1. Introduction
AquaSan Network, Inc. has conducted a water impact analysis for the nonresidential development located on parcel
numbers 147129200115 ("Parcel A") and 147129200116 ('`Parcel B," collectively the "Project"), in Brighton, CO, to
assess the current water assets associated with the Project and their ability to serve the nonresidential buildings at
their complete buildout and occupancy. In evaluating water usage data representative of the Project, a meta -analysis
was performed examining water usage for domestic industrial end users. The information presented in this analysis
reviews the water demands expected at the Project and the ability of the current water assets to serve these intended
end uses.

2.1. Project Buildout
According to the information provided by the development team, the Project consists of three (3) 12,000 square foot
industrial office and storage buildings and one (1) 1,500 square foot industrial office and storage building. The Project
buildout being evaluated for water demands, broken out by parcel, is detailed in Figures 2.1a. — 2.1d.

3. Water Assets Overview
3.1. Active Water Wells
Two active water wells located in Denver Basin's Lower Arapahoe aquifer currently serve the Project: Well Permit
Number ("WPN") 300257 and WPN 290696.
WPN 300257, issued February 25, 2016, and constructed June 28, 2016, is a commercial exempt well serving Parcel
A. According to the Colorado Division of Water Resources ("CDWR"),
Exempt wells are those wells authorized by statute to operate outside of Colorado's water right
priority system. Exempt wells can only supply certain limited uses, including residential, irrigation
of home lawn and gardens, the watering of domestic animals/livestock, and drinking and sanitary
purposes inside a commercial business. 1
As exempt wells do not operate within Colorado's water right priority system, they generally do not require an
augmentation plan as usage from the well causes no material injury to existing water rights. Currently, WPN 300257
is permitted to provide water for drinking and sanitation within a commercial business for Parcel A, which allows for
multiple commercial buildings and structures so long as ownership of the buildings remains under a single owner
who is also listed as the well owner. This is described in the CDWR's Policy 1985-1 "Concerning the Evaluation of
Well Permit Applications for Exempt Commercial Uses (Amended)," which states,
The use of the water diverted is limited to drinking and sanitary facilities only in an individual
commercial business. For the purposes of this Policy, an office building or shopping center
containing multiple tenants may be considered an individual commercial business. In addition, an
individual commercial business may have multiple buildings/structures with drinking and sanitary
facilities supplied by the well.'
Lastly, because WPN 300257 was put to use on or after May 8, 1972, its total annual water demand is limited to one
third of an acre-foot per year, or 108,600 gallons per year. The General Purpose Water Well Permit Application and
Well Construction and Test Report detail the well requirements described above and have been attached as Exhibits
1A and 1B respectively. WPN 300257 was confirmed valid, operational, and being used within its defined limitations
with the CDWR as of September 13, 2024.
WPN 290696, issued March 29, 2013, and constructed June 6, 2014, is a commercial exempt well serving Parcel B.
WPN 290696 is also permitted to provide water for drinking and sanitation within a commercial business and is limited
to 108,600 gallons per year. The General Purpose Water Well Permit Application and Well Construction and Test
Report have been attached as Exhibits 2A and 2B respectively. WPN 290696 was confirmed valid, operational, and
being used within its defined limitations with the CDWR as of September 13, 2024.
3.2. Potential Additional Water Resources Available
The CDWR database indicates potential additional water assets that may be available to the Project, which include:
Parcel A
- Legal Description: 5.95 acres in the NW 1/4 of NW 1/4 of Section 29, Township 1N, Range 66W
- Non -Tributary Water: 1.5 acre-feet located in the Laramie -Fox Hills aquifer
- Not Non -Tributary Water: 1.0 acre-feet located in the Lower Arapahoe aquifer

- Legal Description: 6.97 acres in the SW 1/4 of NW 1/4 of Section 29, Township 1N, Range 66W
- Non -Tributary Water: 1.8 acre-feet located in the Laramie -Fox Hills aquifer
- Not Non -Tributary Water: 1.1 acre-feet located in the Lower Arapahoe aquifer

Non -tributary ground water is considered insignificantly hydrologically connected with a tributary (surface) water
system and, therefore, often does not require an augmentation plan as the withdrawals of ground water from this
source are not expected to deplete surface water more than one -tenth of one percent (0.10%) over 100 years.
Groundwater from the Laramie -Fox Hills aquifer on both Parcels A and B is considered non -tributary and totals 3.3
acre-feet.
Not non -tributary ground water is considered hydrologically connected to surface water and withdrawals of this type

4. Water Consumption Analysis
4.1. Nonresidential Domestic Water Consumption
To determine the water usage expected at the nonresidential buildings at the Project and ensure the water assets
associated with the property are sufficient to meet their demands, a meta -analysis was conducted on data collected
from 9,000 domestic industrial end users and published in the Energy Information Administrations' ("Elk') analysis,
2012 Commercial Buildings Energy Consumption Survey: Water Consumption in Large Buildings Summary.
Figure 4.1a. demonstrates the observed gallons per square foot per year ("GSFY") for domestic industrial end uses,
and their associated percentiles collected from the study:

To project the annual water usage for the Project under a conservative approach, the 95th percentile was utilized by
estimating the mean and standard deviation assuming a normal distribution, which is graphically represented in
Figures 4.2a and 4.2b.

5. Conclusion
5.1. Water Asset Availability to Serve Project
Based on the data collected and evaluated in this Water Impact Analysis, Parcel A, which is allocated 108,600 gallons
per year (see: WPN 300257), is expected to have an annual water consumption of 93,840 gallons per year. This
indicates that Parcel A will use 86.4% of its annual water allotment and have a surplus of approximately 15,000
gallons. Likewise, Parcel B, which is allocated 108,600 gallons per year (see: WPN 290696), is expected to have an
annual water consumption of 52,785 gallons per year. Parcel B is anticipated to use 48.6% of if annual water
allotment, with a surplus of approximately 56,000 gallons. A summary of these water allocations and the resulting
water surplus is shown in Figure 5.1a.

Furthermore, these calculations assume a system that utilizes standard or inefficient fixtures by applying GSFY
values observed at the 95th percentile. A Water Efficiency Program ("WEP"), such as the one provided in Appendix
1, can work to reduce the annual water consumption at the Project. A WEP can achieve significant water savings by
utilizing low -flow fixtures, water management techniques, and implementing the potential use of recycled water for
water closets or clothes washers. The strategies outlined in Appendix 1 can result in a reduction between 20% - 45%
in annual water consumption, which would expand the surplus that already exists in the water wells.
Lastly, the potential availability of non -tributary ground water in the Laramie -Fox Hills aquifer below the Project
suggests additional commercial exempt wells can be constructed and utilized without an augmentation plan. If the
Project chooses to utilize the potential availability of not non -tributary ground water in the Lower Arapahoe aquifer,
or would like to reclassify their permitted water usage, an augmentation plan would be required.
In conclusion, the current well permits and annual demands indicate the Project possess the necessary water assets
to sufficiently serve its nonresidential development as it has been for the past 8-10 years. Moreover, there is a
projected annual surplus of nearly 70,575 gallons, which accounts for approximately 32% of the Project's permitted
water resources. Implementing water efficiency strategies, permitting new commercial exempt water wells, or
providing an augmentation plan are all solutions available to the Project to increase its water allotment if required.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not ensure that
no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and the policy of the State Engineer dated 4/9/85 for appropriation of ground water tributary to
the South Platte River system.
4) The well constructed under permit no. 261608 must be plugged in accordance with Rule 16 of the Water Well Construction Rules within
ninety-one (91) days of completion of this well. The enclosed Well Abandonment Report form must be completed and submitted to affirm that
the old well was plugged.
5) The issuance of this permit hereby cancels permit nos. 261608 and 261608-A.
6) Approved as the only well on a tract of land of 5.95 acre(s) described as Lot B, Recorded Exemption No. 1471-29-2 RE3660, Weld County,
reference attached exhibit "A".
7) The use of ground water from this well is limited to drinking and sanitary facilities as described in CRS 37-92-602(1)(c), for a commercial
business. Water from this well shall not be used for lawn/landscape/greenhouse irrigation, domestic animal/livestock watering, or for any other
purpose outside the business building structure(s).
8) The total depth of the well shall not exceed 305 feet, which corresponds to the base of the Lower Arapahoe aquifer. At a minimum, plain
casing shall be installed and grouted through all unconsolidated materials and shall extend a minimum of ten feet into the bedrock formation
to prevent production from other zones.
9) The pumping rate of this well shall not exceed 15 GPM.
10) The annual amount of ground water to be diverted by this well shall not exceed 1/3 acre-foot (108,600 gallons).
11) The return flow from the use of this well must be through an individual waste water disposal system of the non -evaporative type where the
water is returned to the same stream system in which the well is located. The maximum consumptive use of ground water shall not exceed 10
percent.
12) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be
maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
13) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTE: To ensure a maximum productive life of this well, perforated casing should be set through the entire producing interval of the
approved zone or aquifer indicated above.
NOTE: This permit will expire on the expiration date unless the well is constructed by that date. A Well Construction and Test Report
(GWS-31) must be submitted to the Division of Water Resources to verify the well has been constructed. An extension of the expiration date

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and the policy of the State Engineer dated 4/23/86 under the following
conditions.
4) The use of ground water from this well is limited to drinking and sanitary facilities as described in CRS 37-92-602(1)(c),
for a commercial business. Water from this well shall not be used for lawn or landscape irrigation or for any other purpose
outside the business building structure.
5) Production from this well is restricted to the Lower Arapahoe aquifer, which corresponds to the interval between 60 feet
and 350 feet below the ground surface. Plain casing shall be installed and grouted to prevent production from other zones.
6) The pumping rate of this well shall not exceed 15 GPM.
7) The annual amount of ground water to be withdrawn shall not exceed 0.33 acre-feet (108,600 gallons), as applied for.
8) Approved as the only well on a tract of land of 6.97 acre(s) described as a portion of the NW 1/4, Section 29, Twp. 1 North,
Rng. 66 West, 6th P.M., Weld County, reference attached exhibit "A".
9) The return flow from the use of this well must be through an individual waste water disposal system of the type so that not
less than 4% of the total amount of water withdrawn is returned to the same stream system in which the well is located.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
11) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTE: To ensure a maximum productive life of this well, perforated casing should be set through the entire q cing
interval of the approved zone or aquifer indicated above. t•3

We have received additional information provided by the Applicant's consultant on the referral
regarding the above -referenced change of zone application from Agricultural (A) to Medium Industrial
(I-2) use for two parcels (parcel nos. 147129200115 and 147129200116) of approximately 13 acres
total located in the NW '/4 of Sec. 29, Twp. 1 North, Rng. 66 West, 6th P.M. The comments in this
letter supersede the comments from July 22, 2024 letter.
This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums
to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the
water supply plan for this project or the ability of the water supply plan to satisfy any County
regulations or requirements. In addition, the comments provided herein cannot be used to
guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical
availability of water.
The proposed water source is from well permit nos. 290696 and 300257 issued for the subject
properties. According to the additional information provided, the Applicant's consultant clarified
that the change in zone application will not change the use of well permit nos. 290696 and 300257
from commercial to industrial and therefore these wells will continue to be used for their permitted
commercial exempt uses of drinking and sanitary facilities for a commercial business and an annual
amount to be withdrawn of 0.33 acre-feet from the not nontributary Lower Arapahoe aquifer.
Based on the above, so long as the wells operating under permit nos. 290696 and 300257 are being
used in compliance with their permitted conditions, this office has no comments on the water supply
for this referral.
