all competencies for foster and adoptive parent certification will be met. At a minimum, each Project 1.27 family will complete the following training prior to endorsement by Project 1.27 and certification by the Department: a) Project 1.27 Parent Orientation b) Foster Parent Core Curriculum c) Project 1.27 Core Curriculum d) Support Team Training e) CPR/First Aid Hours 2.0 12.0 12.0 4.0 8.0 Total 38.0 0202 - Project 1.27 training will be conducted in a church host facility and may also be monitored by the Department. This training qualifies and meets all requirements of the State of Colorado and said Department for the purpose of foster care certification and the adoption of children moving towards adoption. Family's Transition to the Department The Project 1.27 office will assemble packets that include the application material and training certificates and endorse the packet's completeness with a letter on Project 1.27 letterhead. Families without this letter will not be recognized as a Project 1.27 family. Project 1.27 families will then submit their packets to the Department with the intent of a six (6) month commitment to the Department after their home study is completed. The Department may require screening interviews prior to receiving the family packet for processing. After the six (6) month time period, if not satisfied, the family may elect to transfer their paperwork to a Colorado county or to a Child Placement Agency (CPA) with the full cooperation of the Department. Home Study Charges Project 1.27 families will not be charged for their home studies when performed by the Department or an independent contractor retained by the Department. If a Project 1.27 family requests that their home study be transferred to another Agency prior to the original Department's contractual time frame, the Project 1.27 family may be required to pay the Department for the home study. Child Placement Process An approved home study does not guarantee placement of a specific child or any child. The goal of the Department is to make the best match for each child. That decision is made by the Department staff, attorneys and ultimately, the Court. 2. FamiliesCare Program This program is a collaborative effort between Project 1.27, the Department, and local churches to strengthen families in Weld County who are at risk of child removal as well as families that are recently reunified. Project 1.27 will recruit, train, and provide ongoing support to churches overseeing FamiliesCare groups to come alongside parents. Some of the types of support that Care Groups may provide are: a) Fresh meals b) Groceries c) Rides to a local food pantry d) Job leads e) Home fix -it projects f) Occasional childcare Project 1.27's objectives for FamiliesCare are: a) Recruit three (3) to ten (10) churches in Weld County b) Train thirty (30) church Care Groups in Weld County c) Connect thirty (30) at -risk families to Care Groups in Weld County d) Research and utilize assessment tools to evaluate the program Qualifying families that are interested will be referred by the Department to participate in the FamiliesCare program. Information Sharing. It is agreed that Project 1.27 families and our staff can share limited case information in the process of recruitment and the provision of on -going support. Modifications. This Agreement may be modified in writing, in whole or in part, upon approval of the signers. Termination. This Agreement may be terminated at any time by either party giving thirty (30) days written notice to the signers. No portion of this MOU shall be deemed to create an obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise appropriated, as this MOU is subject to the availability of funding. Therefore, the Department may terminate this MOU at any time if the source of funding for the services made available to Project 1.27 is no longer available to the Department, or for any other reason. Project 1.27 reserves the right to suspend services to clients if funding is no longer available. Entire Agreement. This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Project 1.27 and the Department may not assign any of its rights or obligations hereunder without the prior consent of both parties. No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. Governmental Immunity. No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections, or other provisions, of the Colorado Governmental Immunity Act &&24-10-101 et seq., as applicable now or hereafter amended. Independent Contractor. Project 1.27 agrees that it is an Independent Contractor and that the Project 1.27's officers, agents or employees will not become employees of the Department, nor entitled to any employee benefits from the Department as a result of the execution of this MOU. Project 1.27 shall perform its duties hereunder as an Independent Contractor. Project 1.27 shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this MOU. Project 1.27, its employees, and agents are not entitled to unemployment insurance or workers' compensation benefits through the Department and the Department shall not pay for or otherwise provide such coverage for Project 1.27 or any of its agents or employees. Unemployment insurance benefits will be available to Project 1.27 and its employees and agents only if such coverage is made available by Project 1.27 or a third party. Project 1.27 shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. Severability. If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties.
