RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZONING PERMIT, ZPAG23-0003, FOR CERTAIN USES AGRICULTURAL SUPPORT AND SERVICE (TRUCKING COMPANY PRINCIPALLY ENGAGED IN THE HAULING OF AGRICULTURAL PRODUCTS) OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - ROGER AND SHERYL HILL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 17, 2023, the Department of Planning Services conditionally approved the application of Roger and Sheryl Hill, 25056 County Road 76, Eaton, Colorado 80615, for a Zoning Permit, ZPAG23-0003, for certain uses Agricultural Support and Service (trucking company principally engaged in the hauling of agricultural products) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, for the parcels of land located on the following described real estate, to -wit: Lot A of Recorded Exemption, RE -2282; being part of the NW1/4 NW1/4 of Section 32, Township 7 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, Section 23-4-1200.C of the Weld County Code requires the applicant meet the Conditions of Approval outlined in Zoning Permit, ZPAG23-0003, including recording the Zoning Permit map within 90 days of approval, and WHEREAS, a hearing before the Board was held on the 23rd day of October, 2024, at which time the Board deemed it advisable to continue said matter to December 18, 2024, to allow Roger and Sheryl Hill adequate time to complete the Conditions of Approval. C. of the Weld County Code, a revocation hearing is requested before the Board of County Commissioners. Summary: Zoning Permit, ZPAG23-0003, was approved administratively on July 17, 2023 for a trucking company principally engaged in the hauling of agricultural products. The site is located approximately one mile north of Galeton on the intersection of CR 76 and CR 51. The property is privately owned by Roger and Sheryl Hill and the reside in the residence and operate the trucking business from this site. There are five (5) Condition of Approval including a submittal of a Change of Use building permit for the maintenance shop that are all outstanding. Conditions of Approval as listed in ZPAG23-0003: A. The applicant shall acknowledge the comments of the Oil and Gas Energy Department, as stated in the referral response dated June 20, 2023. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. B. The applicant shall limit the number of semi -trailers used exclusively for storage to two (2) in accordance with Section 23-3-30.G. C. The applicant shall limit the number of cargo containers to two (2) in accordance with Section 23-3-30.G. D. The applicant shall submit a Change of Use building permit application for the 2,400 square foot pole frame. The Zoning Permit map shall be submitted for review and approval. Item number 3 of the staff report, quoting Section 23-4-1200.C., states: "If the required documents have not been recorded within ninety (90) days from the date of approval or if an applicant is unwilling or unable to meet any of the conditions within ninety (90) days of approval, the Director of Planning Services may refer the application to the Board of County Commissioners, which may revoke the zoning permit following a public hearing. The applicant shall be notified of the public hearing at least ten (10) days prior to the hearing. Prior to said hearing, the Director of Planning Services may grant a one-time extension of up to ninety (90) days, for good cause shown, upon a written request by the applicant. Before this extension has expired, the applicant may seek a further extension from the Board of County ZPAG23-0003 I Hill Page 1 of 4 Commissioners by written request to the Director of Planning. If the Board of County Commissioners denies the extension or if the conditions are not met and the required documents recorded by the date specified by the Board, the zoning permit approval shall be voided, and the application denied." The applicant built a 2,400 square foot personal storage building in June of 2003. The trucking operations on the site have been in violation between October of 2012 and October of 2024 with an eight (8) month period where USR16- 0003 was recorded and active. On August 9, 2017, USR16-0003 was revoked by the Board of County Commissioners via a Show Cause hearing. The application materials for this Zoning Permit (ZPAG23-0003) state that, "There are two existing structures on the property which include an existing single-family residence and a commercial maintenance shop. There is one proposed structure, which includes a 70'x17' lean-to." Staff a requested clarification on the uses in the `commercial maintenance shop'. The response from the applicant stated. "The maintenance shop is a shared space used for maintaining the trucks and personal vehicles." Since the shop was permitted June 23, 2003 as a pole frame storage shed for personal storage, a Change of Use building permit is required in order to utilize the shop for maintenance on the trucks. Per a site visit on July 26, 2024 it was noted that a new lean-to building was built on the site. No building permit is on file for this new lean-to structure. Staff has requested, on multiple occasions, that the applicant complete the Conditions of Approval, however, no action has been taken by the applicant. Per Chapter 23, Article IV, Section 23-4-1200.C., if the applicant is unwilling or unable to meet the conditions the Board of County Commissioners may revoke the zoning permit following a public hearing. As of October 14, 2024, no building permits have been submitted. The courses of action available to the applicant to complete this ZPAG: 1. Apply for a building permit for the lean-to structure. and 2. Withdrawal of the ZPAG and reduce the number of trucks to one. OR 3. Apply for a building permit for the lean-to structure. and 4. Address all five (5) Conditions of Approval per ZPAG23-0003. Due to the applicant being unwilling or unable to meet the conditions of approval the Director of Planning Services, per Section 23-4-1200.C., is referring this case to the Board of County Commissioners to consider a revocation of this case. This ZPAG23-0003 was sent to the Clerk to the Board for scheduling. ZCV21-00356 the Board of County Commissioners certified $47,800 of penalties due to the violation operating on the site. The owner stopped by the Department of Planning Services and staff provided the application forms required to complete a Change of Use for the shop. Other options were discussed with the owner including reducing the numbers of trucks to one or ceasing all commercial activities. A certified letter was sent to the applicant re -stating the language in Section 23-4-1200.C. and stated that this ZPAG will be presented to the Board of County Commissioners on October 23, 2024 for possible revocation. The hours of operation are proposed to be 8:00 a.m. — 8:00 p.m. Monday - Sunday. There are no employees the trucks are driven by the owner of the business and other family members that also live in the same residence as the owner. There are four (4) semi -trucks (cab and trailer). The business is not open to the public. ZPAG22-0003 I Hill Page 1 of 8 The existing structures include a residence, 1,728 square feet in size built in 1999 (PR -9930307). BCN- 030254 was issued in 2004 for 2,400 square foot pole frame for personal storage. The application materials state that this 2,400 square foot building is a garage -maintenance shop. Utilizing this building for the business requires a Change of Use building permit to be submitted to the Department of Planning Services. The applicant is proposing to build a new 1,960 square foot lean to. Two (2) building permits were issued for the cargo containers on the site (ASN 18-0054 and ASN18-0055). No additional cargo containers shall be added to the site. The cargo containers are required to be screened and shall not be utilized as part of the fence. The number of semi -trailers shall be no more than two (2). A Screening Plan in the form of a nine (9) -foot tall solid metal privacy fence. There is a six (6) -foot metal fence that surrounds a portion of the property. This six (6) -foot metal fence is proposed to be raised to nine (9) feet in height This fence is proposed to shield the truck parking and outdoor storage including the cargo containers and the semi -trailers. This is an active Code Violation (ZCV21-00356). This violation was initiated due to the presence of multiple commercial vehicles, noncommercial junkyard consisting of derelict vehicles without first completing the necessary Weld County Zoning Permits and/or Building Permits. This case has been forwarded to the County Attorney's Office and is currently accumulating a daily penalty fee of $100.00. Approval of this ZPAG application and completion of all Conditions of Approval, recording the final ZPAG map and submittal shall correct the violation. if this application is denied, the case will continue through the County Court process until the property has reached compliance. The De rtment of Planning Services approves the ZPAG for the following reasons 1. The submitted materials are in compliance with the application requirements of Section 23-4-1220 of the Weld County Code. 2. The proposed request is in compliance with the ZPAG Criteria requirements of Section 23-4-1200 of the Weld County Code. Pertinent processing information includes: A. Section 23-4-1200.A.3. -- The proposed use is compatible with applicable provisions of Chapter 22, of this Code. Section 22-2-30-A.1. Land use changes should not inhibit agricultural production nor operations. No agricultural production is affected by the proposal. B. Section 23-4-1200.A.2. -- The application complies or will comply with the design standards in Section 23-4-1205 and the conditions in Section 23-4-1240. Specifically: Section 23-4-1205.A. -- Adequate water service in terms of quality, quantity, and dependability is available to the site to serve the USES permitted. According to the referral agency comments from the Department of Public Health and Environment, dated June 8, 2023, the existing residence is served by North Weld County Water District and an on -site wastewater treatment system permitted for three (3) bedrooms #SP -9900498. C. Section 23-4-1200.A.4. -- The proposed use is compatible with the character of the neighborhood. Amended USR-1133 for a 9,000 head dairy is located to the north of the site and the surrounding lands to the south, east and west are production agricultural. This proposed permit is for a trucking business that hauls agricultural products. This ZPAG supports the existing agricultural land uses. Three (3) surrounding property owners were notified of the request and no responses were received ZPAG22-0003 I Hill Page 2of8 3. The proposed request is in compliance with the Operation Standards requirements of Section 23-4- 1210 of the Weld County Code. Pertinent processing information includes: A. Section 23-4-1210.G. — Up to nine (9) commercial vehicles associated with the zoning permit use shall be allowed to be parked on -site. There are four (4) semi -trucks (cab and trailer). This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to recording the map: A. The applicant shall acknowledge the comments of the Oil and Gas Energy Department, as stated in the referral response dated June 20, 2023. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. B. The applicant shall limit the number of semi -trailers used exclusively for storage to two (2) in accordance with Section 23-3-30.G. C. The applicant shall limit the number of cargo containers to two (2) in accordance with Section 23- 3-30.G. D. The applicant shall submit a Change of Use building permit application for the 2,400 square foot pole frame. E. The Zoning Permit Plan shall be amended to delineate the following: 1. All sheets of the plan shall be labeled: ZPAG23-0003 2. The attached Development Standards. 3. Existing and proposed structures and approximate distances to the nearest property lines. All structures to be used in conjunction with the zoning permit shall meet current setbacks and offsets. 4. Existing and proposed cargo containers and semi -trailers. 5. Existing and proposed parking areas, including surface material, number, and dimensions of spaces and drive aisles. Parking shall comply with Article IV, Division 1, of this Chapter as applicable. 6. Existing and proposed signage. All signage shall comply with Article IV, Division 2, of the Weld County Code, as applicable. 7. The proposed Screening Plan. 8. Other existing and proposed improvements. 9. The Zoning Permit Plan shall bear the certifications per Section 23-4-1220.C.6. of the Weld County Code. Do not include the Board of County Commissioners certification. 10. County Road 76 is a gravel road and is designated on the Weld County Functional Classification Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. ZPAG22-0003 I Hill Page 3 of 8 11. County Road 51 is a paved road and is designated on the Weld County Functional Classification Map as a collector road which requires 80 feet of right-of-way at full buildout. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. 12. Show and label the permitted access location, appropriate access width, and the appropriate turning radii on the site plan. 13. Show and label the drainage flow arrows. 14 Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. The applicant shall submit one (1) electronic copy (.pdf) of the plan for preliminary approval to the Weld County Department of Planning Services. Upon approval of the plan the applicant shall submit a Mylar plan along with all other documentation required as Conditions of Approval to the Department of Planning Services. The Mylar plan shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services prior to commencement of the use or construction The applicant shall pay the recording fee. If the required documents have not been recorded within ninety (90) days from the date of approval or if an applicant is unwilling or unable to meet any of the conditions within ninety (90) days of approval, the Director of Planning Services may refer the application to the Board of County Commissioners, which may revoke the zoning permit following a public hearing. The applicant shall be notified of the public hearing at least ten (10) days prior to the hearing. Prior to said hearing, the Director of Planning Services may grant a one-time extension of up to ninety (90) days, for good cause shown, upon a written request by the applicant. Before this extension has expired, the applicant may seek a further extension from the Board of County Commissioners by written request to the Director of Planning. If the Board of County Commissioners denies the extension or if the conditions are not met and the required documents recorded by the date specified by the Board, the zoning permit approval shall be voided, and the application denied. In accordance with Appendix 5-J of the Weld County Code, should the map not be recorded within the specified timeline from the date the administrative review was signed, a $50.00 recording continuance fee shall be added for each additional 3 -month period. 5 The Zoning Permit for Certain Uses in the Agricultural Zone District is not perfected until the Conditions of Approval are completed and the map is recorded. Activity shall not occur, nor shall any building or electrical permits be issued on the property, until the Zoning Permit for Certain Uses in the Agricultural Zone District plan is ready to be recorded in the office of the Weld County Clerk and Recorder or the applicant has been approved for an early release agreement. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. 3. The hours of operation shall be 8:00 a.m. — 8:00 p.m. Monday — Sunday. 4. There are no employees. The truck drivers shall be limited to family. 5. The number of on -site trucks shall be no more than four (4). 6. The truck parking area shall be screened. 7. The semi -trailers and cargo containers shall be screened. 8 The parking area on the site shall be maintained. 9. All signs shall adhere to Chapter 23, Article IV, Division 2 of the Weld County Code. 10. The screening on the site shall be maintained in accordance with the approved Screening Plan. 11. Sources of light shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties in accordance with the plan. Neither the direct, nor reflected, light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. No colored lights may be used which may be confused with, or construed as, traffic control devices. 12. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 13. Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. 14. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 15. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review) 16. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 17. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 18. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code, and the accepted waste handling Ian p 19. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. ZPAG22-0003 J Hill Page 5 of 8 20. Adequate drinking, hand washing, and toilet facilities shall be provided for employees, at all times. A permanent, adequate water supply shall be provided for drinking and sanitary purposes 21. Any On -site Wastewater Treatment system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 22. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 23. All buildings shall comply with the setback from oil and gas wells per Section 23-4-700, as amended. 24 Building permits shall be required for any new construction or set up manufactured structure, per Section 29-3-10 of the Weld County Code. A building permit application must be completed and submitted. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently, the following have been adopted by Weld County: 2018 International Building Codes, 2018 International Energy Code, 2020 National Electrical Code, and Chapter 29 of the Weld County Code. A Building Permit Application must be completed and two (2) complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A plan review shall be approved, and a building permit must be issued prior to the start of construction. The property owner or operator shall be responsible for complying with the Design and Operation Standards of Chapter 23 of the Weld County Code. A Geotechnical Engineering Report, performed by a Colorado registered engineer, shall be required or an Open Hole Inspection. 25. Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Facility Fee, County -Wide Road Impact Fee, and Drainage Impact Fee Programs. 26. The property owner or operator shall be responsible for complying with the Design and Operation Standards of Chapter 23 of the Weld County Code. 27. The Zoning Permit area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Changes from the plans or Development Standards, as shown or stated, require the written approval of an amendment of the Permit by the Weld County Planning Services Department before such changes from the plans or Development Standards are permitted. A revised map may be required to be submitted, approved, and recorded. 28. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 29. The property owner, operator or successor shall be responsible for acknowledging and complying with Section 23-4-1240 of the Weld County Code. 30. Construction or use pursuant to issuance of a zoning permit shall be commenced within three (3) years from the date of approval of the permit. A one-time extension of one hundred twenty (120) days may be granted by the Department of Planning Services for good cause shown by written request. Before this extension has expired, the applicant may seek a further extension from the Board of County Commissioners by written request to the Director of Planning Services. If the Board of County Commissioners denies the extension or if construction has not commenced by the date specified by the Board, the zoning permit approval shall be voided, and the application denied. 31 Any zoning permit may be revoked by the Board of County Commissioners for violation of any of the terms of this Division 17 or conditions of approval of the zoning permit following a Probable Cause Hearing as outlined in Section 2-4-40 of this Code. If the zoning permit is revoked, the property owner shall cease operation of the use immediately. Continued operation of the use after a zoning permit has been revoked shall be a violation of this Code. 32. The Director of Planning Services may revoke a zoning permit if the use is discontinued for a period of three (3) consecutive years. Should the Department of Planning Services observe or receive credible evidence of such a discontinuance, the Department shall notify the property owner by first-class mail. If the property owner objects to the revocation of the zoning permit within thirty (30) days, the Director ZPAG22-0003 I Hill Page 6of8 of Planning Services may schedule a public hearing before the Board of County Commissioners for its review and decision. The applicant shall be notified of the public hearing at least ten (10) days prior to the hearing. 33. The Department of Planning Services may permit minor amendments to an approved zoning permit without a complete application for a new zoning permit, notification to surrounding property owners, or referral to agencies. The applicant shall provide a written summary of the proposed amendment(s) and any other documentation required by the Department of Planning Services. An increase of ten (10) percent or more in impervious surface area or an increase of ten (10) percent or more in traffic shall not be considered a minor amendment. If the Director of Planning Services determines the proposed amendment does not qualify as a minor amendment, the proposed amendment shall require a new zoning permit 34, RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the state's commercial mineral deposits are essential to the state's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and people moving into these areas must recognize the various impacts associated with this development. Often times, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 35 WELD COUNTY'S RIGHT TO FARM STATEMENT: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well -run agricultural activities will generate off -site impacts, including noise from tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave ZPAG22-0003 I Hill Page 7 of 8 their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sandburs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Division 17 Zoning Permits for Certain Uses in the Agricultural Zone District 1 Sec. 23-4-1200. Uses requiring zoning permits in the agricultural zone district. C. If approved, the Zoning Permit Plan shall be recorded by the Department of Planning Services prior to commencement of the USE or construction. All Zoning Permit Plans shall be digitized with electronic signatures and seals or shall be delineated in nonfading permanent black ink on Mylar or other drafting media approved by the Department of Planning Services with original signatures and seals in permanent black ink. The applicant shall pay the recording fee. If the required documents have not been recorded within ninety (90) days from the date of approval or if an applicant is unwilling or unable to meet any of the conditions within ninety (90) days of approval, the Director of Planning Services may refer the application to the Board of County Commissioners, which may revoke the zoning permit following a public hearing. The applicant shall be notified of the public hearing at least ten (10) days prior to the hearing. Prior to said hearing, the Director of Planning Services may grant a one-time extension of up to ninety (90) days, for good cause shown, upon a written request by the applicant. Before this extension has expired, the applicant may seek a further extension from the Board of County Commissioners by written request to the Director of Planning Services. If the Board of County Commissioners denies the extension or if the conditions are not met and the required documents recorded by the date specified by the Board, the zoning permit approval shall be voided, and the application denied.
