Introduction AquaSan Network, Inc. has conducted a water impact analysis for the nonresidential development located on parcel numbers 147129200115 ("Parcel A") and 147129200116 ('`Parcel B," collectively the "Project"), in Brighton, CO, to assess the current water assets associated with the Project and their ability to serve the nonresidential buildings at their complete buildout and occupancy. In evaluating water usage data representative of the Project, a meta -analysis was performed examining water usage for domestic industrial end users. The information presented in this analysis reviews the water demands expected at the Project and the ability of the current water assets to serve these intended end uses. AOUASAN 2. Project Overview 2.1. Project Buildout According to the information provided by the development team, the Project consists of three (3) 12,000 square foot industrial office and storage buildings and one (1) 1,500 square foot industrial office and storage building. The Project buildout being evaluated for water demands, broken out by parcel, is detailed in Figures 2.1a. — 2.1d. Figure 2.1a. Water Assets Overview 3.1. Active Water Wells Two active water wells located in Denver Basin's Lower Arapahoe aquifer currently serve the Project: Well Permit Number ("WPN") 300257 and WPN 290696. WPN 300257, issued February 25, 2016, and constructed June 28, 2016, is a commercial exempt well serving Parcel A. According to the Colorado Division of Water Resources ("CDWR"), Exempt wells are those wells authorized by statute to operate outside of Colorado's water right priority system. Exempt wells can only supply certain limited uses, including residential, irrigation of home lawn and gardens, the watering of domestic animals/livestock, and drinking and sanitary purposes inside a commercial business. 1 As exempt wells do not operate within Colorado's water right priority system, they generally do not require an augmentation plan as usage from the well causes no material injury to existing water rights. Currently, WPN 300257 is permitted to provide water for drinking and sanitation within a commercial business for Parcel A, which allows for multiple commercial buildings and structures so long as ownership of the buildings remains under a single owner who is also listed as the well owner. This is described in the CDWR's Policy 1985-1 "Concerning the Evaluation of Well Permit Applications for Exempt Commercial Uses (Amended)," which states, The use of the water diverted is limited to drinking and sanitary facilities only in an individual commercial business. For the purposes of this Policy, an office building or shopping center containing multiple tenants may be considered an individual commercial business. In addition, an individual commercial business may have multiple buildings/structures with drinking and sanitary facilities supplied by the well.' Lastly, because WPN 300257 was put to use on or after May 8, 1972, its total annual water demand is limited to one third of an acre-foot per year, or 108,600 gallons per year. The General Purpose Water Well Permit Application and Well Construction and Test Report detail the well requirements described above and have been attached as Exhibits 1A and 1B respectively. WPN 300257 was confirmed valid, operational, and being used within its defined limitations with the CDWR as of September 13, 2024. WPN 290696, issued March 29, 2013, and constructed June 6, 2014, is a commercial exempt well serving Parcel B. WPN 290696 is also permitted to provide water for drinking and sanitation within a commercial business and is limited to 108,600 gallons per year. The General Purpose Water Well Permit Application and Well Construction and Test Report have been attached as Exhibits 2A and 2B respectively. WPN 290696 was confirmed valid, operational, and being used within its defined limitations with the CDWR as of September 13, 2024. 3.2. Potential Additional Water Resources Available The CDWR database indicates potential additional water assets that may be available to the Project, which include: Parcel A - Legal Description: 5.95 acres in the NW 1/4 of NW 1/4 of Section 29, Township 1N, Range 66W - Non -Tributary Water: 1.5 acre-feet located in the Laramie -Fox Hills aquifer - Not Non -Tributary Water: 1.0 acre-feet located in the Lower Arapahoe aquifer Parcel B - Legal Description: 6.97 acres in the SW 1/4 of NW 1/4 of Section 29, Township 1N, Range 66W - Non -Tributary Water: 1.8 acre-feet located in the Laramie -Fox Hills aquifer - Not Non -Tributary Water: 1.1 acre-feet located in the Lower Arapahoe aquifer ' https://dwr.colorado.gov/services/well-permitting 2 Colorado Division or Water Resources. Groundwater from the Laramie -Fox Hills aquifer on both Parcels A and B is considered non -tributary and totals 3.3 acre-feet. Not non -tributary ground water is considered hydrologically connected to surface water and withdrawals of this type of groundwater require an augmentation plan, which authorizes out of priority diversions for beneficial use as long as replacement water is made available to replenish senior vested water rights,or requires a minimum of four percent of the water be returned to surface streams. Groundwater from the Lower Arapahoe aquifer on both Parcels A and B is considered not non -tributary and totals 2.1 acre-feet. The CDWR Bedrock Aquifer Evaluation Determination Report detailing the above information has been attached as Exhibits 3A and Exhibit 3B for Parcel A and Parcel B respectively. Nonresidential Domestic Water Consumption To determine the water usage expected at the nonresidential buildings at the Project and ensure the water assets associated with the property are sufficient to meet their demands, a meta -analysis was conducted on data collected from 9,000 domestic industrial end users and published in the Energy Information Administrations' ("Elk') analysis, 2012 Commercial Buildings Energy Consumption Survey: Water Consumption in Large Buildings Summary. Conclusion 5.1. Water Asset Availability to Serve Project Based on the data collected and evaluated in this Water Impact Analysis, Parcel A, which is allocated 108,600 gallons per year (see: WPN 300257), is expected to have an annual water consumption of 93,840 gallons per year. This indicates that Parcel A will use 86.4% of its annual water allotment and have a surplus of approximately 15,000 gallons. Likewise, Parcel B, which is allocated 108,600 gallons per year (see: WPN 290696), is expected to have an annual water consumption of 52,785 gallons per year. Parcel B is anticipated to use 48.6% of if annual water allotment, with a surplus of approximately 56,000 gallons. A summary of these water allocations and the resulting water surplus is shown in Figure 5.1a. Figure 5.1a. A Water Efficiency Program ("WEP"), such as the one provided in Appendix 1, can work to reduce the annual water consumption at the Project. A WEP can achieve significant water savings by utilizing low -flow fixtures, water management techniques, and implementing the potential use of recycled water for water closets or clothes washers. The strategies outlined in Appendix 1 can result in a reduction between 20% - 45% in annual water consumption, which would expand the surplus that already exists in the water wells. Lastly, the potential availability of non -tributary ground water in the Laramie -Fox Hills aquifer below the Project suggests additional commercial exempt wells can be constructed and utilized without an augmentation plan. If the Project chooses to utilize the potential availability of not non -tributary ground water in the Lower Arapahoe aquifer, or would like to reclassify their permitted water usage, an augmentation plan would be required. In conclusion, the current well permits and annual demands indicate the Project possess the necessary water assets to sufficiently serve its nonresidential development as it has been for the past 8-10 years. Moreover, there is a projected annual surplus of nearly 70,575 gallons, which accounts for approximately 32% of the Project's permitted water resources. Implementing water efficiency strategies, permitting new commercial exempt water wells, or providing an augmentation plan are all solutions available to the Project to increase its water allotment if required.
