HomeMy WebLinkAbout20243398.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, DECEMBER 30, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, December 30, 2024, at the hour of 9:00 a.m. El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli El MINUTES: 1) There being no corrections to the Minutes of the Board of County Commissioners meeting of December 11, 2024, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. 2) There being no corrections to the Minutes of the Board of County Commissioners meeting of December 16, 2024, as printed, Commissioner James moved to approve. Commissioner Buck seconded the motion and it carried unanimously. El READ ORDINANCE BY AUDIO: Commissioner James moved to read Emergency Ordinance #260-C by audio. The motion was seconded by Commissioner Buck and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on December 11, 2024, as follows: 1) RES24-0008 — Weld County Department of Planning Services, 2) PUDF24-0002 — Jeremy and Tanya Klausner, and 3) USR24-0015 — Ana Holguin Macias and Mario Contreras Guillen, Go MVJ Transports, Inc. Commissioner Buck seconded the motion, which carried unanimously. lE AMENDMENTS TO AGENDA: There were no amendments to the Agenda. Commissioner Buck seconded the motion and it carried unanimously. PRESENTATIONS: 1) RECOGNITION OF SERVICES, SHERIFF'S OFFICE - LARRY COZAD: Chair Ross read the certificate for the record. Steve Reams, Weld County Sherriff, expressed his appreciation for Larry Cozad for his unparallelled work ethic and being a silent workhorse in the Courts Division of the Sheriff's Office. He further shared it has been an honor to have worked alongside Mr. Cozad for the past eight (8) years, he represented Weld County to his very best, and wished him and his family the best in his next chapter of life. Larry expressed his gratitude for Weld County affording him the opportunity to serve people in this capacity with his late -in -life career change. The Board expressed their appreciation for Mr. Cozad's dedication to serving the citizens of Weld County, wished him luck on his future endeavors, and congratulated him on his job -well-done. (Clerk's Note: The group gathered for a photo opportunity.) Ei WARRANTS: 1) GENERAL WARRANTS - DECEMBER 27, 2024: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. El BIDS: 1) PRESENT BID #62400148, ENVIRONMENTAL JUSTICE PLAN — DEPARTMENT OF FINANCE: Toby Taylor, Purchasing Department, stated two (2) bids were received and staff will make a recommendation on January 13, 2025. Ei 2) PRESENT BID #B2400149, DESIGN AND ENGINEERING SERVICES FOR WELD COUNTY MOTOR POOL COMPLEX - FACILITIES DEPARTMENT: Mr. Taylor stated six (6) bids were received and staff will make a recommendation on January 13, 2025. la 3) PRESENT BID #B2400155, TRAFFIC SIGNAL MAINTENANCE - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor stated one (1) bid was received and staff will make a recommendation on January 13, 2025. NEW BUSINESS: 1) CONSIDER APPOINTMENT OF BRETT CAVANAGH AS DIRECTOR OF WELD COUNTY DEPARTMENT OF OIL AND GAS ENERGY: Brett Cavanagh introduced himself for the record. He shared his pleasure and honor of joining Weld County, expressed his excitement to bring his skills and knowledge to contribute to the County's values. In turn, the Board welcomed him to 'Team Weld' and provided words of encouragement, expressed their excitement and appreciation for his tenacity, and stated they look forward to working alongside him. They acknowledged the importance of the oil and gas industry, not only for Weld County, but the world at -large, and expressed their commitment to helping navigate legislative changes as they arise. Commissioner James moved to approve said appointment. The motion was seconded by Commissioner Buck and upon a roll call vote of four (4) to zero (0) with Commissioner Saine abstained. Minutes, Monday, December 30, 2024 Page 2 2024-3398 BC0016 ItEi 2) CONSIDER GRANT APPLICATION FOR 2025 COMMUNITY HEALTH ASSESSMENT SURVEY REWARD INCENTIVE PROGRAM FOR PLATTE VALLEY HOSPITAL SERVICE AREA AND AUTHORIZE DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT TO SUBMIT ELECTRONICALLY — INTERMOUNTAIN HEALTH: Jason Chessher, Director of the Department of Public Health and Environment, requested approval to apply for grant funds to provide a post -survey incentive award for the 2025 Community Health Assessment. Commissioner James moved to approve said application and authorize the Department of Public Health and Environment to submit electronically. The motion was seconded by Commissioner Buck and it carried unanimously. IE 3) CONSIDER CONTRACT ID #8954 CHANGE ORDER #3 TO AGREEMENT FOR CONSTRUCTION SERVICES FOR DEPARTMENT OF PUBLIC SAFETY COMMUNICATIONS EXPANSION AND RENOVATION (BID #B2400120) AND AUTHORIZE CHAIR TO SIGN - WCC CONSTRUCTION, LLC: Patrick O'Neill, Director of the Facilities Department, explained soft and unsuitable soils were found during Phase I of the removal of the existing asphalt by the contractor WCC Construction, LLC. He stated the cost of removal and replacement is for the total amount of $66,192.40, and staff recommends approval. Commissioner Freeman moved to approve said change order and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. '' 4) CONSIDER SALES QUOTE FOR PURCHASE OF ONE (1) USED REMIXING TRANSFER VEHICLE AND AUTHORIZE INTERIM CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS — WAGNER EQUIPMENT COMPANY: Mr. Taylor, on behalf of David Springer, Director of the Department of Fleet Services, requested to purchase one (1) used remixing transfer vehicle for the Department of Public Works from Wagner Equipment Company, for the amount of $625,755.00. He noted Section 5-4- 50 of the Weld County Code allows the Board to purchase used equipment that, by its nature, is not biddable as a practical matter, and stated staff recommends approval. Commissioner Buck moved to approve said quote and authorize the Interim Controller to sign any necessary documents. The motion was seconded by Commissioner James. Chair Ross added the importance of having machinery and equipment to improve the quality and longevity of Weld County paved roads. There being no further discussion, the motion carried unanimously. ID 5) CONSIDER ACCEPTANCE OF DEED OF DEDICATION FOR PUBLIC ROAD RIGHT-OF-WAY FOR CR 72 AND SH 257 INTERSECTION IMPROVEMENTS PROJECT, AND AUTHORIZE CHAIR TO SIGN - JOURNEY CHURCH AT WINDSOR: Dawn Anderson, Department of Planning Services, stated this, and the next item of business, are both concerning a subdivision development within the Town of Windsor which triggered roadway safety improvements at the intersection of County Road (CR) 72 and State Highway (SH) 257, to include widening CR 72 for the installation of auxiliary lanes with proper roadside ditches. She explained the developer had to acquire additional land at their expense to meet the criteria of the roadway design and Weld County's jurisdiction on the north and south sides of CR 72, east of SH 257, is the cause for the Deed of Dedication and will allow the county to continue to maintain the roadway without encroaching on private property. Ms. Anderson detailed the acreage involved with the north side of the intersection from Journey Church at Windsor, indicated staff from the Departments of Planning Services and Public Works have reviewed the matter, and stated staff recommends approval. Commissioner Freeman moved to accept said deed and authorize the Chair to sign. The motion, which was seconded by Commissioner James carried unanimously. Minutes, Monday, December 30, 2024 Page 3 2024-3398 BC0016 lEi 6) CONSIDER ACCEPTANCE OF DEED OF DEDICATION FOR PUBLIC ROAD RIGHT-OF-WAY FOR CR 72 AND SH 257 INTERSECTION IMPROVEMENTS PROJECT, AND AUTHORIZE CHAIR TO SIGN -TOWN OF WINDSOR: Ms. Anderson detailed the acreage involved with the south side of the intersection from the Town of Windsor, as described in detail in the previous item of business, indicated staff from the Departments of Planning Services and Public Works have reviewed the matter and recommends approval. Commissioner James moved to accept said deed and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. El 7) CONSIDER TEMPORARY CLOSURE OF CRS 6 AND 13 INTERSECTION: Amy Mutchie, Department of Public Works, presented the closure request on behalf of WW Clyde and Co., to begin on January 9, 2025, and go through August 19, 2025, for the roundabout improvements project located at the intersection of County Roads (CRs) 6 and 13. She provided details of the detour route, and stated message boards will be placed in advance of the closure. Commissioner Freeman moved to approve said temporary closure. The motion was seconded by Commissioner James, and upon a roll call vote of four (4) to one (1), with Commissioner Saine opposed. 8) EMERGENCY ORDINANCE NO. 260-C, IN THE MATTER OF A SUPPLEMENTAL APPROPRIATION FOR THE YEAR 2024: Jennifer Oftelie, Weld County Budget Manager, stated the emergency ordinance for consideration is the final supplemental appropriation for 2024, to allow for unexpected adjustments to be made to the 2024 Final Budget. She referenced the exhibits that detail the transfer of funds to complete unanticipated projects, repairs, and expenses. No public testimony was offered concerning this matter. Commissioner James moved to approve Emergency Ordinance #260-C. The motion was seconded by Commissioner Buck, and upon a roll call vote of four (4) to one (1), the motion carried with Commissioner Saine opposed. E Chair Ross took privilege to allow Commissioners Saine and Freeman to say their final words of encouragement and wisdom. In turn, Commissioners James and Buck, and Chair Ross, shared their heart -felt appreciation for their leadership, not only for their constituents, but Weld County citizens as a whole. (Clerk's Note: The group gathered fora photo opportunity.) PUBLIC COMMENT: 1) Edwin Grant, City of Greeley resident, offered his comments to the Board. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Emergency Ordinance #260-C was approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
