RE: APPROVE TWO-YEAR COUNTY PERSONNEL AND MERIT SYSTEM
CERTIFICATION FOR WAGNER-PEYSER ACT FUNDED EMPLOYMENT SERVICES,
AND AUTHORIZE CHAIR PRO-TEM, DEPARTMENT OF HUMAN SERVICES, AND
WORKFORCE DEVELOPMENT BOARD TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Two -Year County Personnel and Merit
System Certification for Wagner-Peyser Act Funded Employment Services among the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Human Services, Workforce Development Board, and the Colorado
Department of Labor and Employment, commencing upon full execution of signatures, with further
terms and conditions being as stated in said certification, and
WHEREAS, after review, the Board deems it advisable to approve said certification, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Two -Year County Personnel and Merit System Certification for
Wagner-Peyser Act Funded Employment Services among the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Department
of Human Services, Workforce Development Board, and the Colorado Department of Labor and
Employment, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair Pro-Tem,
Karina Amaya-Ragland, Department of Human Services, and Matthew Hortt, PhD., Workforce
Development Board, be, and hereby are, authorized to sign said certification.

Brief description of the problem/issue: The United States Department of Labor issued its final ruling regarding
the Wagner-Peyser Act which require states to use State Merit staff to provide Employment Service (ES), except
in three States —Colorado, Massachusetts, and Michigan. As a result, the rule requires Colorado to participate
in rigorous evaluation activities to be conducted by the Department to determine whether such models are
empirically supported. To ensure that Colorado is in compliance with this, and to verify that counties operating
the Wagner-Peyser program are doing so with Merit Staff, the Colorado legislature passed SB23-233 establishing
merit staffing certification requirements for Colorado counties.
In response, the Colorado Department of Labor developed the Two -Year County Personnel and Merit System
Certification that counties are required to sign.
What options exist for the Board?
Approval of the Two -Year County Personnel and Merit System Certification.
Deny approval of Two -Year County Personnel and Merit System Certification.
Consequences: Employment Services of Weld County will not have a Two -Year County Personnel Merit
Certification.
Impacts: Employment Services of Weld County will not be in compliance with SB23-233.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
Total cost = This is a no cost certification.
Recommendation:
• Approval of the Two -Year County Personnel and Merit System Certification and authorize the Chair to
sign.

Two -Year County Personnel and Merit System Certification
Each county merit system shall function under the following principles and requirements in order to be
in compliance with CRS § 8-83-205(8)(a) and (b) - Workforce development program - creation -
administration - merit system - Wagner-Peyser funded employment services (8) (a) and (b), as well as
• Intergovernmental Personnel Act of 1970.42 U.S.C. §EC._4791_ET 99Cl,
• 5 C R Dart 900. subpart F —Standards for a Merit System of Personnel Administration
• Wagner-Pevser Staffing Final Rule - Federal Register: 11-24-2023
WELD County certifies that it has a merit system of personnel administration for its
employees who deliver Wagner-Peyser Act -funded Employment Services. The County further certifies
that its Personnel and Merit System is in compliance with federal standards and that its employees paid
by Wagner-Peyser funds act as an extension of the state in delivering Employment Services. The County
further certifies that its Personnel and Merit System requires the County to do the following:
I. Recruit, select, and advance employees on the basis of the applicant's or employee's relative
abilities, knowledge, and skills, including during the recruitment and selection of qualified
applicants for initial appointments to positions with the county;
II. Compensate each employee equitably and adequately;
III. Train employees as needed to assure high quality performance;
IV. Retain an employee on the basis of the adequacy of the employee's performance;
V. Correct an employee's inadequate performance;
VI. Separate an employee from employment when an employee's inadequate performance cannot
be corrected;
VII. Treat applicants and employees fairly, including compliance with all Federal and state equal
opportunity and non-discrimination laws, in all aspects of personnel administration without
regard to political affiliation, race, color, national origin, sex, religious creed, age, or disability,
with proper regard for the privacy and constitutional rights of the applicants and employees as
citizens;
VIII. Protect each employee against coercion for partisan political purposes; and
IX. Prohibit each employee from using the employee's official authority for the purpose of
interfering with or affecting the results of an election or a nomination for office.
The County certifies that it is in compliance with the above principles and criteria for the administration
and operation of its County Personnel and Merit System for program year 2024 and has a personnel
system in place for the next program year to assure continuing compliance. The persons signing below
are authorized to undertake this certification.
