The proposed PUDF has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning Services. Staff comments made during this phase of the application process may
not be all-inclusive, as other issues may arise during theremaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: AN AMENDMENT TO SPRING MEADOWS PUD (PUDF22-0004) TO INCUDE
1041 WOGLA USES ON LOT 5 AND FURTHER CLARIFY USES ON LOTS 1-4.
This project is south of, east of, and adjacent to CR 42; and west of and adjacent to CR 15.
Parcels: 105930101001, 105930101002, 105930101003, 105930101004, 105930101005:
(Lots 1-5, respectively, PUDF22-0004)
Access is from CR 42 and CR 15.
ACCESS
Development Review has reviewed the application materials related to access.
No change in access is being proposed.
Lots 1-3 and Lot 5 will use Cedar Court to access onto CR 15, approximately 800 feet south of the
intersection of CR 15 and CR 42. This is currently an unpermitted, existing access point.
Lot 4 will access onto CR 42 at APOG24-0062 and at an unpermitted, existing agricultural access point in
the southwest corner of the parcel.
Lot 5 will access onto CR 42 at an existing unpermitted access point approximately 330 feet west of the
intersection of CR 15 and CR 42, and onto CR 42 at APOG24-0061.
The applicant shall obtain an access permit for all unpermitted, existing access locations.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Minimum
access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8 of the Weld
County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 15 is a gravel road and is designated on the Weld County Functional Classification Map
(Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall
delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of-
way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code
Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical
roadways may not be centered in the right-of-way. This road is maintained by Weld County.
County Road 42 is a gravel road and is designated on the Weld County Functional Classification Map
(Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall
delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of-
way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code

Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
The PUDF22-0004 Traffic Narrative does not need revised for this project. The Traffic Narrative stated that
there will be residential traffic only from the five residential lots. This is approximately 9 passenger vehicle
roundtrips per day per residence.
The oil and gas traffic has been addressed in 1041 WOGLA24-0018 and 1041 WOGL24-0019.
No additional traffic information is required.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UP -FRONT IMPROVEMENTS FOR
INTERNAL PAVED ROAD
PUDF22-0004 required an Improvements Agreement for on -site improvements for Subdivisions/PUDs
(Chapter 27-2-80, Chapter 24-9-20). This Agreement was recorded as Reception Number 4929779.
Road maintenance for the oil and gas traffic has been addressed in 1041 WOGLA24-0018 and
1041 WOGL24-0019.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
PUDF22-0004 included an acceptable drainage report with detention exception Sec 8-11-E.7. for residential
developments of nine (9) or fewer lots.
Stormwater management for the oil and gas development has been addressed in 1041 WOGLA24-0018
and 1041 WOGL24-0019.
No additional drainage information is required.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit was required by PUDF22-0004. While a grading permit application, dated
4/23/2023, was received and reviewed (5/10/2023 Email King to Bruxvoort), no additional information has
been received from the applicant. The application was entered as GRD23-0019, but no grading permit
has been issued.
CONDITIONS OF APPROVAL
The PUDF map shall be amended to delineate the following:
1. County Road 15 is a gravel road and is designated on the Weld County Functional Classification Map
as an local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on
the site plan the existing right-of-way. All setbacks shall be measured from the edge of right-of-way.
This road is maintained by Weld County. (Development Review)
2. County Road 42 is a gravel road and is designated on the Weld County Functional Classification Map
as an local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on
the site plan the existing right-of-way. All setbacks shall be measured from the edge of right-of-way.

3. Show and label the permitted and the unpermitted, existing access locations onto CR 15 and CR 42.
Include the width and the appropriate turning radii on the site plan. (Development Review)
4. For the internal road, Cedar Court, show the vehicular and non -vehicular traffic circulation, including
road classification, right-of-way width, road surface width and depth, and access to public right-of-way.

5. Show and label the drainage flow arrows. (Development Review)
Prior to Construction:
1. Obtain access permits for the two development accesses. It is noted that the access from Lot 4
currently has an oil and gas access permit AP24-0062. A second access permit will be required for
the development of Lot 4 per PUDF22-0004. (Development Review)
2. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to
Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the existing County right-of-way. (Development Review)
3. The PUD roadway shall be maintained to mitigate any impacts to the public road including damages and/or
off -site tracking. (Development Review)
4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an
approved Right -of -Way Use Permit prior to commencement. (Development Review)
5. Weld County is not responsible for the maintenance of onsite drainage related features. (Development
Review)
6. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review)
7. Weld County is not responsible for the maintenance on onsite subdivision roads. (Development Review)

Environmental Health Services has reviewed this amendment to Spring Meadows PUD
(PUDF22-0004) to include 1041 WOGLA uses on lot 5 and further clarify uses on lots 1-
4.
The Town of Johnstown will provide water to lots 1 through 3 and Little Thompson
Water District (LTWD) will provide water to lot 4. There is an existing LTWD tap that
serves lot 5. On -site wastewater treatment systems (OWTS) will provide sewer. The
minimum lot size of 4.79 acres coupled with an overall density of one on -site
wastewater treatment system per 16.3 acres does meet current Department policy.
The County Attorney's office has approved the water source.
The application has satisfied Sections 27 and 24 of the Weld County Code in regard to
sewer service, as indicated in the previous final plat. Due to slow percolation rates
obtained from some test holes, engineered systems may be required.
The covenants should state that activities such as landscaping (i.e., planting of trees
and shrubs) and construction (i.e., auxiliary structures, dirt mounds, etc.) activities are
expressly prohibited in the designated absorption field site.
We recommend the following appear as notes on the Final plat:
1. Water service may be obtained the Town of Johnstown or Little Thompson Water
District.
2. The parcels are currently not served by a municipal sanitary sewer system.
Sewage disposal may be by On -site wastewater treatment systems (OWTS)
designed in accordance with the regulations of the Colorado Department of
Public Health and Environment, Water Quality Control Division, and the Weld
County Code in effect at the time of construction, repair, replacement, or

3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which
shall not contribute to compaction of the soil or to structural loading detrimental
to the structural integrity or capability of the component to function as designed.
